Resolution-PC 2004-139~ ~ RESOLUTfON NO. PC2004-139 ' A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL AMEND EXHIBIT N0. 7 OF THE SANTA ANA CANYON ROAD ACCESS POINT STUDY (NO ADDRESS) , WHEREAS, on January 11, 1966, the City Council adopted Exhibit No. 7 of the Santa Ana Canyon Access Point Study approving access points,between the Riverside - Newport Freeway interchange and Weir Canyon Road; and that the exhibit was approved as a logical means of providing access to properties fronting on ,, Santa Ana Canyon Road at such time as said properties developed with uses other than thosefor which they were - zoned in 1966; and that certain amendments have been made to said Exhibit No. 7 since its original appraval; and WHEREAS, the owner of a certain' irregularly-shaped parcel of land consisting of 29-acres with a frontage of .1;413 feet on the south side of Santa Ana Canyon Road, a maximum depth' of 1,125 feet, and located 1000 feet west of the centerline of Festival Drive, has requested a revision to Exhibit No. 7 of the Santa Ana Canyon Road Access Point Study; and that the applicant proposes to cohstruct a new driveway'access point on the south side of Santa Ana Canyon Road approximately 1200 feet west of the centerline of Festival Drive in connection with a proposed wedding chapel and banquet facility; and WHEREAS, theAnaheim Planning Commission did hold public hearings at the Civic Center in the ' City of Anaheim on;October 4, 2004, at 1;30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed conditional use permit anci to investigate and make findings and recommendations in connection therewith; and that said public hearing was continued to the November 1 and 15, 2004 Planning Commissionmeetings; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts . 1. That subject proposal is approved subject to an improvement plan being submitted showing the street improvements consistent with the circulation Element Plan of the General Plan to be constructed on Santa Ana Canyon Road; and 2. That 2 people indicated their presence at said public hearing in opposition; and that 26 letters were received in opposition to the subject petition; and that 4 people spoke with concerns pertaining to the subject request. CALIFORNfA ENVIRONMENTAL QUALITY ACT FINDING: Pursuant to the provisions of the California Environmental Quality Act ("CEQA"), on November 15, 2004, the Anaheim Planning Commission, by its Resolution No. PC2004-137, certified Final Environmental Impact Report No. 327, adopting a Statement of Findings of Fact and Mitigation Monitoring Plan No. 123 for (i) Conditional Use Permit No. 2001-04431, (ii) Amendment to #he Santa Ana Canyon Road Access Points Study (MIS 2004-00088), and (iii) Specimen 'Tree Removal Permit No. 2002-00001; and NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend that the City Council amend Exhibit No. 7 of the Santa Ana Canyon Road'Access Point Study to allow an additional access point on the south side of Santa Ana Canyon Road approximately 1200 feet west of Festival Drive. AND BE IT FURTHER RESOLVED that the applicant is responsible for paying all charges related to the processing of this discretionary case application within 7 days of the issuance of the final invoice or prior to the issuance of building permits forthis project, whichever occurs first. Failure to pay all charges shaU resulf in delays in the issuance of required permits or the revocation of the approval of this application. Cr\PC2004-139 -1- PC2004-139 ~ ~ BE 1T FURTHER RESOLVED that theAnaheim City Pianning Commission does hereby find and : determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any parf thereof, be declared invalid or unenforceable by the final judgment of any courf of competent jurisdiction, then this Resolution, and any approvals herein contained, sha11 be deemed null and void.
