PC2004-34 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSlON ADOPTING AND RECOMMENDWG TO THE CITY COllNCIL ADOPTION OF GENERAL PLAN AMENDMENT NO. 2004-00417 PERTAINING TO THE LAND USE ELEMENT WHEREAS, the Anaheim City Council did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, the Planning Commission did direct staff to initiate an amendment to the Land Use Element of the General Plan to redesignate that certain irregularly-shaped 0.64-acre study area located at the southeast corner of Sfonybrook Drive and Beach Boulevard from the General Commercial and Medium Density Residential land use designations to the Low-Medium Density Residentia! designation; and WHEREAS, the Anaheim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on March 22, 2004, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued to the April 5, 2004 meeting; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at the public hearing, DOES HEREBY FIND: 1. That the evidence presented substantiates the need for an amendment to the Anaheim General Plan and that, therefore, Exhibit A should be adopted redesignating subject area for Low Medium Density Residential fand uses. 2. That no one indicated their presence at the public hearing in opposition to the proposaf, and no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITYACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the Anaheim General Plan to redesignate that certain irregularly-shaped 0.64-acre property located at the southeast corner of Stonybrook Drive and Beach Boufevard, having frontages of 241 feet on the south side of Stonybrook Drive and 110 feet on the east side of 8each Boulevard, and further described as 736 South Beach Boulevard and 2966 West Stonybrook Drive from the General Commercial and Medium Density Residential land use designations to the Low-Medium Density Residential designation; and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of Anaheim adoption of General Plan Amendment No. 2004-00417, Exhibit A, pertaining to the Land Use Element to redesignate the study area from the General Commercial and Medium Density Residential land use designations to the Low-Medium Density Residential designation land.
