RESOLUTION NO. PC2004-93
A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITM
CONDTIONAL USE PERMIT NO. 275 ` _
(119 WEST BALL ROAD)
WHEREAS, on July 23, 1962, the Anaheim Planning Commission did, by its Resolution No.
420, granf Conditional Use Permit Na 275 to construct a walk-up restaurant at 119 West Ball Road; and
WHEREAS, Randal Kimoto, representing the property owner, has submitted the attached letter
dated February 2, 2004, requesting termination of Conditional Use Permit No. 275 to compfy with the Conditions
of Approval of No: 10 of Resolution No. PC2003-63, for Conditional Use Permit No. 2003-04678 (to permit the
expansion of an existing fast food restaurant with waiver of minimum number of parking spaces) approved by
the Planning Commission on April21, 2003, requires theproperty owner to submit a letterto theZoning Division
requesting termination of Conditional Use Permit No. 275 since this entitlemenYis no longerneeded.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Planning Commission does hereby
terminate all proceedings in connection with on the basis of the foregoing findings. '

BE IT FURTHER RESOLVED thatthe Anaheim Planning Commission does`hereby find and
determine that adoption of this Resolution is expressly predicated upon applicanYs compliance with each and all
of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
September 8, 2004. Said resolution is subject to the appe ovisions set focth in Chapter 18.60 "Procedures"
of the Anaheim Municipal Code pertaining to appeal p ures _ may b e by a City Council
Resolution in the event of an appeaL ----
