PC2004-96 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION TERMINATING ALL PROCEEDINGS IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 4051 : (1750 WESTPENHALL WAY) WHEREAS, on August 18, 1998, the AnaheimPlanning Commission did, by its Resolution No. PC98-132, grant Conditional Use Permit No. 4051 to permit a:10,644 square foot 2-story expansion of an existing 13,165 square foot telecommunications'switching station and to construct a maximum 65 foot high roof- mounted #elecommunications tower at 1750 West Penhall Way; and ' WHEREAS, Paul Rothenberg, representing the property owner, has submitted the attached letter dated July 22, 2003, requesting termination of Conditional Use Permit No. 4051 (to permit a 10,644 square foot 2-story expansion of an existing 13,165 square foot telecommunications switching station and to construct a maximum 65 foot high roof-mounted telecommunications tower) approved by the Planning Commission on April 21, 2003. The applicant has indicated that though the existing tower was demolished, there is no need to construct the replacement tower authorized by Conditional Use Permit'Na 4051 because the anticipated transmission facilities are no longer necessary; and NOW, THEREFORE, BE IT RESOLVED that the Anaheim Planning Commission does hereby terminate all proceedings in connection with Conditional Use Permit No: 4051 on the basis of the foregoing findings. BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby find and determine that adoption of this Resolution. is expressly predicated upon,applicanYs compliance with each and all of the conditions hereinabove set forth. Should any such condition, or anypart thereof,'be declared invalid or unenforceable by the final judgment of any court of competentjurisdiction, fhen this Resolution, and any approvals herein contained, shall be deemed null and void. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of September 8, 2004. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 "Procedures" of the Anaheim Municipal Code pertaining to appeal proce ure ay b re ed by a City Council Resolution in the event of an appeal. .
