Resolution-PC 2005-21• ~ RESOLU710N NO: PC2005-21 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION TERMINATING ALL PROCEEDINGS IN CONNECTION WITH VARIANCE NO. 153 : (1126 NORTH EUCL4D STREET) ' WHEREAS, on October 3, 1951, theAnaheim Planning Commission, by its Resolution No. 7 Series 1951-52, grant Variance No. 153 to construct an addition to an existing building in the RM-3 zone at 1126 North Euclid Street; and WHEREAS, A. Hsieh property owner has submitted aletter requesting termination of Variance No. 153 to comply with the Condition of approvalNa 30 of Resolution No. 2002R-210, Conditional Use Permit No. 2002-04554 (to construct a 32-unit attached condominium'subdivision with waivers of required improvements of private streets, maximum fence height, minimum dimensions of parking spaces, minimum building setback, and minimum width of pedestrian accessways) approved by the City Council on September 24, 2002, requires the property owner to submit aletter to the Planning Services Division requesting termination of Variance No. 153 since this entitlement is no longer,needed. ' NOW, THEREFORE, 8E IT RESOLVED that the'Anaheim City Planning Commission does hereby termina4e all proceedings in connection with Variance No. 153 on the basis of the foregoing findings: BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and defermine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
