THE SIDELINES OF SAID STRIP SHALL BE LENGTHENED OR SHORTENED SO AS TO-0RIGINA7E IN THE NORTHERLY LINE OF PARCEL I, HEREINABOVE DESCRIBED, AND TO TERMINATE IN THE SOUTHERLY LINE OF KATELLA AVENUE. WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on February 22, 2006, at 2:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed non-residential condominium hotel for financing purposes is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.14.030.090 (Additional Uses in the PR Zone); 2. That the proposed use will not adversely affect the adjoining land uses or the growth and development of the area in which it is proposed to be located because no physicaf or operational changes, outside of the financing of the hotel, are proposed; -3- PC2006-19 ~ ~ , 3. That the size and shape of the site proposed for the use is adequate to allow the fu11 development of the proposed use in a manner not detrimental to the particular area ar to the health and safety because no physical or operational changes, outside of #he financing of the hotel, are proposed; 4. That the traffic generated by the proposed use wiil not impose an undue burden upon the streets and highways designed and improved to carry the tra~c in the area because no physical or operationai changes, outside of the financing of the hotel, are proposed; and : 5. That the granting of the conditional Use permit under the conditions imposed, if any, will not be detrimental to the health and safety of the citizens of the City of Anaheim because there are no changes to the existing land use as the hotel will continue to operate in the same manner as it does presently. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. CAUFORNIA ENVIRONMEN7AL QUALITY ACT FINDING: The Planning commission concurs with staff that the proposed project falls within the definition of Categorical Exemptions; Section 15301, Class 1(Existing Facilities) and Class 15 (Minor Land Divisions), as defined in the State CEQA Guidelines and is, therefore, exempt from the requirement to prepare additional environmental documentation. NOW, THEREFORE, BE IT RESOLVED that the Anaheim Planning Commission does hereby grantsubject Petition for Conditional Use Permit, upon the following conditions which are hereby ' found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. Ongoing during project operation, with the exception of the proposed financing structure, the non-residential condominium hotel for financing purposes, including sale of individua( units to investors, shall be maintained and operated as a hotel as approved by Conditional Use Permit No. 2288. 2. Ongoing during project operation, Transient Occupancy Tax shall be collected for all hotel rooms as set forth in Chapter 2.12 (Transient Occupancy Tax) of the Anaheim Municipal Code. 3. Ongoing during project operation, owners use of airspace condominium units shatl be limited to seven (7) days per unit not to exceed twenty-eight (28) consecutive days per calendar year regardless of the number of condominium units under the same ownership and shall be subject to the payment of Transient Occupancy Tax based upon the hotel room rate of a comparable hotel room. 4. The CC&Rs and Master Lease shall not be amended or terminated without the prior written approval of the Planning Director and modification of land use permits as may be required to authorize and reflect the changes in the CC&Rs and/or the Master Lease. 5. Ongoing during project operations, the property and the existing structure shall continue to be operated and maintained as the Anaheim Hilton Hote1 or a hotel of comparable quality and shall be managed, maintained and operated by a single qualified professional entity . 6. Ongoing during project operations, at no time sha{{ the hotel rooms be occupied as residential dwelling units. 7. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations: Approval does not include any action or findings as to _4- PC2006-19 • ~ compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby find and determine that adoption of this Reso{ution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the finai judgment of any court of competent jurisdiction, then this Resofution, and any approvals herein contained, shall be deemed null and_void. BE IT FURTHER RESOLVED that the applicant is responsibie for paying all charges related to the processing of this discretionary case application wifhin 15 days of the issuance of the finaf invoice or prior to the issuance of building permits for this project, whichever occurs first: Failure to pay all charges shall result in defays in the issuance of required permits or the revocation of the approval of this application. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of February 22, 2006.
