PC2007-27 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION RECOMMENDING TO THE CiTY COUNCIL ADOPTION OF`GENERAL PLAN AMENDMENT N0: 2007-00451 PERTAINING TO TME LAND USE ELEMENT (1128 WEST LINGOLN AVENUE AND 1221 WEST CENTER STREET) WHEREAS, the Anaheim City Council did adopt the A-~aheim Genecal Plan by Resolution No. 69R-644, showing the general description and extent of possible future development within the City; and WHEREAS, on May 25, 2004, the City Council, by its Resolution No. 2004-95, adopted a comprehensive update to the Generaf Plan for the Cify of Anaheim; and : WHEREAS, The City did receive a verified petition requesting an amendment to the`General Plan to amend the Land Use Element of the General Plan from the Low Density Residential land use designation to the Mixed Use designation on aproperty as shown in the attached map marked Exhibit A. WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of ' Anaheim on Apri! 2, 2007; at 2:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 "Procedures' ; to hear and consider evidence for and against said proposed General Plan Amendmeni and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed mixed use development would comply with the density limitations and land ' use types identified for the Mixed Use General Plan designation. 2. That the proposed amendment relates to the established land use patterns in the vicinity and therefore, said amendment woutd be compatible with, and further the goals of said Plan and therefore, Exhibit A should be adopted redesignating the subject property from the Low Density Residential land use designation to the Mixed Use land use designation. 3. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Planning Commission has reviewed the proposal to~redesignate subject property from the Low Density Residential land use designation to the Mixed Use land use designation and does hereby approve the Negative Declaration upon : finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project. will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that pursuant to the above findings, the Anaheim Planning Commission does hereby recommend to the City Council of the City of Anaheim adoption of Generat Plan Amendment No. 2007-00451 pertaining to the Land Use Element to redesignate the propertyfrom the Low Density Residential land use designation to the Mixed Use land use designation. Cr\PC2007 27 -1- PC2007-27 ~ ~ BE IT FURTHER RESOLVED that the applicant is responsible for paying all charges related to the processing of this discretionary case application within 15 days of,the issuance of the final invoice or prior to the issuance of building permits for this project, whichever occurs first. Failure to pay all charges shall result in delays in the issuance of required permits or the revocation of the approval of this application. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of April 2, 2007. Said resolution is subject to the appeal provisions set forth in Chapter 18.
