Mayor Krein called the meeting to order. PRESENTATION OF HEALTH AWARDS - ANAHEIM RESIAURANTS: Councilman Schutte and Mr. Pet:it, of the Orange County Health Department, presented Award of Excellence Plaques to %he following restaurant establishments: Caravan Inn, 130 East Katella Avenue Carl~s Donut Kitchen, 1755 ~est La Palma Avenue M.AoB \fending, 1501 East Santa Ann Freeway On beha].f of the City Council, Mayor Krein thanked Mr. Pettit, and congratulated the awardees on their achievement~ MINUTES: Approval of the Minutes of the Anaheim City Council meetings held December 14~ 21 and 28, 1965, was deferred one week (January 11, 1966). ~AIVBR OF READING - ORDINANCES AND RESOLUTIONS: Councilman Dutton moved to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading is hereby given by all Councilmen, unless after reading of the title, specific request is made by a Councilman for the reading of such ordinance or resolution. Councilman Chandler seconded the motion. MOTION UNANIMOUSLY CARRIED. PUBLIC HEARING - ABANDONMENT: Public hearing was held on proposed abandonment of a portion of former Anaheim Union ~ater Company eight foot right-of-way easement, property located on the north and west boundaries of T. raCt No. 1599 (north side of Vermont Avenue, west of the Atchison; Topeka and Santa Fe Railway Righ't-of-.~ay), pursuant to Resolution No. 65R-913, duly published in the Anaheim Bulletin December 23, 1965, and notices thereof posted in accordance with law. The Mayor asked if anyone wished to address the City Council. There was no response. The City Manager reported that costs to the City for processing abandonments average $138~91 each, and in contacting nine other cities, it was found Aha: six of them require a fee for abandonment requests.' He recommended that when abamdonments are requested by private parties or companies, a fee be required to provide recovery of processing costs. The City Attorney fdrther explained abandonment procedures, and advised ~hat many are requested by the property owners [or the purpose of clearing title to their land. Councilman Chandler moved that the public hearing be continued to February 8, 1966,-1:30 P.M., to determine the feasibility of recovering abandonment costs when said abandonments are instigated by the property owner. Councilman Dutton seconded the motion. MOTION CARRIED. PUBLIC HEARING - ABANDONMENT: Public hearing was held on proposed abandonment of a portion of Anaheim Union ~ater Company drainage easement, property located on the north boundry of Lots 17, 18, 19 and 1gA; Tract No. 255 (north of Cypres~ Street, west of State College Boulevard), pursuant to Resolution No. 65R~.914, duly published in the Anaheim Bulletin, December 23, 1965, and notices thereof posted in accordance with law. On motion by Councilman Chandler, seconded by Councilman Dutton, public hearing was continued to February 8, 1966, 1:30 P.M., to determine the feasibility of recovering abandonment costs. MOTION CARRIED. DINNER DANCING PLACE PERMIT: Application filed by James V. Gimondo for Dinner Dancing Place permit at the Casa Roma Restaurant, 1740 West La Palma Avenue, was submitted and granted, subject to the recommendations of the Chief of Police~ on motion by Councilman Dutton, seconded by Councilman Schutte. MOTION CARRIED. RECLASSIFICATION NO. 55-56-27: Communication dated November 18, 1965, from Harold Morrison, Secretary, Forest Lawn Cemetery Association, requesting two year extension to waiver of block wall construction on the east property line, was submitted together with departmental reports (C-i and R-A property located at the southeast corner of State College Boulevard and Lincoln Avenue)~ Two year extension of time was granted, as requested, on motion by Councilman Dutton, seconded by Councilman Pebley. MOTION CARRIED. APPLICATION - FAMILY BILLIARD CENTER: Application submitted by Maximillian John Marion, Golden Cue Corporation, for permission to conduct family billiard center at 1813 South Manchester Avenue, was submitted together with report and recommendation of the Chief of Police. (C-1 property - Reclassification No. 61-62-31). Permit To conduct family Silliard center was granted by the City Councl], in accordance with Section 4~24.040 of the Anaheim Municipal Code, on motion by Councilman Chandler, seconded by Councilman Pebley. MOTION CARRIED. ORANGE COUNTY USE VARIANCE NO. 5666: Proposing to establish an automobile leasing agency office in an existing residence zoned R-P, Residence Pro- fessional lonel property located 750 feet north of Lincoln Avenue on the west side of' Brookhurst Street. Ihe City Planning Commission, at their meeting held January 3, 1966, recommended that the Orange County Planning Commission be urged to require any dedication needed for the ultimate widening of Brookhurst Street to its 60-foot half width in their consideration of Orange County Use Variance No. 5666. On motion by Councilman Chandler, seconded by Councilman Schutte, the C:ty Council concurred with recommendations of the City Planning Com- mission, and ordered a copy thereof forwarded to the Orange County Planning Commission. MOTION CARRIED. PRECISE ALIGNMENT - LA PALMA AVENUE: Consideration by the Orange County Planning Commission of the Precise Alignment of La Palma Avenue, between the Anaheim Cit:y limits on the east and Imperial Highway. The City Planning Commission at their meeting held January 3, 1966, recommended that the Orange County Planning Commission, in conjunction with the above consideration~ establish a setback policy for any future develop- ment in the northeast industrial area, by requiring that all buildings be setback 103 feet from the ultimate center line of La Palma Avenue. Associate Planner Ronald Thompson advised that if adopted, the foregoing recommendation would result in a 50-foot building setback from property lines, in accordance with the City of Anaheim:s 50-foot policy in the M-1 Zone. On motion by Councilman Chandler, seconded by Councilman Pebley, the City Council concurred with the recommendations of the City Planning Commission, and ordered a copy thereof forwarded to the Orange County Planning Commission. ANAHEIM STADIUM (COLVIN PROPERTY): On the recommendation of the City Attorney, Councilman Chandler moved that the City Attoney's office be authorized to enter into and file stipulation of value on the Colvin property (Aeroc, Inc~ - Eminent Domain Complaint No~ 1233051 Anaheim Stadium site, approximately nine net acres), at $32,500.00 per net acre. Councilman Schutte seconded the motion. MOTION CARRIED. PROPOSED YORBA LINDA ANNEXATION - LOCAL AGENCY FORMATION COMMISSION DECISION: Councilman Chandler referred to the decision rendered by the Local Agency Formation Commission of Orange County relative to disapproval of the pro- posed Yorba Linda Annexation, being of the opinion that the decision was an arbitrary act on the part of the Commission, and should not have been made on the basis of a moratorium, thereby denying the Yorba Linda citizens their rzght to vote on the issue of annexation to the City of Anaheim. To clarify the authority and position of the Local Agency Forma- tion Commission, iz was moved by Councilman Chandler, seconded by Councilman Dutton, that the City Attorney be instructed to contest the decision rendered in the matter of the proposed Yorba Linda Annexation. MOTION CARRIED. ANAHEIM STADIUM WATER VAULTS - WORK ORDER NO. 1882: Mr. Murdoch reported that seven invitations for informal bids were forwarded to various contractors for the necessary construction of water vaults at Anaheim Stadium, Work Order No. 1882; however, only one proposal was received. Due to the fact that work should ce commenced immediately, as time is of the essence so that work may proceed on paving of the parking areas, he recommended acceptance of the only bid, that of Pebley Brothers, in the amount of $3,458~00. On the recommendations of the City Manager, Councilman Schutte moved that the bid of Pebley Brothers, in the amount of $3,458.00, be accepted. Councilman Chandler seconded the motion. MOTION CARRIED. CLAIM AGAINST THE CITY: Claim submitted by Wallace C. Huber for damages purportedly resultmng from failure of a distribution transformer, on or about December 7, 1965, was denied and referred to the City Attorney and City's Insurance Agent, on motion by Councilman Dutton, seconded by Councilman Schutte~ MOIION CARRIED. (65-66-34 - C-O) ALCOHOLIC BEVERAGE LICENSE APPLICATION: Application submitted by Harold C. and Gloria .3, Grays for New On-Sale Beer license~ at 1i60 North Dowling Street (use established at a time permissible ir: an M-1 Zone)~ 'was presented to the City Council by the City Manager for their information° No action was taken on the foregoing application. MID-YEAR SALARY REVIE~ Council consideration of Personnel Department recom- mendations for Mid-Year Salary Adjustments was continued from the meeting of December 28, 1965, to allom the various organizations sufficient time to analyze the recommendations~ Mr. Jack Peterson~ Senior Personnel Analyst, briefly commented on various issues raised by the Anaheim Municipal Employees Association, as nozed in their letter dated December 29, 1965, and explained the method used by the Personnel Department in arriving at the rates which, in their opinion, were proper rates° 9161 City Hail~ Anaheim~ California ~- COUNCIL MINUTES - January 4~ 19669 1:30 P.M. Regarding "un-used sick leave", Mr. Peterson reported that the Personnel Department 'was not ready to make a recommendation at this time° Regarding the establishment of a "longevity plan", Mr. Peterson advised that the existing plan is a "merit system", paying for performance° Mr. Fredrick H. Nard, representing the Anaheim Municipal Employees Association~ referred to recommendations contained in the Association's letters dated December 14 and 29, i965, being of the opinion that further study and report from the City Manager and Staff was warrantedo The specific classifications contained in their communications were commented upon, and Mr~ Ward advised of the basis upon which each classifica'tio~ in his opin~on~ warranted advancement° Mr. Hard further reported that 13% of California cities have a "longevity plan", however he felt at 'the present time that the Personnel Department had not had sufficient time to analyze material, submitted on this s~:bje~ t In conclusion, Mro Hard requested the Personnel Department be directed to submit a report regarding un~.used sick leave by February 1, 1966~ Mr,~ D ' al.~as Lore, of Local Union No~ 47; International Brother- hood of Electrical ~orkers~ briefed contents of his letter dated December 29, 1965~ copies of ~hich had been sent to eachC, ounc~zman;" and he noted points contained r. he:rein, Mr~ Lore referred to requested studies of various positions in the Electrical Department which have not been received. At the conclusion of the discussion that followed~ Council action on the recommended salary adjustments was continued one week (January 11, 1966~ 1:30 ANAHEIM JIINEY TRANSPORTATION SYSTF~; Mayor Krein read communication dated ,January ~ 1966~ from Mr. Thomas G. Jaeger of Anaheim Jitney Transporta- tion System~ proposing the formation of a Jitney Association, and requesting the City to grant an exclusive franchise to operate the system. Councilman Chandler moved that said letter be received and filed, that public discussion before the City Council be scheduled January 18, 1966~ 1:30 P.M.~ to determine whether the Council. can grant such a fran- chise, and 'the City Attorney be requested ~o advise the Council of their position in this matter, as it relates to the Public Utilities Commission. Councilman Schutte seconded the motion. MOTION CARRIED. REPORI - PROPOSED ~ELL ABANDONMENT~ Mro Murdocb reported on a well located on property at the southwest corner of Orangewood Avenue and Harbor Boulevard, advising that the privately-owned well is apparently out of use, that the matter has been referred to the City Aztorney's office and the owner of the well notified of Anaheim Municipal Code provisions regulatin9 the abandonment of wells. REQUEST - ORANGE COUNTY BOARD OF SUPERVISORS~ The City Manager advised of request received from the Orange County Board of Supervisors that the City of Anaheim participate in hosting the Board of Supervisors of Orange County, Florida, during the week of January 17, 1966. In response to the foregoing request, the City Clerk was instructed to forward an affirmative answer to the Orange County Board of Supervisors, on motion by Councilman Chandler, seconded by Councilman Dutton.
