DEMANDS AGAINST THE CITY: Demands against the City in the amount of $1,109,353.93, in accordance with the 1965-66 Budget, were approved. PUBLIC HEARING - ABANDONMENT: Public hearin9 was held on proposed abandonment of a perpetual easement and right-of-way for street purposes, located on the west side of Beach Boulevard, south of Orange Avenue; pursuant to Resolution No. 66R-368, duly published in the Anaheim Bulletin June 2, 1966, and notices thereof posted in accordance with law. . Mayor Pro Tem Pebley asked if anyone wished to address the City Council, there being no response, declared the hearing closed. The City Council reviewed report of the City Engineer, dated May 27, 1966, recommending approval Of s&id bbandonment. PROTEST - KATELLA PARK IMPROVEMENT ASSOCIATION: Communication dated April 29, 1966, from Ted L. Welander, Katella Park Improvement Association, protesting the use of residences at 2213, 2217 and 2221 West Midwood Lane, as Special Care Institutions, was submitted for Council review together with report from the Zoning Division. 948~ City H~ll~ Anaheim~ California - COUNCIL MINUTES - June 14~ 1966~ 1:30 P.M, . Mayor Pro Tem Pebley asked if a representative of the association wished to address the City Council. Mr. Ted Welander, 2225 West Midwood Lane, representing Katella Park Improvement Association, advised that they are protesting the use of the three residences for business purposes in a residential zone; that the structures were being used for care of mentally retarded persons~ and residents were concerned that the use might be expanded to additional dwellings. In answer to Council questioning, Mr. Welander described how the three homes Were purchased, one at a time, for expansion of facilities at the convalescent home for ambulat'ory elderly persons,located at 1745 South Brookhurst Street, and he was of the opinion that it was a business proposition. City Attorney Joseph Geisler reported that investigations of the complaint have indicated that the number of persons living in the three dwellings is not in excess of the Anaheim Municipal Code Provisions; that the Code definition of a family includes five unrelated persons, not including servants. If any fees were collected for the care of these people, it would be comparable to fees charged for support and room in private homes. Mr. Welander was of the opinion that the homes in question were used for clinics and for special care institutions rather than for re'sidential purposes, and ,~as an opening for other businesses in their neighborhood. Discussion was held by the City Council, and at the conclusion thereof, Councilman Chandler moved that determination on the foregoing issue be continued to July 5, 1966, 7:00 P.M., for further investigation and report from the City Attorney and Development Services Department as to the exact status of the three dwellings in question; it being noted that the owners of subject property will be given an opportunity to address the Council at that time. Councilman Schutte seconded the motion. MOTION CARRIED. Mr. Joe Farber briefly addressed the City Council as a disinterested part?, highly commending the operators of the Convalescent Home and the three facilities on Midwood Lane for the outstanding work being done with people under' their charge. Interested parties in the audience were advised that no further notice of the, July 5, 1966 continuance would be given. REQUEST - TENT PEPA4IT: Request of Don Gray, of Southeastern California Conference of Seventh-Day Adventists, dated May 31, 1966, was submitted requesting permission to erect a tent on the north side of Lincoln Avenue, between Crescent Avenue and Muller Streets, to be used for meetings from August 16 through September 19, 1966. Also submitted and reviewed by the Council were reports from the Police and Fire Departments. On the recommendations of the Chief of Police, the Fire Department and the City Manager, Councilman Dutton moved that permit to erect the tent be granted, subject to the provisions of Council Policy No. 605; and further subject to the following conditions: 1. 'That a floor plan of the tent be submitted showing aisles, seating and exits. 2, That flame proofing certificate for tent be submitted. 3, Seats shall be bonded together in groups of no less than three (3) nor more than seven (7). Councilman Schutte seconded the motion. MOTION CARRIED. SIGN REQUEST - 135 NORTH ~NAHEIM BOULEVARD: Request of Herb Luttrell of Nu Art Sign Company, for permission to erect an advertising display with four foot projection over the right-of-way, for LaCasita Mexican Restaurant at 135 North Anaheim Boulevard, was submitted and reviewed by the City Council 9485 Clt¥ Hall~ Anaheim~ California - COUNCIL MINUTES - 3uno 14~ 1966~ 1:30 P.M. together with plans and reports from the Building and Zoning Divisions. On motion by Councilman Chandler, seconded by Councilman Dutton, said request was granted, subject to the lowest portion of the sign being located a minimum of ten feet above the sidewalk. MOTION CARRIED. CONDITIONAL USE PERMIT NO, 121: Communication dated May 20, 1966, from Harry Knisely, Attorney for William Behnke, owner of Mobile Home Park approved under Conditional Use Permit No. 121, was submitted requesting removal of 90 day time limit for duration of stay for travel trailers. Also submitted and reviewed by the City Council were reports from the City Engineer and Development Services Department. Mr. Knisely addressed the Council advising that the request was a matter of economics as the volume of their business fluctuates with the seasons. He noted that provisions of the Anaheim Municipal Code have been complied with, and that similar trailer parks in the City of Anaheim were not limited to any specific time for vacation trailers. Discussion was held by the City Council and City Attorney, and Mr. Geisler reported that the time limitation was established because the trailer spaces on subject property were smaller than the minimum standards for trailer parks. He recommended that the matter be considered at a public hearing. Councilman Chandler moved that the City Attorney review the State Code to determine if a new classification might be established whereby over-night trailer parks may be permitted by conditional use permit without changing established standards for permanent mobile home parks; and further moved that Conditional Use Permit No. 121 be re-activated and public hearing scheduled before the City Council, to be heard in conjunction with the City Attorney's and City Planning Commission's reports, subject to payment of $50.00 filing fee by the applicant. Councilman Schutte seconded the motion. MOTION CARRIED. CITY PLANNING CO~ISSION ITEMS: Actions taken by the City Planning Commission at their meeting held May 23, 1966, pertaining to the following applications, were submitted for City Council information and consideration: CONDITIONAL USE PERMIT NO. 838: Submitted by George E. Hansenyager re- questing permission to establish a service station at the intersection of a major street and a collector street; C-1 property located at the north- east corner of Clementine Street and Katella Avenue (231 West Katella Avenue). The City Planning Commission pursuant to Resolution No. 2042, Series 1965-66, granted said conditional use permit, subject to conditions. coNDITIONAL USE PERMIT NO. 841: Submitted by R. F. Buchheim, William D. Greschner and Henry Steinbrink, et al, requesting permission for an auto- mobile and truck overhauling, painting, mechanical, and body and fender repair establishment in an existing structure; M-1 property located at 255 North Manchester Avenue. Pursuan~ to Resolution No. 2043, Series 1965-66, the City Planning Commission granted said Conditional Use Permlt~ subject to conditions. CONDITIONAL USE PERMIT NO. 843: Submitted by Owen A. Murray, requesting permission to establish an existing nonconforming u~ (walk-up restaurant) ina new structurel C-2 property located at the southwest corner of Citron Street and Lincoln Avenue (800 West Lincoln Avenue). Granted by the City Planning Commission, subject to conditions, pursuant to Resolution No. 2045, Series 1965-66. CONDITIONAL USE PERMIT NO. 702 - EXTENSION OF TIME: Excerpt from the minutes of the City Plannin9 Commission meeting held May 23, 1966, granting six months extension of time to Conditional Use Permit No. 702, was submitted. CONDITIONAL USE PERMIT NO. 787 - EXTENSION OF TIME: Excerpts from the minutes of the City Planning Commission meeting held May 23, 1966, granting one year extension of time to Conditional Use Permit No. 787, was submitted. VARIANCE NO. 1755 - TERMINATION: The City Planning Commission, pursuant to Resolution No. 2057, Series 1965-66, terminated Variance No. 1755 in accord- ance with request of the petitioner. The foregoing actions were reviewed by the City Council and no further action taken on the above numbered conditional use permit and variance applications. Councilman Chandler left the meeting, 2:30 P.M. CONDITIONAL USE PERMIT NO. 842: Submitted by Ben J. Hess, requesting permission for on-sale beer in conjunction with an employee cafeteria; M-1 property located at 237 North Euclid Street, Building "L". The City Planning Commission, pursuant to Resolution No. 2044, Series 1965-66, granted said conditional use permit, subject to conditions. It was noted by the City Council that no hours of operation were specified by the'City Planning Commission action; thereupon, on motion by Councilman Dutton, seconded by Councilman Schutte, review of action taken by the City Planning Commission was ordered, and the City Clerk was instructed to schedule public hearin9 before the City Council, unless the applicant files written stipulation as to the hours of operation and as reported to the City Planning Commission. GENERAL PLAN AMENDMENTS NOS. 75 & 78: On motion by Councilman Dutton, seconded by Councilman Schutte, the City Clerk was instructed to schedule public hearing July 5, 1966, 1:30 P.M., to consider City Planning Commission Resolution No. 2050, Series 1965-66, recommending approval of amendment to the Circulation Element - Highway Rights-of-Way - Table of Exceptions of the Anaheim General Plan to include Haster Street; and further to include City Planning Commission Resolutions Nos. 2051 and 2052, Series 1965-66, recommending approval of amendment to the Circulation Element - Highway Rights-of-Way - Expressway and Santa Aha Canyon Road. STREET NAME CHANGES - PALM LANE AND MALL LANE: Zoning Supervisor Ronald Thompson briefed action taken by the City Planning Commission recommending that the north-south Palm Lane be renamed Palm Way (south of Ball Road, east of Euclid Street), and that the Mall Lane cul-de-sac be renamed Mall Way (north of Broadway~ west of Gilbert Street), pursuant to Resolutions Nos. 2054 and 205~, Series 1965-66. BASTRUP: The City Manager reported that the Big Brothers of Orange County Organization, has selected Anaheim Police Lieutenant Harold A. Bastrup as "Father of the Year". The City Council instructed the City Clerk to prepare a resolution of commendation for Lieutenant Bastrup. TRANSFER OF FUNDS: On report and recommendation by the City Manager, Councilman Schutte moved that transfer of funds, in the amount of $5,100.00, be authorized from the Council Contingency Account to the Stadium Account, said amount to pay the unbudgeted portion of the salary for the owner's representative at Anaheim Stadium to July 1, 1966. Councilman Dutton seconded the motion. MOTION CARRIED. FIREWORKS PERMITS: Mr. Murdoch reported on requests received for fireworks permits to allow public displays, as follows: a. Request of Atlas Fireworks Company, Inc., for public display of fireworks at all home games of the California Angels at Anaheim Stadium. b. Request of Tommy Walker Enterprises for public display of fireworks at patriotic program to be held July 4, 1966, at Anaheim Stadium. On motion by Councilman Dutton, seconded by Councilman Schutte, said permits were granted, as recommended by the Fire Department. MOTION CARRIED. Stephenson with the 1965 National Safety Award issued by the National Police Officers Association of America to the Anaheim Police Department in recognition of substantial reduction in traffic accidents and fatalities in the City. Chief Stephenson accepted the Award on behalf of the Police Department and stated that efforts in maintaining a good traffic safety record are continuous. RESOLUTION OF CO~ENDATION. - LIEUTENANT HAROLD A. BASTRUP: Mayor Krein read Resolution of Commendation, signed by the Anaheim City Council, congratulating Anaheim Police Lieutenant Harold A.
