PRESENT: ABSENT: PRESENT: COUNCILMEN: Dutton, Pebley, Schutte, Chandler and Krein. COUNCILMEN: None. CITY MANAGER: Keith A. Murdoch. CITY ATTORNEY: Joseph Geisler. DEPUTY CITY CLERK: Alona M. Farrens. CHIEF OF POLICE: Mark A. Stephenson. Mayor Krein called the meeting to order. PUBLIC HEARING TO REVIEW CONDITIONAL USE PERMIT NO. 186 AND ORDER TO SHOW CAUSE: The City Council at their Special Meeting held November 17th, 1966, set this date and hour as the time to hold and conduct a public hearing to review Conditional Use Permit Noo 186, and to determine whether said conditional use permit should be revoked pursuant to Section 18o64.050 of the Anaheim Municipal Code. Notice of said public hearing and order to show cause having been duly served on the parties concerned, Mr. Leo Freedman, 2018 Coldwater Canyon Drive, Beverly Hills, California, and Mr. Sammy Lewis and Danny Dare, Melodyland Theatre, 10 Freedman Way, Anaheim, California. The Mayor announced that he had been informed that Mr. Danny Dare or his Attorney wished to make a statement at this time. Mr. Charles Schlegel, Attorney representing Melodyland Theatre stated, in every controversy there should be consideration given to re- solving same with a full understanding of the issues on both sides; that as result of working with City Attorney Joseph Geisler, he personally came to understand in greater depth the problem of the City in protecting its image. Mr. Schlegel introduced Mr. Danny Dare who would present a statement on behalf of Melodyland. Mr. Danny Dare, 235 West Orangewood Avenue, Anaheim, California, personally and on behalf of Melodyland, read in full communication to the City Council, wherein, based on the spirit of cooperation, they agreed, for a period of one year, that Melodyland will not present any reviews or productions where nudity such as the models of "Vive Les Girls" constitutes part of the productions. That this statement is made on the assumption that valid regulations will be forthcoming, controlling this area of the 9824 City Hall, Anaheim, California - CpUNCIL MINUTES - November 28~ 1966~. 2:00 P.M. entertainment media, feeling that a distinction between a legitimate theatre production and the topless cocktail lounge activity will be more clearly defined in the near future° That the production of Vive Les Girls will continue to be presented through this booking in its present form because they feel committed to present this review in the manner in which it is expected to be presented by the many persons who have purchased tickets for said review. Mr. Dare requested that this public hearing be dismissed and that the action on their sign be rescinded, so that that sign continues to aid and assist in directing the public to the theatre. Said communication and statement were filed for record with the Deputy City Clerk. Councilman Dutton stated he was very happy to see this attitude on the part of Danny Dare and Melodyland Theatre, as he believed this was simply a matter of cooperation in this area that most of us feel is detrimental to the fine image of Anaheim that has taken many years to create. Councilman Dutton moved for dismissal of the Order To Show Cause on Conditional Use Permit No. 186, and to rescind the action taken by the City Council on November 17th, 1966, wherein the City Attorney was instructed to take necessary action to cause removal of the Melodyland sign encroaching on City right-of-way. Councilman Chandler seconded the motion. Mayor Krein asked if anyone had any questions. Councilman Schutte asked that the City Attorney explain to the audience the action before the Council. City Attorney Joseph Geisler explained the concern of the Council that this show may establish a trend for topless or semi-nude entertainment throughout the City of Anaheim. That the solution presented would permit the production of Vive Les Girls through its present booking, in the same fashion as it is presently showing, however, like shows would not be permitted in the future for at least a period of one year. During this year there is presently in the Legislature in California, a bill to clarify the question whether City Councils will or do have the right to regulate nudity in live entertainment. If such legislation has not been accomplished within a year, then the City Council and Melodyland Theatre will again meet and discuss a compromise or settlement on what will occur until such time as the legislation is clarified. Councilman Schutte asked what the time was of "this booking", and felt there should be a definite date stated. Mr. Geisler advised this would be until the next show is booked. Mr. Schlegel stated the show is currently booked and advertised for a four week period, however, it may be a longer booking because there is a six week time slot. That if there is any impasse, they pledged to cooperate with the City Attorney, Police Chief and the City Council. That the lack of particularity in this field is not an attempt to mis- lead the Council, but an attempt to provide flexibility. Shirley Smith, 2749 Alta Vista, Newport Beach, California, stated she was one of the 183,000 voters in Orange County that voted in favor of Proposition 16, and she believed the reason said proposition passed in Orange County was because the parents of this area were concerned about the morals of their children and desired to present high ideals for the future generation. In her opinion, the City of Anaheim was setting a precedent for other cities throughout the State by accepting this compromise and allowing subject production to show for a perzod,of six weeks. Mr. Schlegel stated he believed the statement presented by Mr. Dare was a sound course of action and in good keeping with the spirit of cooperation and the goals attempted by each side in this matter° 2825 City Hall, Anaheim, California - COUNCIL MINUTES - November 28~ 2:00 P.M. Mayor Krein asked if any Council member had any further questions, and called for a roll call vote on the foregoing motion: Councilman Dutton: Aye. Councilman Pebley: Aye. That with their pledge of cooperation as to future shows, he felt Melodyland should be allowed to continue its present booking, as if there is to be any damage to the City, it has already been effected. Councilman Schutte: Aye. On the assurance of the City Attorney that the show would not run beyond December 25th, 1966. Councilman Chandler: Aye. Councilman Krein: Aye. He felt that Melodyland, by their statement, has indicated that they are willing to cooperate with the City. MOTION CARRIED. ADJOURNMENT: Councilman Chandler moved to adjourn.
