MOTION CARRIED. RESOLUTION NO. 62R-547: Councilman Krein offered Resolution No. 62R-547 for passage and adoption. Refer to Resolution Book. A RESOLUFION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND DIRECTING THE PAYMENT OF DEMANDS AGAINST THE CITY AS OF JUNE 12, 1962. (Warrants Nos. 18m62 to 18738, both inclusive, totaling $1,013,535.05.) The Mayor Pro Tem declared Resolution No, 62R-547 duly passed and adopted, SIGN APPLICATION - PAUL~S RECORDERS: Application filed by Paul Engdahl request- in9 permission to erect a non-conforming sign (oversize and roof sign extends nine feet above building) at 1763 South Harbor Boulevard, together with plans9 was submitted, reviewed and discussed by the City Council. At the conclusion of the discussion, Councilman Dutton moved said sign application be denied. Councilman Krein seconded the motion. MOTION CARRIED° SIGN APPLICATION - U:TOTE~M MARKET AND QUIK SHOP: Application filed by Hanover Homes, Incorporated, for permission to erect three non-conforming signs at 1101-1109 West South Street, was submit%ed at the meeting of May 29, 1962, and action continued to June 26, 1962, at 3:00 P.M., with notification to the interested parties to conform with the demands of the City regarding compliance with the Freeway Sign Ordinance. Request of Hanover Homes dated June 6, 1962, for consideration of said signs at this meeting rather than the June 26 meeting, as the existing freeway signs in question are not located on subject property or under their ownership, was submit%ed. Wayor Pro Tem Chandler asked if 'the applicant or his representa- tive was present, As there was no response, the Council requested the matter to be placed on the June 26, 1962, 3:00 P.W. Agenda, in accordance with previous action taken. 58~8 City Hall~ Anaheim, California - COUNCIL MINUTES - June 1~ i962, 3:00 P.M, SIGN APPLICATION, LEO~S RESTAURA~': Application requesting permission to erect a non-conforming sign at lO1 l~est Center Street, together with plans~ was submitted, and in reviewing the plans, it was noted by the Council that said sign is-to be suspended from the wall, but will rest on the top of the existing marquee, with a six foot projection of the wall on Los Angeles Street and a seven foot, six inch projection out from the wall on Center Street. Councilman Dutton moved that said sign application be granted, subject to the condition that the overnang of the right-of-way does not exceed four feet. Councilman Krein seconded the motion. MOTION CARRIED. SIDEWALK WAIVER - ORANGE~OOD AVENUE: Request of W. S. Stevenson, John B. Kilro¥ Company, for waiver of the requirement for sidewalks along a portion of Orangewood Avenue, in connection with their industrial development at State College Boulevard arid Orangewood A'venue, was submitted. On the recommendations of the City Engineer, Councilman Schutte moved 'that temporary waiver of sidewalks on Orangewood Avenue from 1305 feet east to 200 feet east of State College Boulevard be granted. Council- man Dutton seconded the motion. MOTION CARRIED. F{ECLASSIF1CATION NO. 61-62-a8: Request of Ray Mercado, agent for Semco Invest- meni Company, for action by 'the Anaheim City Council approving their request to the Buena Park City Council for sewer services fortheir development pursuant to Reclassification No. 61-62-48 (9181 Knott Avenue) was submitted. On report and recommendat, tons of the City Manager and Cit'¥ Engineez, the City Council authorized request be made to the Cily of Buena Park to provide sewer services to the property located in 'the City of Anaheim, arid described in Reclassification No. 61-62-48, on motion by Councilman Dutton, seconded by Councilman Schutte. MOTION CARRIED. RECLASSIFICATION NO. 61-62-23: Request of Joseph M. Girard, Attorney represent- Lng the applicant, for a sixty day extension of time for compliance with cer-Lain conditions of Resolution No. 7305, was submitted. Councilman Schutie moved thai Reclassification No. 61-62-23 be granted a sixty day extension of time from this date. Councilman Dutton seconded the motion. MOTION CARRIED. RECLASSIFICAYION NO. 61-62-5~: Request of Ernest N. Kay for a six month exten- sion of time for compliance with condihions of Reclassification No. 61-62-5m, and advising %hat if said extension is granted, he will immediately execute the Easement Grant Deed as required by the Resolution of Intention to Rezone, was submitted. A six months' extension of time was granted Reclassification No. 61-62-54, subject to the execution of the Easement Deed as stipulated by the applicant, in his communication dated June 1, 1962, on motion by Councilman Krein, seconded by Councilman Dutton. ANAHEIM CHAMBER OF COMMERCE - RENEWAL~ PROMOTIONAL AGREEMENT: On the recommenda- tion of the City Manager, action by the City Council on Anaheim Chamber of Commerce~s request for renewal of their promotional and advertising agree- ment for fiscal year, 1962-63, was deferred to be considered in conjunction with the 1962-1963 Budget, on motion by Councilman Dutton, seconded by Councilman Krein. MOTION CARRIED. PLANS AND SPECIFICATIONS - CITY HALL RESTROOM FACILITIES: On report by Mr. Robert Davis, Assistant City Manager, plans and specifications for City Hall Restroom Facilities were approved as recommended, on motion by Councilman Schutte, seconded by Councilman Dutton. MOTION CARRIED. CLAIMS AGAINST THE CITY: The following claims against the City were submitted: Claim filed by Robert N. Stone, Attorney representin9 Steven Scott Pallow, for personal injuries resulting from traffic accident on April 17, 1962, on West Broadway near the west side of Magnolia Park. b. Claim filed by Mrs. Helen Keup for injuries resultin9 from a fall on the sidewalk fronting 560 South Lemon Street. On motion by Councilman Dutton, seconded by Councilman Krein, said claims were denied by the City Council and referred to the City Attorney and City insurance carrier. MOTION CARRIED. RESOLUTION NO. 62R-548: On the recommendations of the City Engineer, Councilman Krein offered Resolution No. 62R-5a8 for passage and adoption, awarding the Nutwood Street Improvement, Job No. 684, to the low bidder, Sully Miller Contractin9 Company, in the amount of $5,149.17. Refer to R~solution Book. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS AND ~QUIPMENT AND ALL UTILITIES AND TRANSPORTATION, INCLUDING POWER, FUEL AND WATER, AND PERFORM- ING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT: THE NUTWOOD STREET IMPROVEMENT, FROM APPROXIMATELY 745 FEET NORTH OF WOODWORTH ROAD TO WOODWORTH ROAD, IN THE CITY OF ANAHEIM, JOB NO. 684. (Reclassification No. 59-60-16) The City Attorney outlined the boundaries of subject tract, and reported that required bonds and fees have been paid, and recommended the approval of said Final Map, subject to the posting of a bond to insure improvement of the alley in the event said alley is required. On the recommendations of the City Engineer, it was moved by Councilman Schutte, seconded by Councilman Dutton, that Final Map, Tract No. 2962, be approved, subject to the posting of a bond approved by the City Attorney guaranteeing the construction of the alley. TENTATIVE MAP~ TRACT NO. a689: Subdivider, Lusk Corporation (Boyle Engineering, Engineer); tract located on the east side of Newport Freeway, both sides of the extension of Lincoln Avenue, and contains 138 proposed R-1 lots. The City Planning Commission recommended approval of said Tenta- tive Map, subject to the following conditions: 1. Requirement that should this subdivision be developed as more than one subdivision, each subdivision thereof shall be submitted in tentative form for approval. 2. Subject to the approval of plot and buildi~9 plans by the Planning and Building Departments. 3. Provision of acquisition of property from fhe State or the relocation of "A" Street to the east be required to provide developable lots along the northwesterly tract boundary. a. The average lot size shall be 10,000 square feet, with no lot less than 8,000 square feet. The minimum building pad size shall be 7,000 square feet. 5. Prior to the submission of the final map the present city limits between the City of Orange and City of Anaheim shall be adjusted to conform to the tract boundaries. 6. Areas within the City of Anaheim, after the boundary adjustment, con- tributing to the drainage district in the City of Orange shall be responsible for the drainage charge, which shall be paid prior to approval of the final map. The area shall be the net area draining into the City of Orange. 7. Sidewalks shall be constructed on one side of Lincoln Avenue. Mr. Kreidt referred to a map of the area which was placed on the east wall of the Council Chambers, and reported that the map contained Tract Numbers ~689 and a690. Tract No. a690 is in the City of Orange, and has been approved, subject to the same requirements of Tract No. a689. He summarized the evidence presented to the City Planning Commission and suggested the inclusion of three additional requirements which had not been 5833 City Hall, Anaheim, California - COUNCIL MINUTES - June 12, 1962, 3:00 P.M. presented to the Commission, as follows: The sixty (60) foot Lincoln Avenue right-of-way width shall be approved. The cross section within the 60 foot right-of-waY width (Lincoln Avenue) shall be subject %o modification of sidewalk and traffic lane widths. Said modification shall be determined prior to approval of the Final Map in conjunction with the County of Orange and City of Orange. Access drives serving lots number 1 through 4 shall have a minimum right-of-way of thirty-four.(34) feet, with a minimum road bed of twenty-four (24) feet. 3. Subject to the approval of a grading plan by the City Engineer prior to the approval of the Final Map. Mr. Kreidt further explained the reasons for these additional requirements and referred to a Traffic Study, Number 7956, prepared by Boyle Engineers, which substantiated the need and the projection of four lanes for traffic on Lincoln Avenue. Mr. Maddox reported that the sixty-foot right-of-way for this section of Lincoln Avenue would be sufficient inasmuch as the adjacent property in this section will have no access to Lincoln Avenue. Further discussion was held regarding City Planning Commission's recommendations, numbers 1 and 5, and Mr. Murdoch explained the proposed amendment to the boundary line between the City of Anaheim and the City of Orange, which amendment will include the Anaheim Reservoir site. At the conclusion of the discussion, it was moved by Councilman Dutton, seconded by Councilman $chutte, that Tentative Map of Tract No. 4689 be approved, subject to the recommendations of the City Planning Com- mission, amending Condition No. 5 to read: "That the boundaries of the Final Map shall conform to the then existing City Limits," and further subject to the three requirements as recommended by the Planning and Engineering Staff. In addition, subject to dedication to the City of Anaheim of all vehicular access rights to those lots abutting Lincoln Avenue. MOTION CARRIED. TEN/ATIVE MAP, TRACT NO. a703: Subdivider, Orangethorpe Industrial Properties; tract located on the north side of Orange%horpe Avenue east of the AtChison, Topeka and Santa Fe Railway Right-of-Way, and contains 16 M-1 lots. (53-5a-3). The City Planning Commission recommended approval of said Tenta- tive Map, subject to the following conditions: 1. Requirement that should this subdivision be developed as more than one subdivision, each subdivision thereof shall be submitted in tentative form for approval. 2. Existing improvements shall be checked as to their condition and adequacy and brought up to standards as required by the City Engineer and Director of Public Utilities. 3. Dedication of access rights to Orangethorpe Avenue as required by the City Engineer. a. Drainage of the area shall be accomplished in a manner satisfactory to the City Engineer. On motion by Councilman Schutte, seconded by Councilman Dutton, Tentative Map, Tract No. a703 was approved, subject to the recommendations of %he City Planning Commission. MOTION CARRIED. 583~ City Hall, Anaheim, California - COUNCIL MINUTES - June 12, 1962, 3:00 P.M. TENTATIVE MAP~ TRACT NO. 4717: Subdivider, V. J Shrader; tract located on the west side of Sunkist Street, approximately 1,340.12 feet north of South Street, and contains 32 proposed R-l.lots. The City Planning Commission recommended approval of said Tentative Map, subject to the following conditions: 1. Requirement that should this subdivision be developed as more than one subdivision, each subdivision thereof shall be submitted in tentative form for approval. 5. Subject to the approval of plot and building plans by the Planning and Building Departments. 3. Installation of a six (6) foot masonry wall where Lot Nos. 1, 32, 21, and 20 abut the planned highway right-of-way line of Sunkist Street, provided that said wall shall be stepped do~,,n to a height of twenty-four (74) inches in the front one-half, and to a height of forty-two (42) inches in the back one-half of the front yard setbacks of Lot Nos. 1 and 32, and installation of reasonable landscaping the full distance of said wall construction, plans for said landscaping %o be submitted to and subject to the approval of the Superintendent of Parkway Maintenance, prior to Final Building Inspection. (Following installa- tion and acceptance, the City of Anaheim shall assume the responsibility for the maintenance of said landscaping.) 4. Provision for a stub street to the North as presented in Exhibit No. 1 of Planning Study 38-112-4, to eliminate stub street to the West and provide a stub street to the south tract boundaries. Because of a possible conflict of interest, Mayor Pro Tem Chandler requested Councilman Schutte to Chairman this portion of the meeting, and withdrew from the discussion and action on this issue. Mr. Kreidt explained evidence submitted to the City Planning Commission and also summarized the City Planning Commission's consideration of Plan Study No. 38-112-~. He further reported that when action was taken by the City Planning Commission on the Tentative Tract, the Commission was not aware of the fact that the property to the North of subject property could be developed independently without the need of the stub street to the North. Mr. A. R. McDaniel, Engineer for the tract, advised that the stub street to the North would require the loss of one lot to both parties, and would serve neither developer. He further advised that various studies were developed demonstrating numerous ways the property to the North could be developed without the stub street. Councilman Dutton moved Tentative Map, Tract No. 4717 be approved, subject to the recommendations of the City Planning Commission. Councilman Krein seconded the motion. MOTION CARRIED. Mr. A. R. McDaniel requested Council reconsideration of the City Planning Commission:s requirement pertaining to the stub street running northerly, and explained that the condition was imposed because the evidence presented %o the Planning Commission did not illustrate how the parcel to the North could be developed without the stub street. Mr. Kreidt verified statement made by Mr. McDaniel, and advised that in the interest of time, rather than hold up the map for further Commission consideration, it was determined to forward the map to the City Council as recommended, and verbally present this additional evidence. Councilman Dutton moved previous action taken relative to Tenta- tive Map, Tract No. J717, be rescinded, and that Tentative Map, Tract No. 4717 be approved, subject to the recommendations of the City Planning Commission, eliminating therefrom Condition No. 4.
