Farrens CITY ENGINEER: James P. Maddox ZONING SUPERVISOR; Charles Roberts Mayor Pebley called the meeting to order. FLAG SALUTE; Councilman Clark led the Assembly in the Pledge of Allegiance to the Flag. PROCLAMATION: Mayor Pebley Proclaimed the month of March as "Clean-up, Fix- up, Paint and Plant Month." RESOLUTION OF COMMENDATION: The City Council unanimously adopted a Resolution of Commendation to the Student Body and Faculty Advisors of Katella High School for their project of landscaping and beautifying their new campus in conjunction with "Green Thumb Day, "February 17, 1969. MINUTES: Minutes of the Anaheim City Council meeting held February 11, 1969, were approved on motion by Councilman Dutton, seconded by Councilman Clark. MOTION CARRIED. AMENDMENT TO MINUTES: On motion by Councilman Dutton, seconded by Councilman Clark, the City Clerk was authorized to amend the minutes of the meeting of January 21, 1969, to reflect the intent of the City Council to allow payment of Park and Recreation In Lieu Fees under the previously-established fee schedule, ($25.00 per dwelling unit), in all zoning cases where building permit is ob- tained prior to May 1, 1969, regardless of when the zoning action or applica- tion was filed. MOTION CARRIED. WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Clark moved to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading is hereby given by all Councilmen, unless after read- ing of the title, specific request is made by a Councilman for the reading of such ordinance or resolution. Councilman Schutte seconded the motion. MOTION UNANIMOUSLY CARRIED. REPORT - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City, in the amount of $1,177,814.63, in accordance with the 1968-69 Budget were approved. PUBLIC HEARING - VARIANCE NO. 2032: Submitted by Giacomo Lugaro and Agcctina Lugaro, requesting waivers of maximum number of free-standing signs and minimum distance between free-standing signs, to permit two 30-inch by 40-inch price signs; C-1 zoned property located at 590 North Magnolia Avenue. The City Planning Commission, pursuant to Resolution No. PC69-1, de- nied said Variance. Appeal from action taken by the City Planning Commission was filed by Standard Oil Company, agent for the Applicant, and public hearing scheduled this date° Zoning Supervisor Charles Roberts noted the location of subject pro- perty, the existing uses and zoning in the immediate area, and briefed the evidence submitted to and considered by the City Planning Commission. He re- ported that a study made by the Development Services Staff indicated that of the 231 existing service stations in the City of Anaheim, 182 have legal price signs, 13 more have legal locations where price signs could be posted; 32 have no place for legal price signs (26 of which are Standard Oil Stations), and four have illegal price signs. He noted the Commission's findings that no hardchip was demonstrated that an additional free-standing sign was necessary to enjoy substantially the same rights as other service stations in the City, and the approval of subject petition would set an undesirable precedent for similar requests from service stations as well as other commercial operations. 69-111 City Hall~ Anaheim; California - COUNCIL MINUTES - February 25~ 1969~ 1:30 P.M. Slides of the subject property were shown for Council information, and Mayor Pebley asked if the applicant wished to address the City Council. Mr. Alex Fafenrodt, Attorney, representing Standard Oil Company, related difficulties his company has had in displaying price signs at ser- vice stations that were constructed prior to adoption of the sign ordinance; that the service station on subject property was constructed in 1964, and at that time, permitted signing consisted of one canopy fin sign facing Magnolia Avenue, one hallmark sign facing Crescent Avenue, and a ground level price sign located at the intersection° He noted that although the sign ordinance permits the display of a price sign on either of the two existing free-standing signs on the pro- perty, these locations are ineffective, and would create hazards due to im- paired visibility to motorists, and to employees in changing the price sign. He felt the safest and most visible location was at the intersection, on the existing floodlight standard. Mrs Fafenrodt showed slides of other service stations in the City to illustrate the nature of the problem faced by the applicant, noting that the design of most service stations operated by competitors, particularly those built since the adoption of the sign ordinance, provides for a free- standing sign at the street intersection, on which price signs may be lc- gaily displayed; that Standard Oil Stations built since 1966 have also been designed in this mannero He called Council attention to the propoSed price sign on display at the rear of the Council Chambers. In answer to Council questions, Mr. Fafenrodt stated that the dis- play of a price sign is a major factor in obtaining customers, as studies conducted by the ~rketing Research Department of Standard Oil Company in- dicate that to two-thirds of the gasoline-buying public, price is a deciding factor to determine where to trade. He advised that in Anaheim, the import- ance of displaying advertising prices is even greater, since "gasoline wars" are in effect approximately 60% of the year° Councilman Clark ol. served that most service stations in the City were constructed prior to the sign ordinance and conformance, in many in- stances, has caused a hardship; that a precedent would be set if the request- ed Variance is granted, thereby encouraging other requests for the same con- sideration. Mro Fafenrodt replied that most other stations already have legal price signs located at the street intersection; that only a small number of service stations do z~ot, and of these, 81% are Standard Oil Stations that are in the same circumstances as the applicant; that the cost of relocating the existing free-standing signs would be several thousand dollars. It was noted by the City Council that representatives of Standard Oil Company were present at public meetings and concurred with the adoption of the sign ordinance° Mro EoMo Hawley, District Sales Manager of Standard Oil Company, stated that their Mr. Lindsay had attended the meetings to which the City Council referred, but it was not determined until the conclusion of these meetings that a price sign could not be placed on the light standard lo- cated at the intersection° Mayor Pebley asked if anyone else wished to address the City Coun- cil; there being no response, declared the hearing closed. ~ECOLUTION NO. 69R-99: Councilman Clark offered Resolution No. 69R~99 for adoption, denying Variance No. 2032, as recommended by the City Planning Commission. (Reclassification No. 68- 69-39). The City Engineer reported said final map conforms substantially with the tentative map previously approved; that bond has been posted and forwarded to the City Attorney for approval and required fees paid, and he recommended approval thereof. On recommendations of the City Engineer, Councilman Dutton moved that Final Map, Tract No. 6774, be approved subject to approval of required bo~d by the City Attorney. AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING° (68-69-52 - R-3) o ALCOHOLIC BEVERAGE LICENSE APPLICATIONS= The following applications were presented by the Assistant City Manager to the City Council for their informmtion: a. Application submitted by The Southland Corporation, Charles Richard and Joanne Fay Craig, for Off-Sale Beer and Wine, (Add Co-Licensee) for Seven-Eleven #206, at 801 South Euclid Street, Anaheim, C-1 zone. b. Application submitted by Marvin Lo and Gregory W. Liles, for Original Off-Sale Beer and Wine, for M & M Market at 629 South Anaheim Boule- vard, C-2 zone. No Council action was taken on the above applications. c. Application submitted by Dazoby, Inc., George W. Zorbas, Presi- dent, and Douglas Lloyd Davies, Vice-President, for Original On-Sale Beer and Wine, (Bona Fide Eating Place), for Don Diego's, 1723 West Katella AVenue C-1 zone. , On motion by Councilman Dutton, seconded by Councilman Clark, the City Attorney was authorized to file conditional protest with the Alcoholic Beverages Control Board against the above application, on the basis that the premises are presently located in the C-1 zone, which does not permit the On-Sale of alcoholic beverages. MOTION CARRIED. CONDITIONAL USE PERMIT NO. 991: Request of Mr o R.A. Baker, for extension of time and reconsideration of Council decision of February 20, 1968, requiring that materials stored on the subject property be disposed of within one year, was continued from the meeting of February 18, 1969, to this date, to allow in- spection of the premises by the City Council. Mayor Pebley felt that a six-month extension of time would be ade- quate to remove the operation from the subject property, and Councilman Clark concurred. Councilman Clark observed that the operation does not produce of- fensive odors, but felt it should be removed within a reasonable length of time, as it is somewhat unsightly° He suggested that the separate piles of material be combined and importing of new material be prohibited until com- plete removal is effected° Councilman Dutton noted that the operation is not permitted, by right, in that location and additional efforts could have been made on the part of the applicant to remove the operation within the one-year period of time granted by the City Council. Councilman Clark moved that an extension of time be granted to August 30, 1969, to comply with Council decision of February 20, ].968, re- quiring that materials stored on the subject property be removed° Council- man Schutte seconded the motion. Councilman Dutton felt that a shorter ex- tension of time was indicated and voted "No" to the foregoing motion. MOTION CARRIED. The City Attorney was instructed to inform Mr. Baker by letter of the action taken by the City Council. _REQUEST FOR CROSSING GUARD - DALE AVENUE AND STONYBROOK DRIVE: Request for a cross- ing guard at the intersection of Dale Avenue and Stonybrook Drive was continued from the meeting of February 18, 1969, to this date, and was further continued to be rescheduled when clearing weather conditions allow further report based on radar monitoring of the location. 69-117 ~Anaheim_~_California - COUNCIL MINUTES - Februar 2 __~ 1:30 P.M. COMMUNITY CENTER AUTHORITY - JOINT MEETING: The Assistant City Manager reported that the Community Center A '~hority has requested a joint meeting with the City Council and the Anaheim Union High School District Board of Trustees, to discuss policies and procedures for the coming year. By general consent of the City Council, the date of March 10, 1969, 7:30 P.M., was selected for the requested joliet meeting, to be held at Ana- heim Convention Center. LETTER OF COMMENDATION: At the request of Mayor Pebley, the Deputy City Clerk read a letter from Mrs~ Martha Go Raymond, 805 Helena Street, commending the Anaheim Fire Department for services above and beyond the call of duty in preventing damages to her home as a result of the recent rains.
