Mr.. 'Roberts briefly covered the Development Services Department
report' to the Pladning CommisSion on possible zoning and commercial uses
for subject property,, and the recommendation that if this property is
deemed appropriate for commercial.use it be zoned C-O, Commercial-Office,
and the possibility of requiring or providing a waiver from the 35-foot
setback policy'~long Lincoln AVenue b'e considered.
Mr. Roberts further reported that the City Planning Commission,
at their May 4,~ 19~ meeting, recommended by-Motion that the City Council
give consideration to approving. C~O zoning on sUbject property, provided
the Petition'er initfgte a variance to waive minimum lot size and site
development standardS', as nece'ssary. The Planning Commission further
recommended the 35-.foot. building setback policy for Lincoln Avenue not
be strictly adhered to.in this instance, since the homes to the west al-
ready encroach in this~etback and there is a. definite hardship involved
with the development of..Subject property; however, if an office building
is allowed to e~croadh'into the required'35-foot setback on subject pro-
perty, it shall not be deemed as setting, a precedent for additional en-
croachment on othe'r parcels along Lincoln Avenue.
Mayor Dutton asked if anyone' wished to address the Council.
Mr. J~E~ '(Pete) Pruet~, 249 East Lincoln Avenue, representing
the Applicant, introddce~ a prepared statement, to the City Council re-
questing CZl zoning' on subject'property.
Oh questioning by Councilman Clark, Mr. Pruett advised that the
Applicant for the ~alk~qp restaurah~ had withdrawn his offer, and at pres-
e~t~they have no".specif~c plans for the property.. He added that he did
no~cthink C~.O zoning, on subject property would help their situation.
Mr. Donald McIntosh, 109 South Gilbert Street, whose property
adjoins subject property, inquired where trash storage and parking areas
wo~d be' locatedl H~. was adVised this could not be~known until plans

Mayor Du~ton. asked if anyone else wished to address the Council;
hearing no response, declared the hearing closed.
RESOLUTION NO,..70~R~5: Councilman Pebley offered Resolution No. 70R-
215 for~ad~ptfOn,~autho~izfng the necessary ordinance changing the zone
to C~O, Commercial-Off,ce, subject to the following Interdepartmental
Committee recommendations, and further subject to filing and obtaining
the necessary variance Waiving'minimum lot's~z.e:
1. That all engineering requirements of the City of Anaheim
-along Lincoln Avenue, including preparation of improvement plans-and in-
stallation of allimprovements, such as curbs and gutters, sidewalks,
street grading and paving, drainage' facilities, or other appurtenant
work shall be complied with as.required by the City Engineer and in ac-
co,dance with standard plans and specifications on file in the office of
the City Engineer; that a bond in an amount and form satisfactory to the
City of Anaheim shall be posted with the City to guarantee the installa-
tion of the above-mentioned requirement.
2. That the size and location of access driveways to Lincoln
Avenue shall be approved by the State of California, Division of High-
ways and the City Engineer, prior to issuance-of a building permit.
3. That tree screen landscaping, 20-feet on center, shall be
installed and maintained adjacent to the required walls along the west
and south property lines of shbject property.
4. That trash storage areas shall be~provided in accordance
with approved plans on file in the office of the Director of Public Works.
5. That fire hydrants shall be installed as required and de-
termined to be necessary by the Chief of the Fire Department.
6. That a 6-foot masonry wall shall be constructed along the
south and west property lines,

from view, and the sound buffered from adjacent residential homes.

LITIGATION - PLACENTIA ANNEXATION 69~1: At the invitation of Councilman Clark~
Mrs~ Gonzales, resident of the Atwood area, addressed the Council, requesting
Anaheim permit them'to annex their area to the City of Placentia (terminate
pending litigations) She stated they felt they had a right to choose the
city of which they wished to become a part, and that Anaheim was preventing
this right.
Mrs. Montano and Mrs,. Cruz also addressed the City Council, sup-
porting the position expressed by Mrs° Gonzaleso
Mr~ Murdoch reviewed the action taken by the City of Anaheim, and
advised that Anaheim first protested before the Local Agency Formation Com-
mission in that the City of Placentia not only included the small inhabited
area of Atwood, but a substantial area that should logically and properly
be served by the City of Anaheim, and that the boundaries proposed by the
City of Placentia, and subsequently approved by the Local Agency. Formation
Commission, were detrimental to the interests of the City of Anaheim°
He stated that Anaheim wholeheartedly agreed that if the people of
the Atwood community wanted to be a part of Placentia, that was certainly
their prerogative, and we would cooperate with them on that basis and-even
provide services in an effort to avoid duplication; the conflict is in the
extent of the territory involved in the Placentia annexati6n.
Mayor Dutton noted that the area should have been considered in two
separate actions ~ the Atwood area under the Inhabited Annexation Act, and
the balance of the area under the Uninhabited Annexation Act° In his opinion,
the residents of Atwood were being used to bring in a much larger area that
did not want to be annexed to the City of Ptacentia.

Mr. Geisler~ in further explaining the situation, reported that
the pending lawsuit will not force the Atwood community into the City of
Anaheim; that actually more than 50% of the landowners protested the an-
nexation (which was sufficient to stop the proceedings), and the City of
Placentia chose to proceed. He further stated that, in his opinion, much
of the proceedings were improper - and that is what the lawsuit is all
about. If the lawsuit is won by the City of Placentia, these people will
.be in the City of Placen~ia; and if the lawsuit is won by the City of Ana-
heim, these people.will be in the unincorporated area and still can take
steps to annex-to the City of Placentia.
STATE GAS TAX FUNDS LEGISLATION: Mayor Dutton reported that the Automobile
Club of Southern California had indicated a desire that the Anaheim City
Council back them in their efforts to halt any legislation that might fli-
vert gas ~ax funds presently received under Article 26 of the State Con-
stitution to any .purpose other than highway construction and maintenance.
The Automobile Club had reported the Orange County Board of Supervisors
had adopted a resolution in support of their position.
At the invitation of Mayor Dutton, Mr. Joe Wade, Manager of the
Automobile Club, Anaheim, addressed the Council advising there presently
is a bill in the LegislatUre to divert one cent a gallon of the gas tax
moneys received, which would gake away about 30% of the funds presently
received 'by counties'and cities for highway use under Article 26. The
Automobile Club f~is' Once legislation is passed changing Article 26,
there will be additional legislation to further divert these funds. Mr.
Wade advised the Automobile Club is not opposed to any separate legisla-
tion which would t~mporarilY'levy an additional gas tax for a specific
purpose.
Regarding dse of thes~ funds for other transportation or highway-
related purposes, particularly air pollution, Mr. Wade advised that last
year there were sufficient funds from the weight and license fees to sup-
port the air pollution program, with an overage of 75 million dollars.
FuOther, ther~ ~u~rently is a'bill in the Legislature raising license fees
one:dollar (12 million) for air pollution.
By consent of the City Council, the City Manager was requested
to draft a letter for the Mayor's signature, stating the position of the
City Council, to be sent to our legislators, urging Article 26 of the State
Constitution remain a~ presently in effect.
Councilman Pebley left the Council Chambers, (3:25 P.M.).
NATIONAL HIGHWAY SAFETY .ACT OF 1966 - FEDERAL GRANT: Mayor Dutton reported
that telephone notification had been received this date, awarding the
City of Anaheim a Federal Grant of $108,106.00 for the computerization
of~ traffic accident records under the National Highway Safety Act of 1966
(Public Law 89,564).
APPOINTMENT - CITY PLANNING COMMISSION: The appointment of a Planning Com-
missioner to fill the unexPired term of W.J. (Bill) Thom was ordered de-
ferred.to allow a full Council decision.
