Reverend George Dugard, of the West Anaheim Baptist Church, gave the Invocation. FLAG SALUTE: Councilman Thom led the Assembly in the Pledge of Allegian:e to the Flag. STaTE. COMPENSATION INSURANCE FUND DIVIDEND: W.L. Graham, Safety Represen- tative of the State Compensation Insurance Fund, presented Mayor Pro Tem Pebley checks totaling $93,490.11, reflecting dividends earned on the City's Workmen's Compensation Insurance policy for the 1968 policy year, because of low incidenca of on-the- job accidents. MINUTES! Minutes of the Anaheim City Council meeting held June 2, 1970, were approved on motion by Councilman Stephenson, seconded by Councilman Thom. MOTION CARRIED. WAIVER OF READING - O%plNANCES AND RESOLUTIONS: Councilman Thom moved to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading is hereby given by all Councilmen, unless after reading of the title, specific request is made by a Councilman for the reading of such ordinance or resolution, Councilman Stephenson seconded the motion. MOTION UNANIMOUSLY CARRIED. ~P~E~O~T - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City, in the amount of $416,682.14, in accordance with the 1969-70 Budget, were approved. PUBLIC HEARING - RECLASSIFICATION NO.. 69-70-57: Initiated by the Anaheim City" Planning Commission for a change of zone from County of Orange MI, to the City of Anaheim R-A, on property consisting of three parcels of land bounded on the south by the Riverside Freeway; on the northwest and northeast by White Star Avenue and extends as far easterly as the intersection of White Star Avenue and La Palma Avenue. (White Star-La Palma Annexation). The City Planning Commission, pursuant to Resolution No. PC70- 80, recommended said reclassification be approved, subject to the fol- lowing condition: 1. That these reclassification proceedings are granted subject' to completion of annexation of subject property to the City of Anaheim. Zoning Supervisor Charles Roberts noted the location of subject property, the existing uses and zoning in the immediate area, stating that subject property presently was being processed for annexation to the City of Anaheim. Mayor Pro Tem Pebley asked if anyone wished to address the Coun- cil; hearing no response, declared the hearing closed. _RESOLUTION NO. 70R-294: Councilman Thom offered Resolution No. 70R-294 for adoption, authorizing preparation of necessary ordinance changing the zone as recommended by the City Planning Commission. Parcel 2: Bounded on the northeast and northwest by White Star Avenue, on the west by Blue Gum Street, and on the south by La Palma Avenue. Parcel 3: Bounded on the north by La Palma Avenue, on the south by the River- side Freeway, and on the east by a line projected southerly from a point just westerly of the intersection of White Star Avenue and La Palma Avenue, (White star-La Palma Annexation), with waiver of: a. The City Planning Commission, pursuant to Resolution No. PC70-81, recommended said reclassification be approved, subject to the following con- ditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 30 feet in width from the centerline of the street along White Star Avenue west of Blue Gum Street, 32 feet in width on White Star Avenue east of Blue Gum Streets 45 feet in width on Blue Gum Street, 53 feet in width on La Palma Avenue east of Blue Gum Street, and variable widths as required by the City Engineer on La Palma Avenue west of Blue Gum Street, for street widening purposes~ 2. That a preliminary title report shall be furnished prior to the adoption of the ordinance rezoning the property, showing legal vesting of title, legal description, and containing a map of the property. 3o Prior to the introduction of an ordinance rezoning subject pro- perty, Condition Nos. 1 and 2, above mentioned, shall be completed. 4. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 7. That all air-conditioning facilities shall be properly shielded from view. 8. That subject property shall be served by underground utilities. 9. PUBLIC MEARING - CONDITIONAL USE PERMIT NO~ .1163: Submitted by State College Medical Center, to expand'an'existing motel on C-O zoned property located northwesterly of the intersection of Center Street and State College Boulevard, with-waivers of: a. Requirement that a lot or parcel have frontage on a public street or alley. b. Minimum required structural setback from residentially zoned property. The City Planning Commission, pursuant to Resolution No. PC70-70, denied sa~d conditional use permit. Appeal from action taken by the City Planning Commission was filed by James A. Carter, Agent, and public hearing scheduled this date. Zoning Supervisor Charles Roberts reported a verbal request from James A. Carter, Agent.for the-Applicant, for a continuation of the public hearing to allow the Applicant to be present. On motion by Councilman Thom, seconded by Councilman Stephenson, and at the concurrence of James A. Carter, subject hearing was continued to June 23, 1970, 1:30 P.M, MOTION CARRIED. PUbLIC.HEARING - CONDITIONAL USE PERMIT NO~ 11691: Submitted by Christian Center Church, to establish a structure in excess of 75 feet in height, to permit a 134-foot high "Tower of Peace," on C-R zoned property located on the south side of Freedman Way, east of Harbor Boulevard. The City Planning commission, pursuant to Resolution No. PC70-73, granted said conditional use' permit subject to the following conditions and with the recommendation to the City Council that the existing "reader board sign", located in the public right-of~way at the intersection of Harbor Boule- vard and Freedman Wa~ be removed: 1. That subject property shall be developed substantially in accord- ance with plans and specifications on file marked Exhibit No. 1, provided, how- ever, that the height of the proposed structure shall not exceed the maximum height which would be permitted under the Commercial-Recreation Area "Height Standard Guidelines." 2. That the owner of subject property shall pay to the City of Aha- ' heim the sum of 15¢ per front foot on the westerly 500 feet along Freedman Way, for tree planting purposes. Appeal from action taken by the City Planning Commission was filed by Jacob Paull, Attorney for the opposition, and public hearing scheduled this date. The City Clerk submitted correspondence from Sealy M. Yates, Attor- ne~ for the Applicant, withdrawing the application. On motion by Councilman Pebley, seconded by Councilman Stephenson, withdrawal of application for Conditional Use Permit No. 1169 was approved. MOTION CARRIED. PUBLIC HEARING - HOUSE MOVING PERMIT: Application submitted by James So Snow, re- questing ~'~rmtssion to move dwelling from 2511 Almond, Orange, to 3427 Thorn- ton Avenue, Anaheim, was reviewed by the City Council, together with report of the Development Services Department, recommending said permit be granted, subject to payment of applicable park and recreation fees. Mayor Pro Tem Pebley asked if anyone wished to address the City Council; hearing no response, declared the hearing closed. REQU~T 7 REMOVAL OF PARKING TI,ME .LIN~.T: Request of Mrs. Paulina M. Jones, fo:: removal-of the-recently instituted two-hour parking limit from 9:00 AoM. to 6:00 P.M., weekdays, on Chartres Street between Harbor Boulevard and Helena Street, was submitted together with report of the City Engineer recommending the request be denied. Mayor Pro Tem Pebley invited Mrs. Jones to address the Council. Mrs. Jones stated she owned the property at 415 West Chartres Street, and her tenants of twenty years were unhappy with the parking re- strictions since they felt the occupants of the two residences on that street were being penalized because the medical building on the corner did not provide parking space for patients. Traffic Engineer Edward Granzow explained that prohibiting park- lng on Harbor Boulevard in that area had forced all-day parkers from Har- bor Boulevard onto Chartres Street. He advised the decision to place the parking restrictions on Chartres Street was made to provide parking turn- over so residents would not have cars parked in front of their homes all day. In answer to Councilman Stephenson's query as to who requested the parking limit, Mr. Granzowadvised that Dr. Gather, on the corner., and the real estate office across the street had requested it; and added. that numerous.requests for parking restrictions had been received from residents on Helena Street, north of Chartres Street. Cedric Herring, Mrs. Jones' tenant on Chartres Street, reiterated the opinion that businesses should provide parking spaces for customers. He added if the employees of the medical office would park their cars away from the area~.their patients would not have to park in front-of his home, Mr. Herring said the parking restriction has forced his family to park their cars in the alley, often blocking passage. He stated Mrs. Herring used the car often during the day, making street parking a helpful convenience; however, traffic officers had warned their cars would be tagged in violation if found parked on the street. He felt the street in front of their residence should be available for them to park, since it supposedly was owned by the property owner. City Attorney Joseph Geisler advised streets 'are for travel of the public, and abutting property owners have no specific right to street' parking. City Manager Keith .Murdoch advised that lifting the parking re- striction could result in their not being able to park in front of their house 24-hours a day, because of all-day parkers. Mrs~ Jones said she understood the doctor on the corner had 'been in- structed to provide parking spaces at the time his building was constructed. Mr. Granzow explained that the two-hour parking limit actually al- lowed the residents to park continuously from 4:00 P.M. to 11:00 A.M., thus the only restriction was for five hours a day, five days a week, and it was his recommendation that the two-hour parking limit be retained. Mr. Geisler advised that if a car is moved from one parking spot to another on the same street, it is considered one continuous parking; but if it leaves the street and returns to the street to park, it is considered two separate parking events. He added that it is normal for a traffic officer to assume a car has not been moved when it is seen on the same street time after time during the course of a day. Councilman Pebley stated he felt a homeowner should not have to have parking restrictions in front of his residence if it was not desired. M~. Herring said the real estate office across the street had put gravel in their backyard for parking, and felt the doctor's office also should have to provide some parking area. Councilman Stephenson made a motion to retain the two-hour parking limit on Chartres Street, between Harbor Boulevard and Helena Street, as recom- mended by the City Engineer. Councilman Thom seconded the motion. Councilman Pebley voted "No" on the motion, on the basis that people living on that street did not want the restriction° MOTION CA1LRIED. REQUEST - WAIVER OF WEED REMOVAL CNARGES: Request of L.E. Woodruff for waiver of all but the direct labor charges f~ weed removal on his two lots on Orange Avenue between Brookhurst and Euclid Streets was submitted, together with report of the D~ector of Public Works~ recommending denial. AMENDED AUTHORIZATION - HELICOPTER INSURANCE: The City Manager reported that further consideration of insurance needs on the Helicopter Police Patrol program's two helicopters indicated the one-million dollar liability-only insurance authorized June 9, 1970, probably would not be adequate, especial- ly if the vehicles were used in emergency rescue situations. Systems and Research Director Douglas Ogden explained the insur- ance, as presently authorized, would not cover pilot instructors who are not employees of the City. Councilman Thom indicated he would not approve using these heli- copters to transport visiting dignitaries. Councilman Stephenson moved the authorized helicopter insurance be amended to include one-million dollars liability and one hundred thousand dollars passenger coverage, at a cost of $1,800.00 per year for two heli- copters~ Councilman Thom seconded the motion. PUBLIC DANCE HALL PE~...MIT: Application filed by Patrick T, Robbins for Public Dance Hall Permit to allow dancing seven days per week at The Warehouse, 1721 South Manchester Avenue, was submitted. The City Clerk reported the conditional use permit (No. 1063) granted for The Warehouse, would expire October 29, 1970o Patrick T. Robbins, 2980 Huff Avenue, San Jose, Applicant, stated he was agreeable to paying the full license fee, even though the condi- tional use permit expired October 29, 1970. MOTION CARRIED. ROCK CONCERT -STADIUM: Mr. and Mrs. Thomas Allison, 201 Violet Lane, Orange, protested the Rock Concert held June 14, 1970, at Anaheim Stadium. Mr. Allison labeled the report of the Police Department and a story in the Los Angeles Times as "whitewash," and cited incidents he had seen and heard, with regard to the attendees, alleging an officer of the Police Department Juvenile Division admitted knowing narcotics were passed in the audience. He stated that his children experienced difficulties seeking as- sistance in reaching their home after the concert, because of the disappear- ance of the driver of the car they had arrived in. In the ensuing discussion, Larry Sierk, General MAnager of the Anaheim Chamber of Commerce, said they had received some' phone calls re- garding the concert; reporters from the Anaheim Bulletin and the Los An- geles Times said they had attended the concert and had witnessed some ir- regularities. The City Manager reported considerable demand for holding such a concert at the Stadium, and advised this one had been experimental. He added that Rock Concerts in the smaller and more easily-controlled Conven- tion Center had been successful.
