MOIION CARRIED. 8401 City ~all, Anaheim~ California - COUNCIL MINUTES - February 2~ 1965~ 1:30 RECLASSIFICATION NO. 61-62-110 AND CONDITIONAL USE PER~IT NO. 248~ Request of Linbrook Hardware for permission to delay construction~of wall along the southerly boundary on Parcel 3 of property described in Reclassification No. 61-62-110 and Conditional Use Permit No. 248, was before the City Council January 19~ 1965~ with no action being taken at that time. On motion by Councilman Krein, seconded by Councilman Schutte~ temporary waiver of wall construction on the southerly boundary of Parcel 3 was granted for a period of one year~ subject to the posting of a bond to guarantee said wall installation° MOTION CARRIED. PUBLIC HEARING - BILLBOARDS~ City Planning Commission Resolution No. 1460~ Series 1964-65~ recommending the amendment to Title 18 by the addition of Chapter 63~ Billboards~ and City Planning Commission Resolution Nco 1461~ Series 1964-65, recommending the amendment to Title 18, Section 18.64.020 (3-f) Use-Billboards° Staff report from the City PlaBning Department dated 3anuary 27, f965, setting forth the background of the proposed ordinance and explaining portions thereof~ was submitted and reviewed (copies furnished each Councilman). Assistant Planner 3ack Christofferson briefed the high points of the proposed ordinance~ advising that billboards which would be located along freeways were excluded from this ordinance~ being governed by the Anaheim municipal Code. Mr. Christofferson called attention to chart posted on the east wall of the Council Chambers, entitled~"Amortization of existing R-A billboards - zones permitting billboards - and potential billboard site". The ck~z'c ~]tustrated how billboards will be restricted to certain locations along major arterial highways~ primary and secondary streets~ in conjunction with the proper zoning~ as well as reflecting existing billboard signs. He pointed out that the center-city area was not included for billboard locations~ since it is under urban renewal study by Victor Gruen and Associates; also omitted were Katella Avenue and Harbor Boulevard~ due to their location in the commercial-recreation area, plus their connection with the baseball stadium and the downtown area, respectively. 8402 F City Hall~ Anaheim~ California - COUNCIL MINUTES - February 2~ 1965~ 1730 P.M. Slides were shown illustrating some of the 97 existing billboards in the City of Anaheim, 38 of which are oriented to freeways. Discussion was held by the City Council and Mr. Chris%offerson, and it was noted that this ordinance has been understudy and preparation for approximately five years. The Council expressed their desire to receive comments from representatives of the billboard industry. Mr. Don Davis, of Foster and Kleiser Division, 1550 West Washington Boulevard, Los Angeles, addressed the City Council complimenting the planning staff for their accomplishment, and the City Attorney's Office for their assistance. He was of the opinion that the approach taken and the proposed ordinance was very reasonable, and felt that it will be beneficial to the City of Anaheim as well as to the industry. In answer to Councilman Krein's question, Mr. Davis advised that the proposed three to five year period was stipulated for existing signs to conform with the ordinance as a reasonable length of time in which to amortize investments in signs which would become non-conforming. He pointed out that many of their potential non-conforming signs would be removed in advance of the three year minimum, due to ~evelopment of vacant properties on which the signs are located. Mayor Chandler asked if anyone else wished to address the Council, there being no response, declared the public hearing closed. Further discussion was held by the City Council, and at the conclusion thereof, Councilman Krein moved that the City Attorney be instruc- ted to prepare necessary ordinance, substantially in'accOrdance with recommendations as presented, including those contained in report dated January 27, 1965. Councilman Schutte seconded the motion. MOTION CARRIED. PUBLIC HEARING - CON~ERCIAL-R~CREATION AREA POLICY~ SETBACKS AND LANDSCAPING: The City Planning Commission pursuant to Resolution No. 1~64, Series 1964-65, recommended the establishment of a setback and landscaping policy along the street frontages in the commercial-recreation area, as set forth in said resolution. Excerpt from the minutes of the City Planning CommissiOn meeting held January 4, 1965, were submitted advising that when the original commercial-recreation area setback study had been initiated, Freedman Way and Clementine Street were not extended; since that time said streets were extended and development occured, therefor the City Planning Commission recommended that Freedman Way and Clementine Street be included at the public hearing before the City Council pertaining to said policy. Mr. Mickelson briefed the background information and proposed setback and landscaping areas for the various streets within subject area~ referring to aerial map posted on the east wall of the Council Chamber. He no%ed the flexibility of the prOposed policy, and advised that it was not the intent of the City Planning Commission to ask established businesses for immediate conformance to the policy~ however~ if expansion w~re to take placer new or additional landscaping might be requested. Basically the policy would apply to new developments. Mr. Leo Freedman indicated his desire to address the Council. Therefor due to a possible conflict of interest, ~ayor Chandler withdrew~ from the meeting, and ~ayor Pro Tem Dutton assumed chairmanship. Mr. Leo Freedman, 7 Freedman Way, called attention to the fact that usually lessees are responsible for maintenance, of landscaped areas, which can be a costly item. In his opinion, landscape reqQirementsare greatly exaggerated, and he requested that Setbacks along Freedman Way be established at ten feet. Mayor Chandler resumed chairmanship of the meeting, and asked if anyone else wished to address the Council. ~r. Hiroshi Fujishige, owner of property on Harbor Boulevard, addressed the City Council indicating his opposition to the proposed fifty foot landscaping setback for Harbor Boulevard. Mr. Charles Currier, Manager of the Disneyland Hotel, 1441 South West Street, advised that when they expand their hotel, the proposed thirty feet of landscaping for West Street would eliminate approximately fifty parking spaces in front of the hotel. ~rg Mickeison advised that it was not the intent to require that a portion of asphalt paving of an existing parking area be removed, however~ if no-i~ landscaping exists on the property proposed for expansion, a minimum requirement would be recommended. Mayor Chandler asked if anyone else wished to address the City Qouncil D ~tr. Dave Collins, 1077 West Ball Road, was of the opinion that not only should the proposed policy be reasonably flexible, allowing creative landscaping and architecture, but also said flexibility should be written into the policy. Mr; Paul Schlund~ owner of property at 2036 South West Street, advised that he would be opposed if his residential property, adjacent to a C-R use, were required to comply with landscaping setback for West Street. ~r. James Rose, 802 Glendale, Orange, representing Disneyland, advised that there is a parking problem in the commercial-recreation area, and perhaps additional study would ~eYe~'more realistic formula in keeping with the city's beautification expectations, while allowing for the increasing traffic and parking problems.' He requested an opportunity to study the proposed policy in detail. On motion by Councilman Pebley, seconded bY Councilman Krein, public hearing on recommended setback and landscaping policy in the commercial-recreation area was continued to ~arch 2, 1965, for further study. PUBLIC HMARiNG - GENFaRAL PLAN A~ENDMENT NO. ~7:' City Planning Commission pursuant 'to Resolution No. 1462, Series 1964-65, recommended that the Circulation Element Highway Rights-Of:-Way of the General Plan be amended by the approval of General Plan Amendment No. 47, establishing Cerritos Avenue and Douglas Road as secondary highways between Sunkist Street and the Santa Aha River, based on the following findings~ 1. That the preliminary estimates by the Traffic Engineer indicate daily traffic volumes on these streets will reach approximately 11,000 to 12,000 vehicles at ultimate development. The County standards for a secondary highway is 10,000 vehicles. Therefore, a secondary highway designation is deemed necessary. That although said streets are outside the City limits of the City of Anaheim they are represented as part of the Highway rights-of-way of the Circulation Element of the General Plan. SIGN REQUESI~ Application submitted by Federal Sign and Signal Corporation, requesting permission to erect a non-conforming sign at'the IndePendent Bank, 129 West Lincoln Avenue, was reviewed by the City Council together with report from the Building Department. In answer to Council questioning~ Mr, William Barker, Sales ~ngineer for Federal Sign and Signal Corporation, advised that no letter of approval has. been. obtained from the adjoining property owner to the east. On motion by Councilman Dutton, seconded by Councilman Krein, said sign permit was granted, subject to letter of approval from property owner to the east (sign "A"). MOTION CARRIED. RECLASSIFICATION NO. 63-64-120 AND CONDITIONAL USE PF_RMIT N0. 571 - R£V,ISE~ PLANS~ Revised plans submitted by Standard Oil Company of California, in connection with Reclassification No. 63-64-120 and Conditional Use Permit No. 571, were reviewed by the City Council together with recommendations of the City Engineer and Planning Department-Development Review. ' Mr; R, C, Runion, Sr., representing Standard Oil Company, questioned the necessity of the required planting area in the rear of the service station, marked in red on the revised plans, and advised that a block wall constructed six feet from the finished grade would result in an eight foot wall on adjacent properties. Mr; Runion was advised that the six foot wall and the planter strip were required as a protection to adjoining R-1 properties.' Councilman Krein moved that Revised Plans marked Exhibits 1, 2 and 3~ Revision No. 1, be approved. Councilman Dutton seconded the motion. MOTION CARRIED. Revimed pl~n~ dated thi~ date and signed by Mayor Chandler. 8405 City Hall~ Ana. heim~ California - COUNqIL MINUTES -.February 2~ 1965~ 1.z3Q R~QU~T - FUNDS SOLICIIA.IION~ Communication dated December 2, 1964, from Mr~ ~lbert Hall requesting permission to solicit funds in the City of Anaheim for charity purposes, on behalf of the United Mission and Church in Los Angeles, was submitted. Mr. Hall, 2657 Dalton Avenue, Los Angeles, addressed the City Council advising that although they did not have a church in the City of Anaheim at the present time, their primary purpose in raising funds is to build a non-denominational church. He described the services performed by mission workers in the field, and noted the proportions of amounts to be solicited which would be used for religious purposes and for overhead expenses. In answer to Council questioning, Assistant City Attorney 3chh Dawson explained the provisions of Section 7.32.030 of the Anaheim Municipal Code concerning allowable administrative costs for such solicitation of funds. Council discussion was held, and at the conclusion thereof, Councilman Dutton moved that the request to solicit funds be denied on the basis that the application is deficient under provisions of the Anaheim Municipal Code.' Councilman Schutte seconded the motion. MOTION CARRIED. In answer to Mr. Hall's question, he was informed that a revised application could be filed, and if investigation proved the validity thereof, further consideration would be given by the City Council. Grant Robinson. The City Bngineer reported said final map conforms substantially with the tentative map previously approved, that bond has been posted and forwarded to the City Attorney for approval, and required fees paid. In ~is recommended approval thereof, Mr. Maddox noted that in accordance with Condition No. 2 in the tentative map approval, the "Not a part" has been included in the final tract, precluding the necessity of dedication of access rights to Bast Street~ further~ because of necessary lot renumbering, Condition No. 3 should be amended to read as followsl !~Ihat a drainage easement be provided over Lot Nos. 7 and 18, from Lacy ~venue to Vermont AvenQe". IRE~S~ Mr. Robert Davis reported on call for bids to be opened 3anuary 28, 1965, for the removal of 38 Canary Island palm trees on the west side of State College Boulevard, between Wagner Avenue and Ball Road, and transportation thereof to designated area on the Anaheim Stadium site, transplanting trees per specifications, to include protection of City electrical division communication cable during tree removal operation. He advised that one bid was received from American Tree Service, in the amount of $12,312 (Alternate "A") or, if the communication cable was remoVed:~'b~ them from the working area prior,to the'tree removat~.the~cost wO~ld be reduced '~ {o $11,172 (Alternate "B")~. In conclusion, Mr. McMahon noted that the petition of opposition was signed by many people living some distance away from the property, while those people on adjacent properties which would immediately be affected, where not objecting. Mr. Louis Miller, 403 ~ast WardloW Road, Long Beach, Architect for the project, read from an article on city planning contained in the American Institute of Architects Journal.' He advised that the proposed development has been designed in an attempt to prevent urban scrawl, and noted variations in styles and sizes of buildings, and the spaces between %hem, retaining the general residential character. Mr. Miller displayed a rendering in color illustrating the appearance of the development from Broadway Street. Miss Grace ~. Dickerson, Applicant, addressed the City Council advising that subject property has been owned by her family since the year 1912, that she now resides on the property and intends to live in one of the units proposed. She noted the improvement of these plans, as compared to the plans proposed when the R-3 application was made. 8412 City Hall, Anaheim, California - COUNCIL MINUTES - February 2, 1965,. 1~30 P,~. Miss Dickers°n was Of the opinion that the development would increase the assessed valuation of property in the area. She explained her plans for setting aside sums derived from the rentals, so that the education department of Whittier College could aid deserving young people to become teachers. In answer to Council questioning, Miss Dickerson stated she had no intention of selling the property. Concerning the college fund, she advised that it would commence when the lease is in force. Mayor Chandler asked if anyone wished to address the Council in opposition to the development. Mr. Stanley Hankins, 223 Wayside Place, advised that the property fronting on Lincoln Avenue is zoned C-l, however no development has taken place° He was of the opinion that any multiple dwellings on subject property would be incompatible with adjacent single family residential properties. Mro Hankins noted that the revised plans were submitted after the City Planning Commission hearing, and had not been reviewed by the Com- mission; although the density proposed has been reduced, the development would still increase the density by at least 60 per cent over that indicated by the general plan. Concerning petition containing signatures of persons not immed- iately adjacent to the property, Mr. Hankins was of the opinion that they are affected, not only by development on subject property, but other vacant properties which might request multiple residential zoning on the basis of approval of subject applications. Concerning access to the property, Mr. Hankins noted that an access drive a minimum of 120 feet from both Date Street West and Wayside Place would conflict with Elder Street, extending southerly from Broadway, generating a traffic problem. Mr. Hankins further noted that some children in the Lincoln Elementary School District last year were transferred to other schools to alleviate the crowded conditions. He thereupon requested the City Council to concur with the findings of the City Planning Commission, and deny subject applications° Councilman Dutton asked what were the specifics that make R-1 and R-2 properties incompatible. Mro Hankins stated that since the general plan gives some pro- tection to property owners~ any usage other than indicated on the general plan would be incompatible; further, he noted prices of real estate in subject area, and failed to see why single family residential community advantages should be enjoyed by apartment dwellers. Mr. Hankins felt that R-2 zoning would overcrowd a neighborhood, and referred to the fact that residential property owners chose this location because of its single family residential characteristics. Further discussion was held, and Mr. Hankins felt that the City Planning Commission should review the revised plans, and if approved, in his opinion there would be little objection thereafter. On inquiry of the City Council, several persons in the audience raised their hands indicating their opposition to the proposed development. He summarized the evidence submitted %o and considered by the City Planning Commission, and reported that the property is developed as a medical center, in accordance with Conditional Use Permit No. 265, granted by the City Council August 7, 1962. Ihe applicants are now proposing to add a restaurant, office facilities and office related uses to this medical center, which would front on Ball Road on the easterly portion of the property. He inquired as to whether the wall on the west property line would remain a condition. Mr. LeRoy Rose, Agent for the applicants, advised that at the present time they have filed a request to the City Council to allow posting of a bond to insure installation of said wall, as in the event that the property to the west is zoned commercial, the wall will no longer be necessary. Ihe wall required on the east property line would be installed, however, since adjacent property is residential. Mr. Wolfertwas of the opinion that R-3 zoning might possibly be the best zone for his property, and he again asked whether or not the wall on the west property line would be required. Mr. Dawson explained the provision quoted by Mr. Davis, advising ~hat in lieu of requiring the additional parking spaces~ the city may include parking available in existing municipal parking lots as the balance ~equired in the center-city area; however, to accomplish this~ an "in lieu" payment by the petitioner would be necessary. Mr. Milton Copeland, Attorney representing the applicants, addressed the City Council with reference to Section 18.40.070(4)(a)(3~b), and advised that since the provision for that portion of the school used for assembly or instruction states one space per seat or per each ten square feet of gross floor area, without specifying "whichever is greater", it was his opihibn, that the intent was written in the alternative. If the parking required for the ~300 square feet used for teaching were broken down by ten square feet of gross floor area, 43 parking spaces would be required.
