MOTION CARRIED. 7¸'. 8530 City.Mall, Anaheim, California - COUNCIL MI.N-UTES - March 23, 1965i VARIANC~ NO, 1347 - ORDER TO SHOW CAUSE -.~HELDON A, "CHIP" CHASIN: .Ordg~ to Show Cause why Variance No. 1347 should not be revoked by the City Council for failure:$o.comp!y.with conditions of said variance, w~s submitted, Mayor Chandler referred to a report concerning said i~sUe and advised of the contacts made and the requirements not complied with. It was noted that the variance granted permission to construct a motel subject to conditions, and that the property was advertised apartments. Also noted was the fact that Condition~No'. 5 of ReSolutiOM No. 6795 (street lights), nor the provision requiring the payment of 4 percent gross rental receipts license tax for motel Opera~ion, hadbeen complied with. Mr. Chasin advised that the subject variance was acquire~ by~- another party, and that he was not aware of the requirements, neither he nor Mr. Robert Unger have any interest in the property at this time, however at one time, they did hold a lease interest only. He reported that they used the complex as an apartment Complex rather than a motel, and was not aware that the 4 percent business license would apply. Mr. Chasin advised that at"one time he agreed to take care of the requirements, however, upon returning from a ~trip, h~ W~$ ~o.longer a party to the project, In his opinion, he was not the oae t~ answer thbse charges. The complete file of Variance No. 1347 was revteW~ and contents therein noted. At the conclusion of the discussion, on m~%~on by Councilman Schutte, seconded by Councilman Krein, the City Planni~ ~%partment was" instructed to determine in conjunction with the propert~ owner, Mr. Chasin and Mr. Unger, what the ultimate use of the property i~ to be, either a motel or apartment complex, and when such determina~.oa ~s made, an application be made under this motion of the City Council for the placing of the property under the necessary conditional use p~rmit or zoning', .~ ' Further, the matter of street lighting and who is responsible for payment~ and the question of the 4 percent license tax for motel operation, and who is responsible for payment, if any is due, be ref~ed tQ the City Attorney for action if necessary. MOTION CARRIED. On motion by Councilman Krein, seconded by Councilman Dutton, Council action on Variance No. 1347 was continued to April 27, 1965, 1:30 P.M. MOTION CARRIED. SIDRWALK WAIVER: Request of William C. Sangster and Lonnie M. Dunn, for waiver of sidewalks in the 2100 block of East Orangewood Avenue (southeast corner State College Boulevard and Orangewood Avenue), was submitted, and temporary waiver for a period of one year was granted~ subject to no permanent planting or permanent type improvements bein9 permitted within the area reserved for future stdewalks~ on motion by Councilman Dutton, seconded by Councilman Schutte. MOTION CARRIED. ENTERTAINNIENT PERMITS: The following applications for entertainment permits were submitted and granted for a period of one year, subject to the recommendations of the Chief of Police, on motion by Councilman Dutton, seconded by Councilman Krein: a. Application filed by James Liberio to allow musical entertainment at the Casa Roma, 1740 West La Palma Avenue. b. Application filed by James L. Brush to allow piano bar at the FJnbassy, 300 West Lincoln Avenue. Application filed by Frank A. He further reported on informal bids received for the reproduction of the plans, as follows, and noted that quotations were made on a unit cost basis, 50 sets to be printed first, and more obtainable, if necessary. Further, the Parks and Recreation Commission was requested to consider and make a recommendation for a-policy concerning Similar requests by various organizations. ~ LEOlSLATION - AB 448: Mr. Davis reported on League of California Cities Bulletin concerning proposed reduction in work hours for firemen, Assembly Bill 448, to be heard hy the Assembly Committee on March 25, 1965. He advised that in checking with the City Personnel Director and Fire Chief, it was estimated that the impact on the City of Anaheim, if this bill were enacted, would he an increase in cost to the City of $247,820.00 annually .'for the necessary employment of ~ddi~i~nal'~personnel. , Mr. Edward J. Stringer, Chief of the Fire Department, addressed the Council advising that the Orange County Fire Chiefs~ Assoctation~have 9one on record in opposition to AB 448. The Anaheim Fire Department personnel haVe indicated their preference that Fire Department working conditions remai~ under local jurisdiction. Mr. Mickelson noted the location of the property, and zoning in the ,immediate area. In summarizing the hearing held before the City Planning Commission he doted that the P-1 zone includes R-3 us~. He further reported that Planning Staff recommended 'C-O zoning for Parcel 1 instead of the requested C-1 zoning. The Mayor asked if the applicant or his representative wished to address the Council. Mr. seymour Shulman, Hospital Consultant, 7266 Franklin' Avenue, Los Angeles, California, representing the applicants~ advised that the applications involve an approximate a acre site, for a 55-bed acute short term general hospital with future plans of expansion to a total of 150 beds. He reported the facility would serve emergency provisiOns for a triad of freeways, the future Anaheim Stadium and future expansion of population and industries in this a~ea. Mr. Shulman reported on the existing facilities in the west, south, north and w~st central areas, and advised that there were no hospital facilities located to the east~ further~ the propgsed hospital would serve East Anaheim, Olive, Placentia, Yorba Linda and North Orange, or an estimated population of forty to fifty thousand people. Mr. Shulman reported that .34 physicians have endorsed the proposed hospital, which in his opinion, would appear to insure use of the facility. .In presenting the proposal to the Hospital Committee,' Mr. Shulman stated, i't was pointed out that their present method of computing hospital needs might be reconsidered, in light of newer and more up to date methods recommended by hospital authorities, as the uniformly applied bed population ratio cannot always be used as area differences and characteristics affect utilization. He gave as an example a situation that pointed out the fallacy of such a "need" computation method. Mr. Shulman reported that the proposed hospital represents an investment of approximately One Million Dollars, and a staff of approxima- tely 125 employees. In his opinion, if develop]ed,' it would, fulfill a Void in the eastern. The Mayor asked if anyone else wished to address the Council favoring subject applications, there being no response, invited anyone opposed to address the Council. 'Mr. Grant Cattaneo, 1515 North Vermont Avenue, Los Angeles, California, Staff RePresentative to the Orange County Ho§pital Planning Committee, regarding the characteristics of various areas, advised that their organization has recognized for some time that a flat bed rate could not be used, and have waived the merits of each proposal in terms of the community need, that Qne factor considered was the average age of the population, and according to 1960 Census, Orange County has a smaller 8539 City Hall, Anaheim, Q$1ifornia - COUNCIL MINUT£S - March 23, 1965, 1:30 P.M. percentagg__of_old9r people than most counties in California. He advtsed of the change in the number of beds proposed, and stated that regardless of the size of the facility, the real issues were: is there a need, whose need and what was the responsibility of the City Council to the citizens and the community. Mr. Cattaneo reported that West Anaheim Hospital is in existance and Anaheim. General is presently under construction, and the addition of hospital beds have increased the cost approximately 50¢ per day to those patients utilizing Anaheim facilities. In his opinion, the.riGhts oi the community, or only the interest of a few, compel.determination of need for. special hospitals, and further, the community does not need another hospital nor does it need some of those in existance or about to be completed. He called attention to the need of one or two hospitals properly supported hy the community, in order to increase service rather than the number Of beds; and further advised, that the Orange County Area Planning Committee is of the opinion that it is more efficient and economical to expand an existing facility, rather-than delute the number of highly skilled personnel.by increasing the~numher of facilities. Mr. Cattaneo emphasized that their objectives were to provide the best possible hospital care in the most efficient manner through logical planning, and the right of protection was a responsibility of all. The Mayor asked if anyone else wished to address the Council. Mr. S. Stroud,_231No~th Spruce Street, Anaheim, advised that a year ago it tOok.two weeks for him to he admitted to a hospital for much needed surgery. Mrs. Robert Ktinger, 536 Westgate Drive, Anaheim, reported that she and her husband timed the.triP.from their home to the Anaheim Memorial Hospital last evening,after 6:30 P.M., and found that it took 22 minutes. She advised that there were 62 children in their block alone, and with the growth of the area, the need for the facility was evident. Mr. Bob Hunt, 557 South Rio Vista Street, addressed the Council urging the granting of said applications. Dr. Tarlow advised that one of the objectives of the proposed hospital will be to have emergency facilities 24 hours a day. He related an experience while in emergency service at the Anaheim Memorial Hospital, where a patient was required to be hospitalized in another hospital because of lack of available beds. Dr. Tarlow was of the opinion that the proposed hospital would not only he a service to the community, but would elevate the general real estate in the area. The Mayor asked if anyone else wished to address the Council., 'there being no response, declared the hearing closed. Discussion was held regarding access to Coffman Street, and Mayor Chandler suggested, should the applications be granted, that deed restric- tions be placed on the P-1 area restricting its ~se to parking only. Mr. Frank Gruys, 8440 Melrose Avenue, Los Angeles, California, advised that would stipulate to the use of the P-1 area for parking only. Mayor chandler advised that he respected the opinion of the Hospital Committee, however, in his opinion, their studies.Would be more fittingly directed to the people involved in an acttvtty such as this. By the same token, tf development of Revised Tentative Tract No. 5389 were completed as approved, plans for subject property would have to be revised for the same reason. However, if subject property is developed as shown on Exhibit A, traffic circulation problems would be resolved. Mayor Chandler asked whether an attempt has been made to resolve said problem with interested pasties concerned with Tract No. 5389. Mr. Le Roy Rose, Architect for the proposed development, and representing the applicants, advised that their position has not changed, as the owner of the property to the west has not agreed to withdraw, nor to revise, Tentative Tract No. 5389. Mr. RoSe was of the opinion that the best procedure would be to approve subject development with alternate street pattern proposed, allowing streets to align with those approved in Revised TentatiVe Tract No..5389.. Discussion was held by the City Council and City Attorney concerning Area Development Plan No. 19, with regard to development of the narrow property to the east of subject PrOpertY, and legal problems which could arise with an alley and wall on the west boundary of Tract No. 5~82. Mr. Geisler advised that the block wall could present a maintenance problem to the City. Mr. Ranald A.
