The Mayor asked if anyone wished to address the Council. Attorney, 3o Eo Coldecott, representing the Applicants, addressed the Counci!~ reviewing the proposal, outlining the area and uses in the immediate v~cinity of this property° A plot plan and artist~s rendering of the proposed development was placed on the blackboard for all to review° Mr~ Coldecott explained that the exact layout of the development will depend a great deal on the wishes of the financial institutions and also the architects; that they did not want to leave any impression that the maps shown at this hearing would necessarily be actually what would be constructed. That th~s was what they have in mind and intend to build, but conditions may require ~ome varfatfons, and therefore, they did not wish to be bound by these maps as subm]~tted~ He agreed with the necessity of dedication of land for the widening of Loara Street, and assured the Council that the access to £uclid Avenue would be worked out in which every way deemed best by the City Council~ That they have no intentions of constructing a street along the Flood Control Channel. He further stated that he understood that there would necessarily be dedication for the widening of 5uclid Avenueo Mr~ Coldecott agreed with the findings and actions of the City Planning Commission and urged approval of the rezoning by the City Council. Mayor Pearson asked if any thought had been given to putting a road through north and south, coming out the west end of the 10 acre parcel onto Crescent. Mr, Coldecott advised that he didn't believe under any circumstance~ that it could be considered and stated the reasons: Obtaining the right to bridge the Flood Control Channel. The reduction of the Bank parking lot facilities. A gentlemen in the audience asked if the units would be both singles a~d doubles Wr:~ Coldecott answered that there would be a mixture of one bedroom units having approximately 625 square feet floor space and two bedroom units having approximately 850 square feet floor space. Further discussion was held regarding necessary access for vehicles and was agreed that this would have to be carefully considered by the City ~ngineering Department~ Mr. Burton addressed the Council, opposing any opening onto Loara Street. In his opinion, all traffic from the northeast would be coming through the sub- division tract streets. The minutes of the City Planning Commission regarding the suggested restrictions to be placed on the reclassification were read. With reference to assurance of a first class development, Mr. Coldecott e×plained that there would be well in access of Two Million Dollars in this project and that they had already invested a great deal of money in the area and do not intend not making this a first class development. Councilman Coons asked if they would be willing to include in the deed restrictions that the structures would not exceed two stories. Mr. Coldecott answered, Yes. Mr. Burton advised that the people in Claredge Park felt that the zoning should be R-1 down to the storm drain and requested that the matter be continued for two week so that the people in the area could be heard. Mr. Coldecott advised that this application had two hearings before the City Planning Commission and that this was the second hearing before the City Council and was opposed to further continuance. 2509 City Hall, Anaheim. California~ February 11~ 1958 - 7:00 Considerable consideration was given on what would be reasonable requirements to the rezoning for the protection of all concerned° Mr. Art Beach, resident on Loara Street, referred to the already over crowded conditions of the school. Mayor Pearson asked if anyone else wished to speak on this matter, there being no response, declared the hearing closed. ~ESOI.UTION NO. 4359: Councilman Fry offered Resolution No. 4359 and moved for its passage and adoption, authorizing the prepara~on of necessary Ordinance changing the zone as requested, subject to the recommendations of the City Planning Commission, with the exception of item Noo 2, and further subject to the inclusion in the R-3 deed restrictions that the structures not exceed two- story in height; that the plans for the development of the area showing the type of building and street pattern, etc., be submitted to the City Council for ~ a '~ ~n = approval before the adoption of the Ordinance completing this zone change, Refer to Resolution Book, page A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING 7HAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. A~NDED VARIANCE NO. 701: Submitted by Neville Chemical Company, requesting a change in Condition No. 7 of Resolution No. 3751, granting Variance No. 701, to allow for a revised plot plan layout of buildings, rearranging the plant location to front on Cerritos Avenue and the construction of a Butler type building instead of masonry building for warehousing. The City Planning Commission, pursuant to their Resolution No. 172, Series 1957-58, 9ranted Variance No. 701, as amended~ (for revision of plot plan and use of Butler-type building) subject to: 1. The erection of Butler type warehouse building and office at the location shown on the plot plan which becomes a part of the record. 2. That all other conditions incorporated in the City Council's Resolution No. 3751 be adhered to. 3. That any future development of the north portion of the property fronting on Winston Rd. be subject to review by the City Planning Commission and the City Council. 4. That Cerritos Avenue be developed as a 30 foot half width street deeding 30 feet to the City of Anaheim from the centerline. 5. The installation of curbs, gutters and paving of the one half width street on Cerritos Avenue. 2510 City Hall~ Anaheim~ Californiat February 11~ 1958 - 7:00 Copy of communication sent to the City Planning Commission from Thomas p, Walker was submitted and read. Discussion was held regarding street widths in this area and George E. Holyoke, City Engineer, reported that Placentia Avenue will be a 106 foot street, Sunkist will be a 90 foot right-of-way with a 64 foot travelway, and recommended that the street dedication be increased to 45 foot half street for Cerritos Avenue~ and 32 feet for Winston Road. Mr. Stahl of the Neville Chemical Company was present at the meeting and agreed to the dedication of 45 feet instead of 30 feet on Cerritos Avenue, and to the dedication of 32 feet on Winston Road if required by the City Council. The City Council requested the City Engineer to prepare necessary deeds for the dedication of these right of ways for street purposes. No further action was taken by the City Council. AMENDED VARIANCE NO. 800: Submitted by M. D. C. Corporation, requesting permission to relocate the intended use for better access to the building and easier circulation of traffic. The City Planning Commission, pursuant to their Resolution No. 173, Series 1957-58, granted Variance No. 800, as amended, to relocate the building~ subject to the following conditions: 1. That there be no access or egress to the property from Walnut St. This to be established by deed restrictions so that if in the future the property changes ownership, this condition will be maintained. 2. That there be a 15 foot landscaping area behind the property line on Walnut Street. This to be suitably planted with trees and shrubs. 3. That a 6 foot masonry wall be erected at the rear of the 15 foot landscaped area~ 4. That a 4 foot masonry wall be erected along the North boundary of the property. 5. Ray Rhoads, representing the Applicant, addressed the Council and presented a revised plot plan of the development and advised that the building would remain the same as previously considered by the City Coumil. He stated that although the property owners questioned the additional 10 foot dedication for street widening~ they agreed to this provision° (For clarification, see Minutes of [ebruary 18, 1958, page 2529) An explanation was given by City Engineer, George 50 Holyoke, regarding the condition of dedication° In answer to a gentlemen's question, Mro Rhodes advised t~t they were agreeable to no access onto Walnut Street° Petition containing eleven signatures approving the granting of amended Variance Noo 800 by the City Planning Commission was received at open meeting. VARIANCE NO. 904: Submitted by Chester Herbert, requesting permission to build two small commercial buildings in front of existing residence for a cam shaft shop and flower shop, on property described as 11221 South Manchester Avenue, and further described as lying on the west side of Manchester Avenue between Midway Drive and Haster Street. It was noted that the location of the property lies east of Haster S~reet, between Katella and Orangewood Avenues, therefore, action by the City founcil was withheld to the next meeting (February 18, 1958) to check for correctness the published description of the property under consideration. VARIANCE NO, 905: Submitted by Arvid and Inta Teters, requesting permission to operate an interior decorating service on property described as 523 South Palm Street (between Santa Aha and Water Streets). VARIANCE NO. 910: Submitted by Consolidated Roofing and Sheet Metal Company, requesting permission to use commercial building at 720 South Los Angeles Street for sale and fabrication of sheet metal. The City Planning Commission, pursuant to their Resolution No. 182, Series 1957-58, granted Variance No. 910 for the sale and fabrication of light sheet metal in conjunction with the roofing business now at the subject property~ provided that all the sheet metal work is conducted within the building, and operating hours be within the hours of 7:00 A. M. to 7:00 P.M. No further action was taken by the City Council. REVIEW NO. 14: Submitted by Mr. and Mrs. W. Bradway Aspin, requesting permission to erect a block wall one foot from the property line at 2332 East Seville Avenue (Lot 72 of Tract No. 2569). The City Planning Commission, pursuant to their Resolution No. 183, Series 1957-58, granted Review No. 14 to permit the issuance of a special use permit for a six foot concrete block wall, one foot at the rear of the property line extending to the rear of the garage. No further action was taken by the City Council. REVIEW NO. 15: Submitted by Rancho La Paz Mobile Homes Park, requesting permission to expend the present trailer park to the adjoining 10 acres on the west side of the existing park, increasing the capacity of the park by 110 trailer spaces, making a total capacity of the park, 290 trailer spaces. After taking into consideration certain protective measures filed for and on behalf of the owner of the property to the west, the City Planning Commission pursuant to their Resolution No. 184, Series 1957-58, granted Review No. 15 for the issuance of a special use permit for an enlargement of the existing Mobile Homes Park, subject to: The erection of a fence or masonry wall along the westerly boundary of the property at such time as it is determined what use will be made of this property. If manufacturing, it is possible the construction should be a 6 or 8 foot wall. ,~(r. Kenneth Brown, Manager-Vice President of Rancho La Paz Mobile Homes Park, addressed the Council~ stating that Mrs Hampton, owner of the property to the west, requested a six foot chain link fence and the City Planning Commission granted them the right to reserve the type of fence to be constructed, subject to the type of development of the adjacent property. He assured the Council that 'the fence or wall would be whatever type necessary to further beautify the park. !~r. Brown furiher explained the size and location of the trailer spaces and their type operation. Discussion was held regarding the necessary payment by all developers of the required fee for the acquisition of park and recreation sites and being consistent with subdivision ($25.00 per lot) this charge should be based on a $100.00 per acre basis for trailer parks. ~1r. Brown stated that although this was the first he knew of this re- quirement, they would be willing to pay the fee on a $100.00 per acre basis. Mannes, requesting C-1 zoning on property located on the east side of Brookhurst Avenue, approximately 130 feet south of the centerline of Niobe Avenue (324 foot frontage on Brookhurst). Public hearing was ordered to be held March 4, 1958, 7:00 P.M. on motion by Councilman Wisser~ seconded by Councilman Coons. MOIION CARRIED. Tract located between Sunkist Street and Placentia Avenue, south of and adjoining the Riverside Freeway~ containing 102 lots. The City Planning Commission approved said Tentative Map, subject to engineering requirements, and that should this subdivision be developed as more than one subdivision, each successive subdivision thereof shall be submitted in tentative form for approval. full. Murdoch~ called attention to drainage easement at the end of the cul-de-sac on the lot lying between Lots 4S and 49 and advised that these drainage ditches are a constant source of maintainance and annoyance to the neighbors. Mr. A. R. McDaniel, Engineer for the tract, addressed the Council and advised that probably a conduit system to drain the tract could be worked out and was certain that this could be taken care of to the satisfaction of both the City and the developer. On the recommendations of the Administrative Officer and with the consent of Engineer, A. R. McDaniel, action by the City Council was withheld for one week to se~ what type of construction could be developed for the drainage of this tract~ on motion by Councilman Coons, seconded by Councilman %~isser. MOTION CARRIED. REVISED TENTATIVE MAP, TRACT NO. 1646: Subdivider, J. T. Hintz. Tract located on the west side of Western Avenue, approximately 1657 feet north of Ball Road and contains 73 lots. The City Planning Commission approved Revised Tentative Tract Map 1646, subject to the following: 1. Engineering requirements. 2. Should this subdivision be developed as more than one subdivision~ each successive subdivision thereof shall be submitted in tentative form for approval. A gentleman addressed the Council and asked if there were any architectural restrictions on this tract and called attention to the already constructed large homes in the area. He was answered that the only restrictions that would apply to this tract would be the 1225 square foot liveable area requirement and the minimum lot size requirement of 70 foot frontage and 7200 square foot area. It was considered by the Council that this area should be given further consideration~ as it appears to be partially established in compliance to the R-O zoning. Mayor Pearson asked if anyone was present representing the tract. There was no response. It was moved by Councilman Wisser, seconded by Councilman Coons, that Revised Tentative Map of Tract No. 1646 be denied without prejudice to resubmit with plans for proposed development. Tract located on the west side of Eucild Avenue, approximately 527 feet south of Ball Road and contains 25 lots. The City Planning Commission approved said tentative map of Tract No. 3199, subject to the following: 1. Engineering requirements. 2. Should this subdivision be developed as more than one subdivision, each successive subdivision thereof shall be submitted in tentative form for approval. Mr. Dale A. Schienost addressed the Council and advised that the homes planned for this tract would be similar to those across the street in the Aha-Wood subdivision. lhe Engineering Committee recommendations were submitted and read in full. On the recommendations of the Administrative Officer and City Engineer, Councilman Fry moved the Tentative Map of Tract No. 3199 be approved, subject to the recommendations of the City Planning Commission and the Engineering Committee.
