The City Planning Commission, pursuant to their Resolution No. 261, Series 1957-58, granted said variance, subject to the nine conditions established by the City Council for such directional signs. The City Planning Commission, pursuant to their Resolution No. 263, Series ]957-58, denied said variance. No further action was taken by the City Council. VARIANCE NO. 968: Submitted by Patricia E. Linton, requestin9 permission to erect a permanent neon sign in front of commercial store at 1765 ~est La Palms Avenue (north side of La Palms Avenue, west of Euclid Avenue). The City Planning Commission, pursuant to their Resolution No.264, Series !957-58, granted said variance, subject to the erection of the sign in accordance with the plan presented. TRAC[ NO. 1782: Request of the Wagner Realty Company for reconsideration of Tentative Map, Tract 1782, was submitted. The City planning Commission recommended approval of said tentative map,subject to the following conditions: i. That Priscilla Avenue be made a 60 foot street. That the owner of the subject tract contact the owner of the prope?t¥ to the East in an attempt to reach an agreement to develop proposed "A'~ Street as a full 60 foot width street. In the event of the fail- ure of the owners to agree upon said street, Street '~A'~ to be constructed as a 30 foot alley with full sidewalk development on the west side. That in the event Tentative Tract No. 3288 to the West is not constructed prior to the construction of the subject tract, a 30 foot easement with subsequent full improvements thereof for street purposes be obtained along the East boundary of the existing shopping center to connect proposed '~A'? Street with Anaheim-Olive Road. 4. That lots 1-.8 inclusive facing Westport Street be limited to multiple family dwellings of only one story in height. 5. Engineering requirements. Print of said map was placed upon the bulletin board and the location and zoning noted. The Administrative Officer reported that this map had been reviewed by the Engineering Committee, ~hich committee comprises himself, the City Engineer, P]~nning Director, Director of Public ~orks and Director of Public Utilities~ and t~i~: street pattern would, at least, serve the area if it had an outlet to the north or east or both. It. would require immediate construction of the east-west street running %hrough Tract No. 3288, that the opening to the west appears to be assured by Lhe recording of the tract map. The map was previously denied by the City Council because: 1. The uncertainty of the extension of the north or east streets through the tract. 2. To see if there was a possibility of limiting to single story the multiple dwellings on the south tier of lots. R. W. Mungall advised, the property is presently zoned P-l,which allows R.-.3 use. M:r. Nerenbaum, Registered Civil Engineer, addressed the Council relating their meetings with the Engineering Committee, am the changes to the map resulting from said meetings, that the map now meets all requirements and requested approval. He further advised that the land could be used for R-1 as well as R-3 purposes and their plans were revealed so as not to appear to be withholding anything. At the suggestion of the Administrative Officer, and it being agreeable with Mr. Nerenbaum, Councilman Fry moved that Tentative Map of Tract No. 1782 be approved, subject to the filing of deed restrictions limiting to single story structures those dwellings on the south tier of lots, being lots i-8 inclusive and that recording of these restrictions be prior to submission of the map for final approval. Mr. Ha,try Coolidge, resident-owner in the tract directly to the south, addressed the Council advising that, although the majority of the homes were sold wh~ the er'~gin.~i healting on this matter was held, they were not then the duly recorded owners, therefore, not notified of the hearing. If this technicality' of a few days would void tae variance, the property owners would have an opportunity to be heard =egm'~aing R~.-3 use. It was his opinion that all were opposed to the two story strut- When =~sked what the average time was between a tentative map and a final map, Mr. Holyoke ~dvised that this was a period of approximately six months and with ~ctioa on the final map, there is also worked out, street, sewer ~nd water plans,and ?~a[ the cost of getting a final map to the City Council for approval is approximately $~00.00 per lot. Councilman Coons felt that since the time of the v~ri~nce was granted, one the the conditions being the filing of the final map, that. if the applicant hired an engir~eer and proceeded with the preparation of the final map and suffered a delay caused by the City Engineering Department, resulting in ~heiz request for a change, in his opinfoe, this would constitute work on the project. Mayor Pearson was of the opinion that this was a matter of decision on the p,~rt of the C~ty Council and whether or not there can be a satisfactory compromise, as the peopi~ ia the area have made known their feelings, and are entitled to be Mr. Coolidge was sure that the people in the area would never be satisfied ~iZP~ the construction of a two story unit, of any type, at this location even ~ith ~be provisions of no windows and a high wall. In their opinion, this type of build- ing was not compatible with the homes already constructed. The City Planning Commission, pursuant to their Resolution No. 265, Series i957-58 9ranted Variance No. 969 for a waiver of 25 feet to 20 feet for front yard set-backs except on Lots 59 to 62 inclusive, which face on South Street, these must be maintained at 25 feet, and a waiver of rear yard requirements on Lots 3 to 27 inc!usLve as shown on plot plan, which is a part of the application. No further action was taken by the City Council. VARIANCE NO. 970: Submitted by Allan L. Campbell, requesting permission to construct and operate a restaurant and cocktail bar on property described as 409 Brookhurst Street, 'west side of Brookhurst Street, south of Broadway). lhe City Planning Commission, pursuant to their Resolution No. 266, Series 1957-58 granted said variance, subject to the following conditions: !. A possible revision of plans so that the back portion of the lot will not be landlocked. 2. The deeding to the City of Anaheim of 53 feet from the center]ine of Brookhurst Street for street widening. 3. The installation of a sidewalk on Brookhurst Avenue as required by the City Engineer. Other improvements are in on the property. Plot plan of the proposed development was placed upon the bulletin board for Council consideration. SWIMMING POOL REGULATIONS: Communication dated May 22, 1958, from Bruce Gelker, President, Magic Circle Motel Association, was submitted and read, regarding the reouired height of fences around motel swimming pools. Mr. Gelker addressed the Council requesting a 30 day extension of time to comply with the Code requirements with reference to installation of fences around swimming poTls, which according to the Anaheim Municipal Code must be complied with by hne 1, 1958. He further requested that the section of the Code be so interpreted as to not :require fencing around motel swimming pools,because of fact that their motels are on a 24 hour basis and their pools are under close surveyance at all times. CounciLman Fry moved that the 30 day extension of time be granted. There was no second to this motion. After further discussion it was moved by Councilman Fry that all motels either furnish satisfactory evidence of 24 hour surveyance or else be required to fence the pools. Councilman $chutte seconded the motion. MOTION CARRIED. DOUBLE TRAFFIC LANE- EAST CENTER STREET: Consideration was again given to the request of Ralph O. Jewitt for removal of the double traffic lanes fronting the Anchor Motel ~: 1538 East Center Street. The City Council ruled to hold to the policy established, regarding a similar situation on Katella Boulevard being, not to exceed four openings in a half mile area and no opening to be closer than 330 feet from the centerline of any inter- section. RECLASSIFICATION NO. 57-58-28: Submitted by Broadway Hales Stores, Inc.~ requestin9 R-3 zoning on property located west of Loara Street, north of the Orange County Flood Control Channel. Plans of the proposed apartment project were submitted. Mr. Burton and others interested in viewing said plans were requested to do so prior to the next meeting (~une 3~ 1958) 7 at which meeting the plans will be considered by the City Council. DIRECTION LIGHTS: A gentleman, representing the owner of the Candy Cane Motel, 1747 South Harbor Boulevard~ addressed the Council requesting permission to allow the mushroom type parkway lights to remain in the parkway fronting their motel, out~ lining and silhouetting %heir driveway. Mr. Hobb of the Saga Motel, 1650 Harbor Boulevard stated, they had a similar situation and requested these lights be allowed to remain, due to their set- back and to facilitate those making left hand turns into their driveways.
