Decision of the City Counc~l on this Variance application was deferred from the meeting of September 1.0, !958 to this date. !~.r., R. W. Mungall, S~,cretary to the City Planning Commission, reported on the meeting w:~th four of the eight property owners on Cerritos Avenue and the subdivider of the property to the north, ~egarding the possibility of obtaining a street giving access to Euclid ~venue. He advised that the subdivider is willing to purchase the north i.'~O feet of their pmoperty~ however, at this time he was not in a position to te]] them how much he could pay. At the conchsion of the meeting, the matter of price and acceptance would necessarily have to be left to the owners of propert'l~ on Cerritos Avenue. It was considered that if a road was developed it would be to the East of the rest home and the establ]shment of' the rest home would in no way effect the possibility of a road. The .~ayor asked if anycne wished to address the Council. A Gentleman, being one of the property owners onCerritos Avenue, addressed the Council, advising that over a year ago this matter came before the City Council and they had been given reasonable assurance that they would be given every con- sideration with reference to access befo~'e that property would be subdivided. It was unknown to them that this tract, map had been approved; furthe:r, none of the property owners are really interested in selling their property, however~ when this tract goes in~ their future possibilities are stopped and the backs of their property will remain undeveloped~ In his opinion, a serious mistake was made when this tract map was approved and none of them had an opportunity to know about it~ ~,!z~ ~{'ungall~ Secretary of the City Planning Commission, advised that the Planning Commission Minutes will show that a couple of years ago, they had these people together and tried to wo'rk out a st-,,~eet on the north side of the property before this tract was accepted, and they were unsuccessful. Howell addressed the Council and referred to the communication of A. C. Turner., Superintendent of City ~Jissions, Orange County Southern Baptist Associatior~, where~n Nit. Turner advised that he, Rev. Howell, is an honored minister in the fellowship of the Southern Baptist Convention and of the Orange County Southern Bapt'{st. Association of Churches, and invited anyone interested to visit the services any Sunday or ~Vednesday evenings. Regarding a boarding school, there was some thought given to this in the original planning to have some six or eight boarding students on the property, but as the plans developed, it became apparent that this would not be practical and this plan was abandoned in favor of an alternate plan to have the students housed in private homes on property completely removed from the proper'ty ~n qu~stion. The Anaheim ~unic[pal Code was consulted and City Attorney, Preston Turner adv~ sed, according to the Code, an academy was allowable only in R-3 zoning, Rev. Howell was of the opinion that both churches and schools are permitted in an R-A zone, when the school provides the state curriculum. He further advised that they had a use and occupancy permit for the school and church dated prior to the action on the Resoiut]on of Intention~ that the use and occupancy permit clears the property for a school and he has in his possession a letter that clears the property fo~ the church.
