F-58-59-1: Submitted by Harry F. Rinker (Tietz Construction Company) requesting C-2 and R-3 zoning on lots within Tentative Tract No. 2222~ The City Council, pursuant to their Resolution of Intent No. 4675, adopted August 5~ 1958, granted the following: C-l, Lot 1 R-3, Lots 2 to 17, inclusive, R-l, Lots 18 to 41, inclusive. At the request of the Applicant, this matter was rescheduled for further considerations due to the revision of Tentative Map, Tract No. 2222, and public hearing ordered this date~ ~Councilman Borden entered the meetinq~ 7:30 ~EV~SED /ENTAYIVE MAP ~ YRACT NO. 2222: Submitted by Harry S. Rinker (Tietz Construction Company), located on the north side of Katella Avenue, south of the Southern California Edison Company easement, and east of Nutwood Street. The Mayor asked if anyone wished to address the Counci. 1. Mr. Harry Rinker addressed the Council and explained the proposed changes ~n revised tentative map, Tract No. 2222 and advised that their reason for requesting C-2 was that the type of development planned comes under the C-2 zoning and if it is zoned C~.I, then a Variance Application would have to be made for each proposed development. Councilman Coons asked about the cul de sac on SalVe Lane to separate the R~i zoning from the R~3 zoning that was shown on the previous tentative map reviewed by the Council. Mr. Rinker advised that actually they were submitting two proposed revised tentative studies for the Council to review. Both revised tentative maps were placed on the bulletin board, one showing Sallie Lane going through to the East and one showing Sallie Lane as a cul de sac in Tract No. 2222. Councilman Coons moved that the revised tentative map, Tract No. 2222, dated September 30, 1958~ which shows the complete separation of the R-1 in Tract No. 2722~ and the proposed R-3 area in Tract No. 2222, by the erection of a block wall along the easterly boundary of the proposed tract, be approved. Councilman Fry seconded the motion. MOTION CARRIED. Upon approval of the revised tentative map, Tract No. 2222, dated September 30, 1958, Mr. Rinker withdrew the tentative map previously approved by the City Council. The Mayor declared the hearing on Reclassification No. F-58-59-1 and Tract No. 2222 closed. Bailey, requesting permission to waive City Code requirements to allow the construction of a 928 square foot house on a 4440 square foot lot at 1217 West Damon Avenue. The City Planning Commission, pursuant to their Resolution No. 51, Series 1958-59, granted said Variance for a dwelling with 928 square feet to be built in accordance with plan presented and with 4 foot sideyards, which were permissible when the original building permit was taken out in 1948. Plans were reviewed by the City Council and no further action by the City Council was taken. yARIANCE NO, %028: Submitted by George Gu and Berthal Gregory, requesting per- mission to construct a motel and restaurant with cocktail bar on property described ss 1401 South Harbor Boulevard (west side of Harbor Boulevard, south of Disne¥1and). The City Planning Commission, pursuant to their Resolution No. 52, Series 1958-59, granted said variance, subject to~ 1. The dedication of 60 feet from the center line of Harbor Blvd. to the City of Anaheim for street widening. 2. The preparation of improvement plans and the installation of all improvements as required by the City Engineer. 3. Dedication and improvement plans to he completed within 90 days. 4. VARIANCE NO. 1029: Submitted by Walter E. Leep, requesting permission to waive City Code requirements of minimum house sizes to allow the construction of a 916 square foot house on property described as 814 Sabina Street. The City Planning Commission, pursuant to their Resolution No. 55, Series 1955-59, granted said variance, subject to the erection of the building ~n accordance with the plans presented. Mr. Donald Spengler, Agent, advised that they could meet the required rear yard set back, making it a 15 foot set back instead of 10 feet as shown on the plans. The City Council was of the opinion that definite street dedication and requirements should be established, and withheld action on said variance to their next meeting, October 7, 1958. REVIEW NO. 19: Submitted by Kenger Properties, Inc., requesting permission to establish a deluxe 216-space trailer park, with recreation building, swimming pool, play area and required utility building, on property described as 304 West Katella Avenue (on the west side of Haster Street~ south of Katella Avenue). The City Planning Commission, pursuant to their Resolution No. 57, Series 1958-59, granted said special use permit, subject to: 1. Dedication to the City of Anaheim of 60 feet from the centerline of Katella Avenue at the main entrance to the park. 2. A map of the proposed tract was placed on the bulletin board. The City Council asked to see plot and house plans and Mr. R. Mungall, Secretary, City Planning Commission, advised that no plans were submitted to the City Planning Commission. The Mayor asked if the subdivider or his representative were present, there being no response, the Council withheld action on said revised tentative map, Tract No. 2264, to their next meeting (October 7, 1958) and requested the subdivider be notified to submit plot and house plans. PETITION - ABANDONMENT OF ALLEY ~!IIHIN TRACT NO, ~428: Communication dated September 18, 1958, from Marshall O. Victor, transmitting a petition signed by i2 property owners within Tract No. 1428, requesting abandonment of the alley shown on said recorded tract map, was submitted (copies having been furnished each Councilman). Communication dated September 30, 1958, from Howard W. and Flora E. Stanton, and Petition signed by three property owners abutting the alley within Tract No. 1428, protesting the abandonment of said alley, were submitted and read. Mr. Holyoke, City Engineer, submitted a map to the Council, showing ~e alley and tract ~n question and ~ndicated thereon the property owned by those si?ning the petition requesting abandonment of said alley. It was noted that one property owner had signed both petitions, where- upon Wr. Willard M. Legg, owner of Lot 1, addressed the Council and requested his name be withdrawn from the request for abandonment as he was in favor of keeping the alley open. Mr., Kufahl, owner of Lot 3, addressed the Council, protesting the abandonment of the alley, and advised of their need for the alley as some of the people have openings in their rear fences and back their cars in and out of their garages. Mr. Turner, City Attorney, advised the Council that before abandoning an alley, it must be proved that the alley is no longer necessary for public use; that from the reports received at this meeting, it would appear that this alley [.s necessary for use of the people living in the area. Councilman Coons moved that the petition requesting the abandonment of the alley in Tract No. 1428 be denied. Councilman Borden seconded the motion. MOTION CARRIED. REOUEST FOR TEMPORARY SIDEWALK ~IAIVER ~ JACK L. NECF: Communication dated ~eptember 23, 1958, from Jack f.. Nece, requesting temporary waiver of sidewalks on the easterly side of Stinson Avenue, directly south of Lincoln ~venue, being the E1 Rancho Motel property, 2650 Lincoln Avenue, was submitted (copies furnished each Councilman). George E. Yurdoch, advised that the temporary waiver of sidewalks until such time as required by the City was presentino a problem, and discussion was held relative to requiring the posting of a b~nd or some method to insure the installation of improvements when required, in addition to recording with the County Recorder the resolution granting the temporary waiver. .~ONTINUATION OF PUBLIC HEARING ~ VARIANCE NO. 1026: Ihose persons representinq the Applicant and the group in opposition, ~eturned t~ the Council Chambers and public hearing on Variance No. 1026 continued, (see page 2940 of minutes, Sept. 30, 1958). The Mayor asked if anyone wished to address the Council. Mr. Coleman, Applicant, addressed the Council and advised that they still had not come to a definite conclusion. He reiterated the circumstances necessitating the filing of a variance and advised, in his opinion, the possible remodeling of the garage would not be in keeping with good architecture, nor would it be what the people in opposition wantedt that Hintz Construction Company is willing to erect a six foot block wall along the north property line of the tract (approximately 660 feet) to make a division between the 1450 square foot homes and the 1260 square foot average homes to the south, as this is the basic opposition of some of the people; that he feels Hintz Construction Company should do nothing about the homes facing South Street as the people across the street have no street improvements, although they do have large homes. Also, to further improve the appearance of the rear of the homes on the north tier of the tract, he suggested that a fascia board, properly painted, be placed along the ends of the rafters, Mayor Pearson asked if the same type of fascia board could be placed on the front of the homes facing South Street, and Mr. Coleman replied %hat on the front of the houses, the ends of the rafters are rounded. Yr. ~ite, 2214 Virginia Avenue, addressed the Council and advised that in his opinion, the building of the wall would not improve the homes in the tract. Personally, he would be in favor of the wall because his home would be one of the few backing up to the wall; that it was his understanding that the approximate cost of buildin9 the wall would be $3000.00, which in his opinion, would not up- grade the homes very much, as it would only affect about 6 or 7 homes in the tract. Also, he understood, that due to being unable to get a final inspection, that approximately $6,000. has been lost in commitments and interest on the loan by the subdivider, and that if they did not get this variance, they would still ao ahead and fix up the garages for approximately $100.00 per house, therefor, h~ concluded, if this were true, they wouldn t have had to ask for a variance, they 2945 Wesley Methodist Church~ 630 N Los Anoeles St. Anaheim~ Calif r Sept....30~ 1958 7:00 P.M. could have gone ahead and remodeled the garages for the same amount of money which they claim to have lost by the delay, however, he didn't believe that making a one car garage would improve the appearance of the homes, because as soon as the homes are purchased, the owners will probably remove the wall and make a two-car garage as was originally built. Ihat he believed a fair solution would be to put shake roofs on the approximate 24 homes not yet sold, thereby up-grading the tract. Ihat if this variance is granted with no restrictions, it would cost the people in the area about $2000. per house; that if the houses were remodeled to Code, their homes would be degraded approximately $1000; that if the houses had originally been built to Code, it would have cost the sub- divider approximately $700.00 per house more to build. In answer to Councilman Borden~s inquiry as to whether these homes were being sold on VA or FHA terms, ~r. Coleman advised that these homes were being sold under conventional bank terms. Mr. John Kirsch, 14182 E. South Street, addressed the Council, and advised that before any subdivider started work on South Street, they considered with the City Council what would be the best type of homes to be built by the subdividers in the area, and came to an agreement of 7200 square foot lots; that they feel a solution would be to put shake roofs on the homes along South Street, not to make the garage into another room. In answer to Mayor Pearson's inquiry as to what the cost would be to put on shake roofs, Mr. Coleman replied about $600.00 per house, however, in his opinion, it wouldn~t be good architecturally to have 8 or g homes on South Street with shake roofs; that there are 44 homes in the tract. Councilman Schutte asked if the houses that have not been sold, would not sell for a better price if shake roofs were added. Mr. Coleman replied he didn't believe so, that from the standpoint of sales appeal, it would probably detract from the sales of homes without shake roofs. He further advised that they have 28 deposits on these homes at this time, and how many actual sales this turns into depends on how long they will have to wait for the final inspection. The following persons addressed the Council advising that they had purchased homes within the tract; that they were completely satisfied with their new homes and were anxious to move in and urged the Council to give full con- sideration to their wishes: Mr. Vogel, Mrs. Ramsey, Frank Downs, Mrs. Parish and Mrs. ~urray. Those addressed the Council in opposition were Mrs. Lee Karaki, 506 Dustin Place; Mr. Malts, 2134 Virginia Avenue; ~.r. Goldfine; ~r. and ~rs. ~.4artin, 2224 Virginia Avenue; Mrs. Paschal, 2138 Virginia Avenue; and Max ~.6organ, 2230 Virginia Avenue. ~r. Dick Kempling, resident on the south side of South Street, stated that he understood most of the lots along the south side of the tract have been sold. He was advised by the Applicant that all but one home has been sold along South Street and five homes have been sold along the north side of the tract. Councilman Coons suggested putting shake roofs on the homes on the perimeter of the tract and let those homes in the interior of the tract remain as they are. Mr. White advised that they would be agreeable with this suggestion. Mr. Sylvan Y. Allen, Attorney representing the Applicants, addressed the Council, stating that this was strictly a hardship case; that the purpose of a variance is to help hardship cases; that they had built the tract and made their loans and commitments in good faith, and urged the granting of the variance. Councilman Coons stated that in view of the facts presented regarding Variance --~ 1026 and after giving full consideration, it appeared that a light shake roof could be put on the 20 houses remaining to be sold for approximately $400.00 per house, however, it would be his recommendation that the houses on the perimeter be improved with light shake roofs except on the west boundary adjacent to Tract No. 2300. RESOLUTION NO, 4779: Councilman Coons offered Resolution No. 4779 and moved for its passage and adoption, granting Variance No. 1026 upon the condition that a light shake roof be applied on the buildings on Lot No. 1 and Lot Nos 8 through 17, inclusive, Lot No. 30, Lot No. 31, and Lot Nos. 38 through 44, inclusive. Garner and ~ildred Moss for refund of the $25.00 license fee required for the operation of the Fantasy Motel, 173~ Harbor Boulevard, as their business transaction has been cancelled and they are not in possession of the motel property, was submitted at the meeting of September 23, 1958 and held over for further investigation and report. Communication from MayBelle E. Spencer, City Treasurer, was submitted and read, recommending the request for refund be granted as the Fantasy Motel is under license to the original owner. Councilman Fry moved that said request for refund of license fee in the amount of $25.00 be granted. Councilman Coons seconded the mo%ion. MOTION CARRIED. REQUESTS FOR IMPROFE~,~ENTS: (a) Request dated September 11, 1958, from George O. Cameron, 7631 Ball Road, and other residents in the area, for ~mprovement of Ball Rnad~ west of H~qhway 39. George E. Holyoke, City Engineer, reported that extensive improvement plans for Ball Road have been prepared as part of the gas tax project, however, have been delayed by the State, and at this time, he did not know when the improvement will be commenced. ~r. ~,~urdoch, City Administrative Officer, suggested that perhaps the Public ~orks Department and Engineering Department could work out some temporary relief for these residents, in the event the improvement project is delayed too long to be completed before the rainy season. (b) Communication dated September 23, 1958, from Gordon Walker, submitting a~petition calling attention to certain hazardous conditions on ~ranoe Avenue between Orangeview Junior Hiah School and W~stern Avenue; requesting a foot bridge across Carbon Canyon Wash on Western Avenue; and to provide stop signs on Knott Avenue at Orange Avenue. The City Administrative Officer reported that the Public Works Fepartment and the Engineering Department are investigating said conditions, and suggested said matter be held over for further study. 2947 Wesley Methodist Church, 630 N Los Anqeles St. ~naheim~ Calif - ~eP[ 30~. 1958 7:00 P.~. CORRESPONDENCE: (a) Communication dated September 20, 1958 from Mys, Baccus, regarding the requirement of foster parents to obtain a City business license for full time care of children was submitted. (copies furnished each Councilman). A Lady from the Orange County Welfare Department addressed the Council, urging that the Council consider a change in the license ordinance to require a City license for foster parents only when there are six or more foster children in one home; that all foster parents must be accepted and duly licensed by the County of Orange ~!elfare Department before children will be placed in their home. Discussion was held by the City Council, and the City Attorney was authorized to prepare an amendment to the City business license ordinance, re- quiring a City license for duly licensed foster parents, licensed by the County of Orange Welfare Department, who have six or more foster children in their home. (b) Public Utilities Commis$io~- Application of The Western Union Telegraph Company for an order authorizino it to increase and revise certain intrastate rates and regulations applicable to telegraph service and leased facility service within the State of California. ~RIVE~AY OPENINGS: Mr. Dave Collins, representing Vernon and L. R. Fredericks, addressed the Council, requesting two 18 foot driveway openings on property at 1227 West Lincoln Avenue. On the recommendations of the City Engineer, Councilman Fry moved that the request for two 18 foot net openings for driveways on property at 1227 West Lincoln Avenue, be granted, with the condition that the existing driveways be closed. CITY ADMINISTRATIVE OFFICER: Keith A. Murdoch. CITY ATTORNEY: Preston Turner. PUBLIC HEARING - RECLASSIFICATION NOr F-58-59-7: Submitted by Walter H. and Maude O. Brewster, et al, requesting R-3 zoning on property described as 11662, 11722 and 11702 Loara Street (east side of Loara Street, south of Orangewood Avenue). The City Planning Commission, pursuant to their Resolution No. 47, Series 1958-59, recommended said reclassification, subject to the following conditions: 1. Deeding to the City of Anaheim 45 feet from the center line of Loara Street for widening. 2. Installation of improvements on Loara Street as required by the City Engineer. 3. The filing of R-$ Deed Restrictions limiting any multiple-family dwellings to only one story. Staff report regarding this Application was read. The Mayor asked if anyone wished to address the Council. Councilman Borden advised, on checking this area, he found it to be surrounded by better than average single family dwellings with no shopping center nearby to justify high density occupancy. The Mayor asked if anyone wished to address the Council. Mr. C. J. Brindley, owner of property across the street and to the north of subject property, addressed the Council, favoring the rezoning. In answer to Councilman Borden's question if this zonin9 would conform to the general plan, Mr. R. W. Mungall advised that these were exceptional lots, being 300 feet in depth with a home on the front of each lot. Mr. Brewster addressed the Council and questioned the necessity of a 90 foot street. Mr. George Holyoke, City Engineer, reported that-this requirement was an error, that Loara Street was to be a 64 foot right-of-way, which would only require 32 feet instead of 45 feet dedication. Further discussion was held regarding the placement of buildings on the property, at the conclusion of which, Councilman Schutte moved to continue said public hearing to October 14, 1958, 7:00 P.M. for further investigation. Councilman Coons seconded the motion. MOTION CARRIED.
