Brewster, et al, requesting R-3 zoning on property described as 11662, 11722 and 11702 Loara Street (east side of Loara Street, south of Orangewood Avenue). The City Planning Commission, pursuant to their Resolution No. 47, Series 1958-59, recommended said reclassification, subject to the following conditions: 1. Deeding to the City of Anaheim 45 feet from the center line of Loara Street for widening. 2. Installation of improvements on Loara Street as required by the City Engineer. 3. The filing of R-3 Deed Restrictions limiting any multiple-family dwellings to only one story. Staff report regardin9 this Application was read. The Mayor asked if anyone wished to address the Council. Councilman Borden advised, on checking this area, he found it to be surrounded by better than average single family dwellings with no shopping center nearby to justify high density occupancy. The Mayor asked if anyone wished to address the Council. Mr. C. J. Brindley, owner of property across the street and to the north of subject property, addressed the Council, favoring the rezoning. In answer to Councilman Borden's question if this zoning would conform to the general plan, Mr. R. W. Mungall advised that these were exceptional lots, being 300 feet in depth with a home on the front of each lot. Mr. Brewster addressed the Council and questioned the necessity of a 90 foot street. Mr. George Holyoke, City Engineer, reported that-this requirement was an error, that Loara S?reet was to be a 64 foot right-of-way, which would only require 32 feet instead of 45 feet dedication. Further discussion was held regarding the placement of buildings on the property, at the conclusion of which~ Councilman Schutte moved to continue said public hearing to October 14, 1958, 7:00 P.M. for further investigation. F-58-59-8: Submitted by Angelo Scaglione, requesting R-3 zoning on property located at 9102 Lincoln Avenue (south side of Lincoln Avenue, east of Magnolia Avenue). The City Planning Commission, pursuant to their Resolution No. 46, Series 1958-59, recommended said reclassification, subject to the following condi ti ons: 1o The filing of R-3, Multiple Family Residential Deed Restrictions. 2. The removal of the C-l, Neighborhood Commercial, Deed Restrictions on the subject property. 3. The installation of a 30 foot improved roadway along the east side of the property for access and egress. The Mayor asked if anyone wished to address the Council. Mr. Scaplione, addressed the Council, advisin9 that the depth of the C-1 property was too great and better utilization of the property could be made if the rear portion was zoned R-3; that access to the proposed R-3 area would be by private 30-foot easement, and the area would be developed as one parcel. The City Council was of the opinion that before action was taken on this application, there should be presented a development plan of the property. In answer to Councilman Coons'question, R. ~l. Mungall reported that the City Planning Commission had made an overall study of this area, however, he would have to check the study before reporting their findings. Mr. Keith A. Murdoch, City Administrative Officer, suggested that Mr. Scaglione prepare a sketch of the development showing access to the rear portion of the property; that the proposed zoning would be consistent to the general plan and would be an up-grading of the property, however, he felt that some thought should be given to ingress and egress and the future street pattern in the area. At the conclusion of the discussion, Councilman Coons moved to continue the public hearing two weeks (October 21, 1958) to allow the applicant time to prepare a plot plan showing the building arrangement and also a sketch of the improvement. Shoemaker and Oscar Wo Louderback, requesting C-3 zoning on property located on the north side of Lincoln Avenue, between Cathryn Drive and Brookhurst Street. /he City Planning Commission, pursuant to their Resolution No. 50, Series 1958-59, recommended said reclassification, subject to the following conditions: 1. The dedication of 60 feet from the centerline of Brookhurst Street to the City of Anaheim for future street widening. 2o Improvements on Lincoln Avenue as required by the City Engineer. 3. The payment of $2.00 a front foot to the City of Anaheim for the installation of street lights. 4. Above conditions to be completed within 90 days or upon annexation to the City. The Mayor asked if anyone wished to address the Council. Plot plan of the area was presented and reviewed by the City Council. The ~dministrative Officer advised that a request for annexation of this territory to the City of Anaheim has been received, however, the annexation has not yet been commenced; that no action can be taken on the Resolution of Intent until the annexation is commenced, and no action can be taken on the Ordinance rezoning the prOperty until the annexation is completed. 2956 ~,!esley [~ethodist Church~ 630 N Los Anqeles St, Anaheim~ Calif - Oct 7, 1958 7:00 R. Mungall reported that the area was presently zoned County C-l, which is compared to our C~2 zoning~ Mr. Shoemaker, Applicant, addressed the Council, advising that it was his desire to be annexed to the City of Anaheim. The City Council indicated their approval of this application as it was a development in keeping with what was already in the area~ Councilman Fry moved that said hearing be continued four weeks (?'$ovember 4, 1958) to allow necessary time for the commencement of annexation proceedings~ Councilman Coons seconded the motion. PUBLIC H~ARING - RECLASSIFICATION NO, ~-58-59-13: Submitted by Wagner Realty Company, requesting C~2 zoning to allow the operation of a cocktail bar in conjunction with a restaurant on property located at 2008 Anaheim-Olive Road (south side of Anaheim- Olive Road, east of and adjacent to Alex~'s Market). The C~ty Planning Commission, pursuant to their Resolution No. 49, Series 1958=~59, recommended said reclassification, subject to the conformity in general with the plans presented. The Mayor asked if anyone wished to address the Council. Mr. Stephen Gallagher, Attorney for the Applicant, addressed the Council and presented a revised plan of the proposed development. Reference was made to the many restaurants within the City of Anaheim that operate in conjunction with the restaurant, a cocktail bar. Mr. ?.;illiam Connolly, resident in the area, addressed the Council and on request for more information was invited to the Council table, and reviewed the plans and artist?s rendering as presented. In answer to a question by Mr. Connolly regarding signs, he was assured by the developer that there would be no blinking electric signs. Discussion was held regarding the revised plans which indicated reduction in size of the bar facilities. Holyoke, City Engineer, reported that there would be no dedication required on Santa Aha Street, however, the improvements should be required. Keith A. Murdoch, City Administrative Officer, reported that the Agent for the owner indicated at the last meeting that he would comply with the required rear yard setback. No further action was taken by the City Council. REVISED TENTATIVE MAP - TRACT NO. 2264~ AND REVISED TENTATIVE MAP, TRAC/ NO. 2515: TRACT NO. 2264: Subdivider, Moore Built Homes. Tract located on the south side of Ball Road, 660 feet east of Western Avenue and contains 77 R-1 lots. The City Planning Commission approved said Revised Tentative Map subject to the following conditions: 1. That Lots 2 and 3 shall be the only lots to have vehicular access from Ball Road. 2. That pertinent plot and buildin9 plans be submitted to the City Council for review. 3. Require that should this subdivision be developed as more than one subdivision, each successive subdivision thereof shall be submitted in tentative form for approval. TRACT NO, 2515: Subdivider, ~oore Built Homes. Tract located on the east side of Western Avenue, south of Ball Road, and contains 40 R-1 lots. The City Planning Commission approved Revised Tentative Map of Tract No. 2515, subject to the following conditions: 1. That pertinent plot and building plans be submitted to the City Colncil for review. 2. That should this subdivision be developed as more than one subdivision, each successive subdivision thereof shall be submitted in tentative form for approval. Action on said tracts was withheld by the City Council at their meeting of September 30, 1958, for submission of more detailed plot and house plans. The tract maps were placed upon the bulletin board and reviewed by the City Council. Mr. Steve Pechac, representing Moore Built Homes, presented plot plan of the two tracts and advised that the houses would be 1282 square feet, 3-bedroom, with one full bath~ one three-quarter bath~ and one-half bath. Building plans were submitted, ~ogether with a rendering of one of their most popular models. It was noted that the map indicated 40 foot dedication rather than 45 foot dedication on Western Avenue, and Mr. Murdoch advised that since both tracts are tied in together and if the additional was required on Western Avenue~ 2t would create a jog in the other streets because the street pattern would not match the existing streets, and under these circumstances, recommended the approval of the maps, with the street pattern as shown, even thouoh they do not meet City standards. TRACT NO. 1812 - REMOVAL OF DEED RESTRICTIONS: Communication from Dalton & Laramore Construction Company, Inc., by Syd P. Bartlett, Jr., dated October 2, 1958, requesting removal of existino one-story deed restrictions on Lots 67 through 77, inclusive (Ball Road) t~ allow the construction of two-story apartments, was submitted and read. Mr. Bartlett addressed the Council advising that in contactino the people in the tract and in talking with the City Council, it was apparent that the only objections to the two-story units were on those lots facin9 single story residences on 3uno Street; that they have now arranged for a definite buffer between the one-story and two-story structures, and all of the R-1 houses have been sold~ He further advised that there were no objections to the sinsle story multiples next to the R-1. Mr. Murdoch reported that the situation has changed to the extent that the property immediately to the west of this property owned by Mira Flores has since been zoned for multiple family, on which there were no height limitations placed on the Ball Road frontage. Plans of the proposed buildinos, showino~ two-bedroom units of approxi- mately 700 square feet were presented a~d reviewed by the City Council. Discussion was held and Councilman Coons requested that the footage of the units be brought up to a minimum of 850 square feet per unit. To this, Mr. Bartlett agreed. Councilman Coons moved to grant the Applicant's request for two-story construction on the Ball Road frontage, being Lots 67 to 77, inclusive, of Tract ~o. 1812, provided that the Applicant revise his submitted drawings for a m]nimum of 850 square feet per unit for the two-bedroom apartments, and further consented to the change in the deed restrictions and authorized the Mayor to execute said consent. Councilman Fry seconded the motion. MOTION CARRIED. ENCROACH~ENT PERMIT - INTERSTATE ELECTRONICS CORPORATION: Communication dated October 7, 1958, from Paul H. Reedy, President, Interstate Electronic Corporation, was submitted and read, requesting permission to install a one inch steel pipe under Vermont Avenue between the Interstate Electronics Corporation building at '707 E. Vermont Avenue, on the north side of the street, and the Interstate Engineering Corporation building at 600 E. Vermont Avenue on the south side of the street, for the protection of a cable transmittino television signals in connection with an experiment of television intercommdnication system. The Administrative Officer and City Engineer reported that the request, having just been received, was only roughly checked, however, they could see no particular objections in the 9ranting of the request. It was moved by Councilman Coons that the Applicant's request be granted, providing he fulfills all necessary requirements of the Engineering Fepartment and the Public Works Department. Councilman Schutte seconded the motion MOTION CARRIED'. · iRACT NO. 2317: ~r. Coleman addressed the Council advising of the difficulty in securin9 necessary bond guaranteeing to the City that the perimeter houses Tract No. 2317 will be provided with shake roofs, and requested release and final inspection of the interior houses that have been sold, in order to close escrows and obtain necessary funds to make the required improvements in the 2960 Wesley Methodist Church~ 630 N Los Anaeles St. Anaheim~ Calif - Oct 7, 1958 7:00 P.M. perimeter houses of the tract. Discussion was held and the Administrative Officer advised that the concern of the Council was for some assurance that the work on the roofs would be completed; that the Council could still withhold final inspection on the perimeter homes and have some guarantee that the job will be done. Mr. Coleman asked release on only those interior homes that have been sold and offered to furnish the Council a list of those sold. At the conclusion of the discussion, it was moved by Councilman Schutte~ seconded by Councilman Fry, that the request be granted on those interior houses which have been sold in Tract No. 2317, and that Mr. Coleman furnish the City Clerk a list of those houses sold as of this date, and that the Building Inspector be authorized to make final inspect[on on those interior houses which have been sold. Holbrook~ Tart & O:Neill (LaMont-Kelsey property regarding abandonment). PURCHASE OF PROPERTY (LA MONT-KELSEY): The Administrative Officer reported that communication from Holbrook, Tart & O~Neill regarding the abandonment of the LaMont-Kelsey property, was received prior to successful negotiations with the owners of the properties involved; that the LaMonts have agreed to accept $74,000.00 for their properties as an amended judgment if they can receive payment within the next ten days and if they are allowed 30 days to remove the house and 60 days to remove the shop. Regarding the Kelsey property, they have agreed to accept $34,500,00. RESOLUTION NO, 4800: Councilman Schutte offered Resolution No. 4800 and moved for its passage and adoption, author[zing the purchase of the properties at the figures given. Discussion was held and reference was made to a previous minute action regarding the installation of parkin9 meters on all of the perimeter lots and Councilman Pearson offered an amendment to the Resolution as a justification for expenditure of these funds, to the effect that these lots be purchased with the proviso that at least half of the spaces on the perimeter lots be metered to the extent of and up to, all day parkin9, As action had already been taken by the City Council to install parking meters on the perimeter lots and with the understandin9 and assurance of the City Council that this was what they wanted accomplished, Councilman Pearson withdrew his amendment to said Resolution. *** RESOLUTION NO, 4800: A RESOLUTION OF THE CITY COUNCIL OF TH~ CITY OF ANAHHIM AUTHORIZING THE CITY ATTORNEY TO ENTER INTO A SETTLEMENT AGREEMENT AND STIPULATION TO BE ENTERED IN THE SUIT IN EMIkrENT DOMAIN ENTITLED "CITY OF ANAHEIM VERSUS CLARA M. CANCELLATION OF CITY TAXES: On motion by Councilman Coons, seconded by Councilman $chutte, cancellation of City taxes was authorized on property purchased by the Magnolia School District for public purposes~ as recorded in Book 4417, page 535, Official Records of Orange County, on September 17, 1958. ~v~OTION CARRIED. TENTATIVE PLANS - FIRE STATION NO. 4: Administrative Officer, Keith A. Murdoch, presented tentative plans for Fire Station No. 4, to be located on Orange Avenue and provide fire protection in an area relative unprotected at the present time, and explained that the station is designed residential in character so that it will fit in with the development presently existing on the north side of the street, and so that it will fit in with the ultimate residential development of the adjacent properties. ORDINANCE NO. 1287: Discussion was held regarding the adoption of Ordinance No. 1287, creating the office of City Manager, and Mr. Murdoch, City Administrative Office~ reported a change to Section 8, Subsection B, pertaining to the powers and duties, by adding thereto a phrase at the end of the paragraph, reading, "and received approval for such appointment or removal". Said Subsection B of Section 8 was then read in full, includin9 the additional wording. Mr. George Chula, Attorney representing Mr. William Harris, 10002 ~,!idwood Lane, Anaheim, California, addressed the Council advising that this was something to be considered carefully and asked how this matter was brought to the attention of the City Council. He was informed that this Ordinance was written on City Council initiative and that the Government Code contains provisions authorizing the City Council to establish the office of City,~ana~er~ and to delegate the authorities such as will be found in the intended Ordinance which follows, very closely, the State law. Vr. rhula advised that his client was of the opinion that this Ordinance would give too much authority and questioned the necessity of having an executive session prior to the removal of department heads. Mr. Turner answered that this was a State law provision which provides that personnel problems be taken care of in executive session and is a protection to the employee from undesired publicity that might follow a public meeting. l~r. Harris asked if the Ordinance declared the term of office and questioned the method to be used regarding his dismissal, and also asked about bringing this matter before the people of Anaheim. Mr. Mike Hulett, 701 North West Street, addressed the Council, giving full support and approval to the adoption of the Ordinance, and advising, that in his opinion, Anaheim has the man to fit the position. ~r.
