FLAG SALUTE' Councilman Dutton led the assembly in the Pledge of Allegiance to the flag. SALARY PROPOSAL: The City Manager presented the recommended salary proposal and amendments to personnel rules, advising that his recommendations were the result of a series of negotiations with the various associations and unions representing City employees. Mr. Murdoch reported that agreement had been reached with the Anaheim Municipal Employees Association (AMEA) and the Anaheim Firemen's Association, and advised that for the employees represented by those two organizations, and those unrepresented employees, the salaries would be increased 7~ percent with the exception of certain positions, as set out in the recommended resolution for a slightly higher rate, effective October 10, 1969. Further, that these exceptions were in line with changes in positions, additional responsibilities, more substantial jobs, and with the policy of the City Council in making every attempt to pay the prevailing wage scale in the appropriate labor market for various classifications. Regarding the International Brotherhood of Electrical Workers (IBEW), Mr. Murdoeh reported that no agreement had been reached; that normally in that case, negotiations might continue; however, in this instance, the City staff recommendations were being presented at this time without agreement or memorandum of understanding. Regarding the Anaheim Police Association, Mr. Murdoch further advised that the Association had rejected the recommended increases in wages, salaries and other benefits even though it was the final proposal by the City staff. It was his understanding that their major concern was with only one area~ In conclusion, Mr. Murdoch recommended the adoption of three resolutiops. Ope for the employees represented by the Anaheim Municipal Employees Association, the Anahe:i.m Firemen's Association. and the unrepresented employees, and that two resolutions be adopted cont'n~ning the recommendations of the staff for employees represented by both the Anaheim Police Association and the IBEW, basically a 7~ percent increase for most positions, with 69-648 ~Anaheim, California - COUNCIL MINUTES - October 2~9:30 A.M. the exceptions similar to those described in the recommendations for the other City employees, effective October 10, 1969, contingent upon ratification of the terms of the resolutions by the two organizations no later than midnight this date. If the ratification did not occur, then rates of wages and salaries would not be changed for those represented by the two organizations, pending further action at a later date. In response to Councilman Schutte's question, City Attorney Joseph Geisler advised that time was urgent at this point; that negotiations had been extended two extra weeks into the current pay period, and in order to make the changes retroactive to October lOth, action must be taken within the current pay period which ends at midnight, this date. Any increase in salaries beyond the current pay period in which they occur could place the individual members of the City Council personally financially liable for the difference. (Employees represented by the AMEA and Firemen's Association and unrepresented employees.) Roll Call Vote: AYES: COUNCILMEN: Dutton, Schutte and Clark NOES. COUNCILMEN: None ABSENT: COUNCILMEN- Krein and Pebley The Mayor declared Resolution No. 69R-600 duly passed and adopted. Mayor Clark asked if a representative of the Anaheim Police Association wished to address the City Council. James A. Bush, President, Anaheim Police Association, read letter from the Association dated October 23, 1969, (copies furnished each Councilman), accepting the City's proposal with the exception of the classification of Police Sergeant which they requested be increased an additional 2½ percent. Points set forth in said letter as the basis for their request included the 10 percent raise proposed for Fire Captain which placed that classification 2~ percent above Police Sergeant, whereas in the past, they had received the same rate of pay; that the Orange County Sheriff Sergeant would be paid 2½ percent more than the Anaheim Sergeant, even if the additional 2½ percent were approved; that the proposed increase for Sergeants would place them in tenth position in the sixteen city "quartile" used as a guideline. Mayor Clark asked if the Association was taking into consideration the other benefits in the proposal and the existing fringe benefits for Anaheim City employees. Mr. Bush replied that in his opinion, the County Officers had a superior retirement system, received shift differential pay, and had at least comparable benefits in all other areas. Discussion was held by the City Council relative to the increase proposed for Police Lieutenants, it being noted that said position was in the exempt classi- fication, and received no overtime pay for overtime worked nor were holidays automatically paid~. ' Personnel Director Roy Heissner concurred that there were many variations in fringe benefits between Orange County and the City of Anaheim, however, he pointed out that in the study of the sixteen city "quartile" used as a guide-. line, the City staff could not find one which offered shift differential pay. Further discussion was held and Mr. Murdoch stated the staff felt that the 7~ percent increase proposed for sergeants was appropriate; that the spread between sergeant and lieutenant pay was not excessive and was appro- priate, and he firmly recommended that the sergeants~' pay increase be adopted as proposed. An additional point noted by the City Manager was the availability of a Post Advanced Certificate for sergeants which, if received, automatically allowed an additional 2½ percent increase in pay, Mro Bush reported that twelve of the thirty-four sergeants had received their Post Advanced Certificates, however, to qualify took a great deal of time and study. Mr. Murdoch reported that the pay scales for Police Sergeant and Fire Captain reflect a difference in the duties and responsibilities. Relative to the point made that sergesnts would be tenth in the sixteen city "quartile", he stated that they would gctually be equal with the salary paid by the City of Los Angeles, or No. 8 position, as compared to lieutenants which would be equal to the No. 3 position. Mr. Bush advised that since other cities have had their raise for some time, it was felt by the Association that the No. 10 spot was more nearly correct. Mayo~ Clark asked if anyone else wished to address the Council regarding t~a Police Department's position. There was no response. It was the consensus of the City Council that the proposal presented and recommended by the City Manager was a fair plan. Mr~ Dallas Lore= Business Manager, representing employees in the IBEW, addressed the City Council, advising that there were many areas where the members of the Union and the City staff did not agree; that many job duties and titles were being reassigned; one area of difference is the creation of a "Trouble Man" working alone during the day and night performing duties currently done by the Water Division. Another area is permitting Area Operators to do switching in the field. Standby pay is to be eliminate~ causing a loss of approximately $78.00 per week to a lineman and $90.00 per week to a line crew ~oreman. Mr~ Lore stated although their differences were not in the area of salaries, they have agreed to take the proposal to the membership without a recommendation. Further, they have been placed in an awkward position in that as of midnight, there is no memorandum of understanding, no strike clause, and everything is cancelled. He, thereupon, requested, should an agreement not be reached by the membership, some way be found to extend the retroactiva pay~ 69-650 Anaheim. z_California - COUNCIL MINUTES - October 231.~_~969 9:30 AoM. Mr. Murdoch reported that the creation of the position of "Trouble Man" is felt to be essential for the efficient and economical operation of the department. He felt the danger to a one-man operation was minimum. In eliminating standby pay, it is management's opinion that the norr~al compensation and part of the job includes the obligation to be available on reasonable call for emergency situations. They are expected to respond and are paid a premium rate when called. Under the former method of pay- ment, it was felt that the City was not receiving a dollar return and the procedure should be changed to obtain more efficiency and affectiveness for dollars spent in this area. Mr. Murdoch reported that the area of difference was the change in operations which normally is a management prerogative. He stated the dead-line was not arbitrarily established; it is established by law and known all along. Recognizing this, the Council adjourned to this date to extend the time as much as possible. The alternative would be for the Council to take no action on the recommenda- tions affecting those classifications so represented. However, his recom- mendation would allow ratification by vote of the membership tonight and provide salary increases and other benefits to be retroactive to October 10, 1969. RESOLUTION NO. 69R-607. BLUE ~ROSS--~DICAL AND HOSPITALIZATION INSURANCK: On the recommenda-. tion of the City Manager and Personnel Director, premium rate increase of approximately 9 percent was absorbed by the City of Anaheim and amendments to the contract to include intensive care in hospital and convalescent homes, extending maximum benefits from ~10,000.00 to $20,000.00 per member--three separate $50.00 ded~ctive per family, or $150.00 maximum deductive per family-- effective during the month of October, 1969, was authorized on motion by Councilman Schutte, seconded by Councilman Dutton.
