1969/12/0969-740 C~ty Hall~ Anaheim, California - COUNCIL MINUTES - December 2, 1969, 1:30 P.M, CROSSWALK - SYCAMORE: AT CLEMENTINE STREET: The City Engineer reported on th~ installation of a crosswalk on the north side of Pearson Park on Sycamore Street, at Clementine Street. He pointed out that investigation revealed that required war- rants as established by Resolution No. 6773 were not met and thereupon recommended the crosswalk not be installed. Councilman Dutton requested Mrs. Ernest Ganahl be notified of the City Engineer's recommendation and the reasons therefor. SIGNAL - BALL ROAD - BETWEEN BROOKHURST AND GILBERT STREETS: Councilman Peb- ley called attention to a dangerous condition created by the crosswalk on Ball Road, between Brookhurst and Gilbert Street, in front of the Brookhurst Theatre~ and requested the installation of a traffic signal at this location be investigated by the Traffic Engineer. MINUTES: Minutes of the Anaheim City Council meeting held November 18, 1969, were approved on motion by Councilman Dutton, seconded by Councilman Krein. MOTION CARRIED. WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Dutton moved to waive the reading in full of all ordinances and resolutions, and that con- sent to the waiver of reading is hereby given by all Councilmen, unless after reading of the title, specific request is made by a Councilman for the reading of such ordinance or resolution. Councilman Krein seconded the motion. MOTION UNANIMOUSLY CARRIED. 69-741 City Hall~ Anaheim~ California - COUNCIL MINUTES - December' 9~ 1969~ 1'30 RESOLUTION NO. 69R-699 - VARIANCE NO~ 2122: Application submitted by C~ Weaver, for Variance to establish an outdoor playground equipment display and sales area in C-2 and P-L zone in conjunction with an existing shopping center (White Front), located at the southeast corner of Harbor Boulevard and Wil- ken Way~ The City Council, pursuant to Resolution N6. 69R-699, denied said variance at the meeting of December 2~ 1969. Prior to adjournment Councilman Schutte stated he had inadvertently voted incorrectly on said resolution and desired to change his vote to "Noo" Decision on changing vote was con- tinued to this date for legal ruling. Councilman Schutte stated that since the last meeting he had re- ferred to Roberts Rules of Order; that it specifically notes a vote can only be changed after it is announced and before the results of the acCion declared. He thereupon withdrew his request to change his vote. PUBLIC HEARING - ABANDONMENT NO~ 69-9A: Pursuant to Resolution No. 69R-667, duly published in the Anaheim Bulletin, and notices thereof posted in accordance with law, public hearing was held on proposed abandonment intiated by the City Engineer of an existing roadway known as Old Jefferson Street, located north and south of Riverdale Avenue, east of Jefferson Street, and south of the Santa Aha River. Mayor Clark asked if anyone wished to address the City Council; hear- ing no response, he declared ~he hearing closed. CONTINUED PUBLIC HEARING - VARIANCE NO. 2135. Submitted by Earl Hardaway, request- ing permission to establish an auto rental facility in an existing restaurant structure as a primary use, with waiver of primary uses. Property presently zoned C-l, located on the north side of Katella Avenue, west of Harbor Boule- vard (Resolution of Intent to C-R - 66-67-61). The City Planning Commission, pursuant to Resolution No. PC69-219, granted said variance, subject to the following conditions. 1. That the owner of subject property shall pay to the City of Ana- heim the sum of $2~00 per front foot along Katella Avenue for street lighting purposes. 2. That the owner of subject property shall pay to the City of Ana- heim the sum of 15¢ per front foot along Katella Avenue for tree planting pur- poses. 3. That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of 180 days from date hereof, whichever occurs first, or such further time as the Planning Commission or City Council may grant. 69-742 City Hall~ Anaheim~ California - COUNCIL MINUTES - December 9, 1.?~69~ 1:30 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works J 5. That fire hydrants shall be installed as required and deter- mined to be necessary by the Chief of the Fire Department. 6. That all air-conditioning facilities shall be properly shielded from view. 7~ That Condition Nos° 4, 5, and 6, above 'mentioned, shall be complied with prior to final building and zoning inspections. 8. That subject property shall be developed substantially in ac- cordance with plans and specifications on file with the City o~ Anaheim, marked Exhibit Nos° 1, 2, and 3. 9~ That passenger automobiles only shall be rented from this facility, that 'parking on the property shall be limited for the rental of vehicles and employee automobiles only, and that no mechanical work, paint- lng, or car washin$ of automobiles or the pumping of gas shall be permitted on subject property~ An appeal of action taken by the City Planning Commission was filed by George HarveyAgent for the Applicant, and public hearing sched- uled for December 2, 1969, at which time Applicant requested continuance to this date, to allow the principals of National Car Rentals to be present. Zoning Supervisor Charles Roberts noted the location o£ subject property, the existing uses and zoning in the immediate area, and briefed the evidence submitted to and considered by the City Planning Commission~ He called attention to Condition No. 9 outlined in the Planning Commission's resolution limiting certain activities in conjunction with this business. (See above.) Councilman Dutton asked why there was opposition to the agency's servicing their own equipment° Mr. Roberts replied it was felt that the gasoline fumes generated could, filter into the air conditioning systems of the nearby motels, and there was the added concern about the noise that accom'panies maintenance operations. Council discussion ensued, and it was noted that there are sev- eral motels in the area with service stations immediately adjacent to them, and that other car rental agencies were allowed to maintain their own equip- ment. Mayor Clark asked if the Applicant or his Agent was present and wished to address the City Council. Mr. David S. Collins, 1077 West Ball Road, Agent for the Peti- tioner, stated he had sent a letter to each Councilman wherein their ob- jections to the condition imposed was noted. He added that the item of most serious concern to the Petitioner was the prohibition of pumping gaso- line, both because of the economic interest to the tenant and its obvious inequity. The Mayor asked if anyone else wished to address the City Coun- cil; hearing no response, he declared the hearing closed. RESOLUTION NO. 69R-701: Councilman Krein offered Resolution No. 69R-701 for adoption, granting Variance No. 2135, subject to the conditions recom- mended by the City Planning Commission; amending therein Condition No. 9, to permit fueling their own vehicles, minor repairs and washing of vehicles; prohibiting painting, body or fender work. Mr. Maynard Kambak, Agent for the Applicant and proposed Devel- oper of the property, reported that the present difficult money market had delayed their project, however, this problem had been resolved within th(~ past 90 days. He noted they had their first 5-year guarantee of all mini- mum lease income negotiated with the Republic of China, and the following 6 -(M~-to 20 years had been guaranteed by the United States Government. He concluded his remarks by stating it was felt that this 100% guaranteed income which had been converted to written confirmations with the governmental agencies, would satisfy the past reservations of the perma- nent lenders, in regards to financing.~ He further ad~.~ed that if commi't- ments are obtained from the lenders, the interim construction financing had been arranged and the project should be started within 60 to 90 dayg. CITY PLANNING COMMISSION ITEMS~! LEAGUE OF CALIFORNIA CITIES - EXECUTIVE MEETING: Mayor Clark announced that the Executive Committee meeting of the Orange County Chapter, League of California Cities, would be held December 11, 1969, at 6:45 P.M., at Friedemann Hall, Orange, and that the first item on the agenda would be the aerial mapping of the General Plan of Orange County. He extended an invitation to Councilmen and staff members to attend said meeting and offer any suggestions they might have. MOBILE HOMES - PROJECTED REVENUE AND SERVICE COST SURVEY: Councilman Dutton discussed the Planning Department's survey on projected revenue and ser- vice costs on mobile homes, parks and residential developments, noting that most mobile homes are purchased elsewhere, and that Anaheim does not benefit by the sales tax. He remarked that mobile homes are recognized by the State as vehicles, therefore their use becomes both residential and commercial. Citing as an example~ the "closed" mobile home parks, he asked the City Attorney for an opinion on the type of control the City of Anaheim would hav~ on their commercial use, questioning how they could be considered residential and at the same time have a commercial use. 69- 749 City Hall~ Anaheim, California - COUNCIL MINUTES - December 9~ 1969~ 1:30 P~M. City Attorney Joseph Geisler reported that it was felt that. this was not a legal question~ that for that reason, the Legal Department 'has re- ferred the matter to %he City Planning Commission. He advised that the City Planning Commission has ~nterpreted that the sale of trailers, restricted to use within the park, would be an "incidental" use. However, he concluded, if the sales were so restricted~ then it becomes a policy matter and the findings of the Planning Commission will come before the Council for their interpretation.
