Mayor Schutte called the meeting to order. MINUTES: The Minutes of the Special Meeting held June 27, 1960, 12-noon were approved, and correction to the Minutes of June 22~ 1960, page 4184 authorized on motion by C~uncilman Chandler, seconded by Councilman Fry. MOTION CARRIED. CONTINUED PUBLIC HEARING: RECLASSIFICATION NO. F-Dg-60-97z Submitted by Dave and Ann Domries, et al, requesting change of zone {rom R-1 to R-3~ property located at 706 Knott Avenue, was continued from the meeting of 3uno 28, 1960 to this date for the presentation o{ plans. Correspondence received this date signed by Domrtes~ Arnett and Nakawaki, requesting permission to withdraw said application for reclassif- ication was submitted and read. Said request to withdraw application was granted by the City Council on motion by Councilman Coons, seconded by Councilman Chandler. MOTION CARRIED· CONTINUED PUBLIC HEARING: RECLASSIFICATION NO. F-59-60-101: Submitted by Joseph D. Huarte, requesting change of zone from R-3 and R-1 to C-l, pro- perty located at the northwest corner of Placentia and Vermont Avenues. The City Planning Commission, pursuant to their Resolution No. 2~9, Series 1959-60 recommended said reclassification be denied. Public Hearing was held May 31, 1960 and continued to this date at the request of the applicant, for the presentation of plans of development. Mr. Russel O. Roquet, representing the applicant, presented plans of development on the Placentia Avenue frontage only, and advised that they wished to amend their application to encompass only the Placentia Avenue frontage. Revised plans, as submitted, were compared with the original plans previously considered by the City Council. Mr. Harinec, resident on Tyrol Place, objected to the further extension of the commercial zone and referred t° a zone change recently granted Mr. Huarte for a Tire, Brake, Tune-up and Wheel alignment Serv'ice at this location which has not yet been developed. Plans from the previous rezoning file (F-58-59-62), as referred to by Mr. Harinec, were reviewed by the City Council, and it was noted that there appeared to be a discrepancy in distances noted between the two plans of development. Thereupon~ Councilman Chandle~ moved that the Publ'ic Hear- ing be continued one week (July 12, 1960) for the purpose of correcting the drawing submitted. Councilman Thompson seconded the motion. McMahon, ~'3 California Bank Building, Anaheim~ representing the applicants, addressed the Council urging favorable consideration of their application. He advised that the previous request for rezoning included an R-3 area, and in the present application, all of the R-3 area has been eliminated, and the residential tract to the East is separated from the proposed C-1 area by approximately 270 feet. Those addressing the Council in opposition to the rezoning were: Leon Sail - 527 North Harcourt Street. Frederick J. Dorsch - 539 NOrth Harcourt Street. J~rs. Charles Lusk - 530 North Harcourt Street. Herbert Oberst - 519 North Harcourt Street, Those opposing the reclassificiation requested council protection of their investments in their homes; questioned the need for additional commercial zoning in the area and feared the increased traffic resulting in increased danger to their children. ~ir. McMahon referred to the Tract Map, Tract No. 3365, which is in conjunction with the application, being the property involved, and noted the large area planned for residential compared to the C-1 area planned only on Magnolia Avenue, Said map was reviewed by :the City Council. /he Mayor asked if anyone else wished to address the Council, there being no response declared the Hearing closed. Councilman Coons noted that the amount of C-1 requested was greatly reduced from the previous application, that only the four lots on Magnolia Avenue are planned for commercial development, the balance o~~ the property planned for R-1. He felt there were some C-1 allowable~uses that'would not he compatible with the area and suggested the uses established in Resolution 6065 pertaining to a similar area be considered. The C-'! allowable u~e,s outlined in Resolution No. 6065 were read. Councilman Chandler felt that the development in this tract' of R-1 and C-1 should be concurrent in order to prevent the spread'of any of the C-1 area. Mr. Jacobsen of A. R. McDaniel Engineering Co. advised that the R-1 and C-1 lots would be recorded at the same time through the recordation of the Tract Map. RESOLUTION NO. 6126: Councilman Chandler noted that the lot sized in the proposed tract would not be large enough to accommodate R-3 or anyother type of development, other than R-1 and thereupon offered Resolution No. 6126 and moved for its passage and adoption, authorizing the preparation of necessary Ordinance, changing the zone as requested, subject to the recommendations of the City Planning Commission, and further subject to the following list of restricted uses: 4206 City Hall, Anaheim; Califor...n.ia ., COUNCIL ~INUTES.- July.5., 1960, 7.:.00 P,M. 1. The City Plannin9 Commission recommended said reclassification in accordance with their Resolution No. 274, Series 1959-60, subject to the follow- ing conditions: i. Development in accordance with plan9 presented. 2. Dediqation of 53.feet from center lfne of Dowllng Avenue. 3. Preparation of street plans and install all improvements on Dowling Avenue in accordance with.apProved standard plans on file in the office of the City Engineer. 4. Payment of $2.00 per front foot for street lighting purposes. 5. P-L, 50 foot Parking-Landscaping setback on Dowling Avenue. 6. 90-day time limit on items Nos. 2, 3 and 4. The Mayor asked if anyone wished to address the Council. Mr. Philips, son of the owner, and Betty Roberts representing both buyer and seller were pres6nt. No one addressed the Council in opposition to the reclassification and no written protests were received in the office of the City Clerk, thereupon the Mayor declared the Hearing closed. Plans from the file were reviewed by the City Council. RESOLUTION NO. 6127: Councilman Coons offered ResolutiOn No. 6127 and moved for its passage and adoption, authorizing the preparation of necessary ordinance changing the zone as requested~ subject to the recommendations of the City Planning Commission. Mr. William M. Taber, Realtor, representing the applicants requested an extension of time as due to a death in the family the Applicants could not be present at this meeting. At the request of Mr. Taber, Public Hearing was continued two weeks, ~Juiyf 19, 1960). on motion by Councilman Chandler, seconded by Councilman Thompson. gOTION CARRIED. PUBLIC HEARING: RECLASSIFICATION NO. F-59-60-110: Submitted by Paul H. and Clada M. Ple%z, requesting,¢hange of zone from R-1 to C-3, property briefly described as located at the"northeast corner of East and South Streets. The City Planning Commission, pursuant to their Resolution No. 276, Series 1959-60 recommended, said Reclassification be denied. Councilman Coons disqualified himself from this proceedings, due to possible conflict of interest. Correspondence dated June 29, 1960 from Mr. Walt Gooden, explaining their request and presenting their arguments in favor of the rezoning was sub- mitted and read. The Mayor asked if anyone wished to address the Council. Mr. Gooden adCressed the Council and referred to the map attached to his letter explaining t~at the area of lmnd on which the r~zoning is requested is approximately 190 feet from the north property lin:e of the Pletz property, and approximately 468 feet from the residential area to the ~ast. Mr. C. W. Young of Douglas Oil Company addressed the Council stating in his opinion this was a logical location for a Service Station, and that they were the proposed purchasers of'the property. Those addressing the Council in opposition tlC the zone change were: Mr. Patrick Smith - 700 South East Street. Mr. Anthony G. Glass - 1212 Crestbrook Place. Mr. Harold Hall - 1240 Crestbrook Place. Mrs. Peters - 1237 Crestbrook Place. Those opposing the reclassification requested the area be retained as presently zoned, R-1. They felt that this development would depreciate the values of their properties and were uncertain of plans for that area north of the proposed service station property which is adjacent their,properties. They requested that the service station on the opposite corner not be taken into consideration for in their opinion, this station was.constructed illegally. The Mayor asked if anyone had any new evidence to offer, there being no response, declared the Hearing closed. RESOLUTION NO. 6128: Councilman Chandler, in noting the zoning in the immediate area, offered Resolution No. 6128 and moved for its passage and adoption denying Reclassification Application No. F-59-60-I10. REVISED TENTATIVE MAP, TRACT NO. 3794~ Developer: Buccola Investment Tract located 174.11 feet south of North Street on the west side of West Street and contains 21 proposed R-1 lots. The City Planning Commission recommended said tract be approved subject to the following conditions: i. Eliminate stub street southerly! proposed easement shown on west tract boundary to he temporary until property to the west is developed. 2. Pertinent plot and building plans to be submitted to City Council for review. 3. Require that should this subdivision be developed as more than one subdivision, each subdivision thereof shall be submitted in tentative form for approval. Councilman Coons moved that Revised Tentative Map of Tract No. 3794 be approved, subject to the recommendations of the City Planning Commission. Councilman Chandler seconded the motion. MOTION CARRIED. INTERPRETATION C-1 ZONE - POST OFFICES: The City Planning Commission Resolut- ion No 1, Series 1960-61 was submitted and read, recommending to the City Counci~ that Post Offices be considered an allowable use in the C-1 Zone and be so classified in accordance with the general provisions of Section 9200.14. Discussion was held by the City Council, taking into consideration the two types of Post Office activities, the Main Post Office and the Branch Post Offices, considering the size of both, and it ~as questionable to some members of the City Council, that a blanket C-1 zoning for this activity would be good planning, not only because of the size of the operation, but of the traffic created by both trucks and cars. At the conclusion of the discussion, Councilman Coons moved this matter be held over for one week (July 12, 1960) for further information. Councilman Chandler seconded the motion. MOTION CARRIED. Councilman Fry withdrew Resolution previously offered, approving the City Planning Commission recommendations. RESOLUTION NO. 6129: R£CLASSIFICATION NO. F-59-60-59: Councilman Fry offered Resolution No. 6129 and moved for its passage and adoption. Refer to Resolution Book, page A RESOLUIION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AM~.NDING RESOLUTION NO. 6088 IN RECLASSIFICATION PROCEEDINGS NO. F-59-60-92. Walker re- questing waiver of Condition No. 5 of Resolution No. 4758 requiring the construction of a 6-foot masonry wall along the south and east property lines of the property being developed for a rest home as he has acquired the adjacent property and plans for future expansion. With the stipulation that a grapestake fence will be constructed at this time, Councilman Chandler moved that a one year temporary waiver of the requirement of the block wall be granted. Councilman Thompson seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. F-59-60-94~ Submitted by Stevens, Kerwin, Grebel, Kluthe and McLaughlin for C-1 zoning on property located on the west side of Placentia Avenue between South Street and Morava Avenue. Correspondence received from Mr. McLaughlin, dated June 28, 1960, requesting council interpretation of the plot plans as approved, and further clarification of conditions was submitted. Mr. McLaughlin addressed the Council regarding the required wall and landscaping at the south end of his property. Exhibit A, plans and landscaping only - Exhibit B, the layout and Exhibit C being elevations were again reviewed by the City Council, and those interested were invited forward to review said plans with the Council. RESOLUTION NO. 6132: Councilman Chandler offered Resolution No. 6132 and moved for its passage and adoption amending Resolution No. 6065, eliminat- ing the landscaping requirement on the south side of the property, in accordance with amendment shown on the overlay marked "Exhibit A". Land- scaping to be from the west property line extending easterly 29 feet. (Sirius and Tiller Annexation) WHEREAS, the City Council of the City of Anaheim has canvassed the returns of a certain special annexation election held on the 28th day of June, 1960, in certain unincorporated territory sought to be annexed to said City of Anaheim~ and WHEREAS, the City Council has caused a record to be made of the canvass of returns of said election~ which record is entitled, "RECORD OF CANVASS OF RETURNS OF SPECIAL ANNEXATION ELECTION HELD JUNE 28, 1960".
