RESOLUTION NO. PC2004-1
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 88 (ORIGINALLY "SPECIAL USE PERMIT NO. 88")
AND CONDITIONAL USE PERMIT NO. 3045
WHEREAS, on November 7, 1960, the Anaheim City Planning Commission did, by its
Resolution No. 115, Series 1960-61, grant Special Use Permit No. 88 to operate a nursery school in the
R-O (Residential Suburban) Zone at 1597 West Katella Avenue; and that subsequently the term "Speciai
Use PermiY' was repiaced by "Conditional Use PermiY'; and
WHEREAS, on August 15, 1988, the Planning Commission did, by its Resolution No.
PC88-220, grant Conditional Use Permit No. 3045 to permit an addition to the existing pre-school for a
maximum of 100 children; and
WHEREAS, on March 18, 2003, Reclassification No. 2002-00085 was approved by the
City Council to rezone the subject property from the RS-10,000 (Residential, Single-Family) to the RM-
2400 (Residential, Multiple-Family) Zone; and that Condition No. 3 of Resolution No. 2003R-52, adopted
in connection with said reclassification, specifies that the property owner shall request termination of
Conditional Use Permit Nos. 88 and 3045 prior to adoption of an ordinance rezoning the property; and
WHEREAS, the subject property is vacant; and
WHEREAS, Mahmoud Bdaiwi, General Partner, Toura #2, L.P., property owner, has
submitted a letter requesting termination of Conditional Use Permit Nos. 88 and 3045; and
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby terminate all proceedings in connection with Conditional Use Permit Nos. 88 and 3045 on
the basis of the foregoing findings.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
January 12, 2004.
