PC2008-64 A RESOLUTION OF THE ANAHSIM PLANNING COMMISSION DETERMINING THAT A PREVIOUSLY-APPROVED CEQA NEGATIVE DECLARATION IS THE APPROPRIATE ENVIRONMENTAL DOCUMENTATION AND APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 2000-04244 TO AMEND CERTAIN CONDITIONS OF APPROVAL OF RESOLUTION NO. PC2000-101 WITH A WAIVER OF MINIMUM NUMBER OF PARKING SPACES (3'RACKING NO. CUP2007-05256) (2200 WEST SEQUOIA AVENUE) WHEREAS, the Anaheim Planning Commission did receive a verified Petition For an amendment to previously-approved Conditaonal Use Permit No. 2000-04244 with a waiver of minimum number of parking spaces for certain real property in the City of Anaheim, County oF Orange, State of California, shown on Exhibit A, attached hereto and incorporated herein by this reference. WHEREAS, on August 28, 2000, Resolutipn No. PC2000-101 approving Conditional Use Permit No. 2000-04244 with a waiver of minimum number of parking spaces was adopted by the Planning Commission to expand an existing private school with 172 parking spaces proposed where 541 spaces were required by Code; and WHEREAS, Condition No. 14 of Resolution No. PC2000-101 states: 14. That the maximum enrollment at this campus shall be seven hundred fifty (750) students (consisting of five hundred (500) senior high students and two hundred Fifly (250) junior high school students); and that the ma~cimum number of teachers shall be forty nine (49) and the maximum number of administrative staff shall be twenty seven (27). WHEREAS, the applicant has requested an amendment to this conditional use permit to modify Condition No. 14 pertaining to the maximum number oF senior high school students enrolled and the maximum number of teachers and administrative staff and to further waive the minimum number of parking spaces; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on April 2$, 2008, at 2:30 p.m., notice of said public hearing having been duly given as required by law and in acwrdance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed conditional use permit with a waiver of minimum number of parking spaces and to investigate and make findings and recommendations in connection therewith; and that said public hearing was continued to the May 28, 2008, Planning Comznission meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: -1- PC2008-64 1. That an amendment to the conditional use permit to modify the maximum number of senior high school students enrolled and number of teachers and administrative staff is permitted under authority of Code Section 18.60.190. 2. That an amendment to the conditional use permit to modify the maximum number of senior high school students enrolled to 750, to eliminate the junior high schopl program, and to modify the maximum number of teachers to 55 and administrative staff to 30 will not adversely affect the adjoining land uses or the growth and development of the area. 3. That the parking demand study found that the parking demand of the school is forecast to be l98 stalls while providing 218 stalls on site. Therefore, the school would have adequate on-site parking spaces to accommodate the forecasted demand at this site. 4. That the parking demand study Found that the on-site parking supply of the sckaool is adequate to meet the parking needs of the schooL Therefore, the school will not cause increased demand and competition for on-street parking spaces in the immediate vicinity. 5. That the proposed capacity changes of the school will not affect on-site circulation. The project will not increase traffic congestion within the off-street parking areas or lots provided For the school. 6. That the proposed changes will not affect vehicular ingress or egress patterns. The project will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the school. 7. ThaY no one indicated their presence at said publio hearing in opposition; and that no correspondence was received in opposition to the subject petition. WHEREAS, the Anaheim Planning Commission has reviewed the proposal and does hereby find that the Negative Declaration previously approved in connection with Conditional Use Permit No. 2000-04244 (Tracking No. CUP2007-05256) is adequate to serve as the required environmental documentation in connection with this request. BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby approve an amendment to Conditional Use Pemut No. 2000-04244 to amend, in its entirery, the conditions of approval adopted in connectian with Resolution No. PC2U00-101, to modify the school capacity to read as listed below and to waive the minimum number of parking spaces to allow 218 parking spaces where 290 spaces are required by Code: -2- PC200$-64 No. Conditions of Approval Responsible for Monitorin GENER AL 1 That trash storage area(s) shall be maintained in accordance Planning with approved plans on file with the Public Works Department, Streets and Sanitation Division. The walls of the storage areas shall be protected from graffiti opportunitaes by the use of plan materials such as minimum one (1) gallon sized clingin~ vines planted on maximum three (3) foot centers, or tall shrubbery. 2 That no required parking or pedestrian circulation or vehicle Code Enforcement circulation area shall be fenced or otherwise enclosed for storage or other outdoor uses. 3 That the maximum enrollment at this campus shall be seven Planning hundred fifty (750) senior high students and that the maximum number of teachers shall be fifty-five (55) and the maximum number of administrative staff shall be thirty (30). 4 While the senior high school and junior high schooi run Planning concurrently, said total enrollment shall not exceed 750 students. 5 That prior tp the elimination of the junior high school, the Planning parking lot shall be modified to provide a minimum of 218 parking spaces. 6 That there shall be no restrooms or showers pernutted within tlie Planning auditorium/gymnasium building. 7 That the roll-up doors on fhe west elevation oF the Code Enforcement auditorium/gymnasium building shall be kept closed at all times, except during times of deliveries. 8 That the hours of operation for the auditorium/gymnasium Code Enforcement facility shall be restricted to 7 a.m. to 10 p.m. 9 That a gate shall be maintained at the westerly driveway Code Enforcement entrance on Sequoia Avenue. The gate shall be closed between 10 p.m. and 7 a.m. and during all non-school hours, including weekends and holidays, ro prevent access to the property. 10 That the residential streets to the west shall not be utilized by Code Enforcement students, teachers or employees of the school. -3- PC2008-64 11 That a maximum of 125 student parking permits shall be issued Planning perschoolyeat 12 That the hours of operation for the school shall be limited to the Planning following: Monday through Saturday: 7:00 a.m. to 10:00 p.m. Sunday: 7:00 a.m. to 7:00 p.m. 13 That no outdoor loud speakers, which aze audible to the Code Enforcement residential area to the west, shall be permitted. 14 That a security officer provided by the school shall monitor the Code Enforcement adjacent residential neighborhood in the moming and aftemoon hours to ensure students are neither parking off-campus and loitering. 15 That that subject property shall be developed substantially in Planning accordance with plans and specifications submitted to the City of Anaheim by the applicant and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 8. 16 That approval of this application constitutes approval oF the Planning proposed request only to the extent that it complies with the Anaheim Municipal Zpning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance,regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with eaeh and all of the conditians heceinabove set forth. Should any such condiYian, or any part thereof, be declared invalid or unenforceable by the final judgment of the court oF competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null aod void. AND BE IT FURTHER RESOLVED that the property owner/applicant is responsible for paying all charges related to the prpcessing of this discretionary case application within I S days of the issuance of the final invoice, prior to the issuance of building permits or commencement of activity for this project, whichever occurs first. Failure to pay all charges shall result in delays in the issuance of required permits or the revocation of the approval of this application. -4- PC2008-64 THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of May 28, 2008. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 "Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced by a City Council Resolution in the event of an appeal.
