PC2008-70 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION DETERMINING THAT A PREVIOUSLY-APPROVED MITIGATED NEGATIVE DECLARATION IS THE APPROPRIATE ENVIRONM~NTAL DETERMINATION'FOR THIS REQUEST AND APPROVING RECLASSIFICATION NO. 2008-00217 (A 1.95-ACRE PORTION OF 8300 AND 8306 EAST LA PALMA AVENLJE) WHEREAS, the Anaheim Planning Commission did receive a verified Petition for Reclassification for a portion of certain City-owned real property situated at 8300 and 8306 East La Palma Avenue in the City of Anaheim, County of Orange, State of California, as legally described in Exliibit "A", and as shown in Exhibit "B", attached hereto and incorporated herein by this reference. WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 23, 2008 at 2:30 p.m., notice of said public hearing liaving been duly given as required by law and in accordance with tl~e provisions of the Anaheim Mwiicipal Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by iYself aud in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: l. That this is a City-initiated reclassification of suUject property from the General Commercial (C-G), Scenic Corridor (SC) Overlay zone to the Open Space (OS), Scenic Corridor (SC) Overlay zone. 2. That the proposed Open Space (OS), Scenic Corridor (SC) Overlay zone would be consistent with the property's existing Park land use designation of the General Plan. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community and would serve to preserve this property lcnown to contain the federally-protected Coastal California gnatcatcher and habitat. 4. That the proposed reclassiPication of subject property does properly relate to the zones and Hieir permitted uses locally established in close proximity to subject properCy and to the zones and their permitted uses generally established throughout the community. 5. That no one indicated their presence at said public liearing in opposition; and that no correspondence was received in opposition to subject petition. NOW, THEREFORE, BE IT RESOLVED that Yhe Anaheim Planning Commission has reviewed the proposal and does heraby find and determine tl~at the Mitigated Negative Dedaration previously-approved in connection witl~ the Weir Canyon Road/La Palma - 1 - PC2008-70 Avenue Improvemant/Itestoratiou project is adequate to serve as the required enviromuental documentation in counection with this request upon finding thaY the declazalion reflects die independent judgment of tl~e lead agency and that it has considered the previousfy-approved Mitigated Negative Declaration together with any comments received during the public review, process and that fihere is oo substantial evidence that tha reclassification will liave a significanT eP'fect on tl~e environmeiit BE IT FURTHER RESOLVED ihat tlxe Anal~eim Planning Commission does hereby appruve the suUject Petition for Reclassification to authorize an amendment to the Zoning Map of tl~e Anaheim Municipal Code to exclude t(ie above-described property &om fhe General Conunercial (C-fi), Sceuic Corridor (SC) Ovarlay zone and to incoiporate said described paoperty into the Open Space (OS), Scenic Corridor (SC) Overlay zone. BE IT FURTF~ER R~SOLVED, that this resolution shal] not constitute a re2oning oF, or a commihnenf by the City to rezone the subject property; any such rezoning shall require an ordinance of the City Council, which slzall Ue a legislative act, which may be approved or denied Uy the City Council at its sole discretion. THE FOREGOING RESOLUTION ~vas adopted at the Planning Commission meeting of June 23, 2005. Said resolution is subject to tl~e appeal provisions set forth in Cliapter 18.60 "Procedures" of the Anaheim Municipal Code pertaining to ai~peal procedures and may be replaced Uy a City Counci] Resoludon in the event f an appeal.
