Appeal from action taken by the City Planning Commission was filed by Mro Sol Schalman~ and public hearing scheduled. The Mayor asked if anyone wished iD address the Council. Mro Plone, representing the Broadway Village of Anaheim, addressed the Council, advising that the~ proposed building would be a maximum of 7,000 square feet~ and would be located at the northwest corner of Euclid and Crescent Avenues, being a portion of a ten acre parcel proposed for a shopping center. He further advised that the request was made to obtain permission to use not more than 10 per cent of the building for a bar area, and explained that the proposed lessee was the Coffee Dan's Restaurants. He then presented a drawing of the Coffee Dan's Restaurant in West Covina, which indicated the relation of the bar area to that of the dining area. He also presented an over-all plan of development for the ten acre site, and advised that the one opening onto CresCent was moved to line up with Fairhaven Street in order to be less objectionable to the residents in this area~ and stipulated that the business will front on Euclid Avenue. Those addressing the Council in opposition were~ Anthony Audino~ 553 Fairhaven Street; Mr. Pavese, 540 Fairhaven Street; Mr. Bryant., 554 Fai~haven Street° Reasons voiced were~ briefly~ (a) the close proximity to the $chool~ (b) increased traffic. Discussion between the City Council was held and it was realized that a restaurant could be constructed under the present zoning without the bar facilities, and the question was raised whether or not the people in the area would benefit with this type activity including a bar~ over other uses allowable in the C-1 zoner taking into consideration the change of plans~ that is~ the one opening onto Crescent Avenue, %o the new location, being the extension of Fairhaven Street. S - 3anu.a...ry 26, !960,.. 7,00 Po~o Mr. Leonard Smithi, Authorized Agent, addressed the Council, reia%ing the size of the parcel of PT.~ .petty and explaining their plans of developmen%~ which includes a parapet wall as a further protection of privacy ~:o the people in the residential area° ~ advised that no buildings wOuld'"be placed within the north 100 feet of the property and that they were prepared to immediately file the required deed restrictions. Plans in the file. indicating two stOry Structures, not to exceed 20 feet in height, were reviewed by the City Council. Dr. Bouchelle, 1416 Birchmont Drive, advised that they had no objection to the rezoning if the same restrictions were placed on the property that apply to the previous Similar reclassification of %he adjacent property~ and, further, if no two-sto~y structures are permitted. That they, as a group, object to any two-story bui~ding in that area° He then submitted and read a letter from Mr. 3ohn Fo McC{rew, 1461 Beverly Drive, reiterating his objections and also calling attention to the establishment of a precedent in the area° Mr. Milton Sohley~ 1450 Birchmont Driver felt that a parapet wall would only help the people immediately behind the building, and that %o 9o up another 8 feet~ with windows~ would deprive them the privacy of their back yards° He then submitted a copy of a letter from Dr. Scott Smart, 1456 Birchmont Driver in which his reasons for objections were noted° Mr. Roscoe Hill, 1432 Birchmont Drive, voiced his objections, feeling that this was an invasion of their privacy.. Mr. Heald, Applicant, stated, in view of the apparent objection to the proposed invasion of privacy, suggested they blank out any windows on the north end of the second story, and reported that under the present zoning~ they would be permitted to build to a height of 20 feet within 25 feet from their property° He felt no precedent would be established due to the fact that a variance is required before an industrial enterprise is started in this area° Mr. Lloyd Lichtenwalter, 1411 Bi.rchmon% Drive, objected to the 20 foot height limitation because it was more than a one-story buil.ding~ and requested the property be restricted the same as the other developments already in the area. Reference was made to the Anaheim Municipal Code wherein self-service service stations are prohibited withiln the City. It was reported that this was a provision adopted prior to an amendment of the State Fire Code, which amendment takes, care of the problem existing i~ set~-service service stations. Thornton Piersallo ACTING PLANNING DiRECTOR~ Richard A o Reeseo The Mayor called the meeting to order° MINU/ES~ Minutes of the regular meeting held Jante ry 26, 1960 were approved on motion by Councilman Coons~ seconded by Councilman Thompson° MOTION CARRIED° CONTINUED PUBLIC HEARING - ~{ECLASSIFICATION NO, F-59-60-65: Submitted by Stella Co Roach~ requesting change of zone from R-A 1;o C-3.~ property located at 1753 Lincoln Avenue (nor%h side of Lincoln Avenue~ between Euclid. Avenue and Crescent Way)o The City Planning Commission, pursuant to their Resolution No° 143-A, Series 1959-60~ recommended said reclassification from R-A~ Residential- Agricultural~ to C~.3~ Heavy Commercial~ for the east 65 feet~ subject to certain conditions~ and that the reclassification of the balance of the property be denied until a better use than a used car lot is proposed for the property° The City Council, at their regular meeting held January 19, 1960, adopted Resolution of Intent No° 5766~ rezonin9 the easterly 65 feet to C-3~ subject to conditions~ and continued said hearing on the remaining 135 feet %o January 26~ 1960 and was again continued to this date for the presentation of a rendering and plan of development° Mro James Roach, son of the Applicant, presented an artist"s rendering° Said rendering~ after being reviewed by the City Coun¢il~ was retained by Mr. Roach o It was the opinion of the City Council that the rendering submitted was inadequate, being an ornamental facing only, and that a roof should be provided over at least one row of the used cars on display, and the 35 foot building se,tback maintained° Reference was made to a previous application for display and sale of industtial machinery in this area~ which was denied because it was felt that outside display of tractors and other pieces of heavy industrial equipment was not in the best interest of the area~ as this would set a pattern for future
