RHSOLUTION NO. 5859: Councilman Coons offered Resolution No. 5859 and moved for i~s paggage and adoption, authorizing the preparation of nece~gary ordinance, changing the zone, as requested, subject to the recommendations of the City Planning Commission, with the exception that Condition No. lB thereof be amended to read, "Payment of $2.00 per front foot for street lighting purposes, unless the street lightin9 is indluded as part of the tract map"~ and further subject to the payment of $25.00 per dwelling unit to the Park and Recreation Fund, to be collected with the issuance of the buildin9 permit. PUBLIC HEARING - VARIANCE NO. 1205.- Submitted by James and Monica Lombardo~ requesting permission to construct four motel apartment units on vacant westerly lot adjacent to Corner property at 503 West Vermont Avenue~ plus swimming pool~ also, requesting that building on Lot 1 be known as a motel (northwest corner of Palm and Vermont Streets)° The City Planning Commission, pursuant to their Resolution Nco 170~ Series 1959-60, denied said varianceo Appeal from action taken by the City Planning Commission was filed by Mrs° Lombardo and public hearing was scheduled to be held this date. Communication dated March 1, 1960 from Mro Ralph Wo Maas, regarding deed restrictions on the property, was submitted and read° Petition o£ approval, containin9 ten signatures of property owners in the area, was submitted° The Mayor asked if anyone wished to address the Council° Mrs. Lombardo addressed the Council, relating the present commercial activities in the immediate vicinity and stated her request for a four'unit motel was made so that she could build the apartments without garages and have sufficient area to build a swimming poolo She referred to the plot plan in the file, indicating 8 off street parking spaces° Mro Murdoch reported that verbal request had been made by Mrs° Lombardo, advising that she wanted the application to also include the waiver of the garage requirements and a five foot front yard encroachment permit for the swimming poolo Councilman Thompson asked Mrs° Lombardo if an oral request was made by her before the City Plannin9 Commission for the encroachment into the front yard for the .swimming pool and also for no garages° To this question, Mrs° Lombardo replied, yes. Reference was made to previous application for a beauty shop on the adjacent property at the corner and Mrs° Lombardo stated that when this application was made, signatures were obtained from all the landlords, approving this use. The City Attorney advised that in order to remove the deed restrictions from this tract, all the persons affected by the restrictions would have to sign a waivero Councilman Coons moved fhat the public hearing be continued {or one week (March 15, 1960) to allow Mrs. Lombardo time to obtain the signatures required for waiver of the deed restrictions. Councilman Thompson seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. F-59-60-18: Keystone Savings and Loan Association (Masonic /emple): Consideration of the verbal request of Mr. Leo Friis to eliminate Condition Nco 5 of Resolution of Intention No° 5596, was continued from the meeting of March 1, 19600 Communication dated March 8, 1960 from Mro Leo J. CANCELLATION OF CITY TAXES~ Request of Harold Jo Botts, President, and Bill Cochrane~ Secretary, Anaheim Optimist Club~ for waiver of City taxes on property owned by the Optimist Club at 113 West Chartres Street, was~.submittedo Mr. Botts addressed the Council, calling attention to the use of the facilities for public purposes° Councilman Pearson moved that the City taxes be waived on said property, as requested (AoPo #35-121 18) 'CounciIman Coons seconded the motion. MOTION CARRIED. REPORT OF DAMAGES~ Communication dated February 24, 1960 from George W. Robinson, 2515 Britain Way, Anaheim, advising of damages to certain electrical household equipment~ was submitted~ and on motion by Councilman Fry, seconded by Councilman Ihompson, action on said matter was deferred for one week (March 15~ 1960) to allow time for further investigation by the Public Utilities Director. CANCELLATION OF COUNTY TAXES: On motion by Councilman Coons~ seconded by Councilman Fry, the Orange County Board of Supervisors was requested to cancel County taxes on property acquired by the City of Anaheim for public purposes~ Parcel Nco 1 only of property purchased from Florence Ho Spencer~ pursuant to Resolution Nco 5802 and deed recorded February 17, 1960, in Book 5103, page 125, Office of %he County Recorder of Orange County° MOTION CARRIED. A petition, signed by six property owners within Tract No. 1142, representing seven parcels of property, requesting the approval of Variance No. 1205, was submitted, and Mrs. Lombardo advised that she now had obtained the signatures of all of the property owners affected, with the exception of one owner on Hampshire Avenue, who is moving. Plans from the file were reviewed by the City CoUncil and Mrs. Lombardo further advised that the location of the swimming pool has been
