CONTINUED PUBLIC HEARING - VARIANCE NO. 1211: Submitted by Alpha Beta Food Markets, Inco~ requesting permission to erect a free standin9 sign 6~ 11" x 1~~ 0" on property located at 915 South BroOkhurst Street (west side of Brookhurst Street~ north of Ball Road)° Public hearing was continued from the meeting held March 29, 1960 for £urther investigation pertaining to the legality o£ the Bank o{ America identification sign° Mro Murdoch presented original plans of the Bank of America building and explained that it was a procedure in the Planning Department to approve permits for signs when they were for identification only. Mro Edwin Markson, representing Alpha Beta Food ~arkets, addressed the Council and agreed to a sign which would be a part of the Center sign instead of a separate sign in accordance with their request. Further discussion was held regarding other similar signs in the City of Anaheim° It was felt that the Plannin9 Department approval of 'plans was for structural requirements only. To allow a review of the present sign regulations, both in the sign and zoning ordinances, and with the Consent of the Applicant., Councilman Pearson moved that the public heartn~ be continued to May 10~ 1960~ 7:00 Gouncilman Goons seconded the motion, MOTION CARRIED. PUBLIC HEARING - RECLASSIFICATION NO, F-59-60-81~ Submitted by Rowland and Johnston, requesting C-1 zoning on property located at 916 West La Palina Avenue (south side of La Palina Avenue, adjacent to Boy Scout Club House). The City Planning Commission, pursuant to their Resolution No. 196, Series 1959-60~ recommended said reclassification, subject to the following conditions: 1. Payment of $2.00 per front foot for street lighting purposes. 2. Development in accordance with plans presented. C-1 Deed Restrictions - limiting use to Business & Professional Office. It was explained that the charge was made for future installation of ornamental street lights. RESOLUTTON NO. 5916: Councilman Pearson offered Resolution Noo 5916 and moved for its passage ands doption~ authorizing the preparation of necessary o~inance, changing the zone as requested, subject to the recommendations of the City Planning Commission° Refer to Resolution Book, page . PUBLIC HEARING - VARIANCE NO. 12025 Submitted by Rowland and Johnston~ re- questing waiver of rear~yard and garage requirements on property located at 1020 South Philadelphia Street (east side of South Philadelphia Street~ 1105 feet south of Vermont Avenue). The City Planning: 'Commission, pursuant to their Resolution No. 179, Series 1959-60, denied said Variance. Appeal from action taken by the City Planning Commission was filed by Do Lo Rowland~ and public hearing scheduled this date. The Mayor asked if anyone wished to addr'ess the Council° Mro Johnston addressed the Council, explaining their reasons for appeal was because of the fact they felt that their plans of development had not been thoroughly understood° He noted the location of the property and stated the request was made in order to get a better front yard setbacks and regarding the two-story provision, that they were approximately 76 feet from the nearest one-story residential unit. He further explained that these apartments are designed as bachelor type units, and the proposed carports will not be seen from the street. Plans filed with the City Planning Commission were reviewed by the City Council. Councilman Fry noted that the plans showed 8 feet from the railroad property line. ~4r. William Arnold, 960 South Philadelphia Street, addressed the Council, explaining that they in the area did not want substandard apartments at this location. F-59-60-79~ Submitted by Richard E. and Lo Mable Ostroot, requesting R-3 zoning on property briefly described as located on the east side of Nutwood Street, north of Ball Road, between Ball Road and Beacon Avenue° The City Planning Commission, pursuant to their Resolution No. 194, Series 1959-60, recommended said reclassification be denied. Mro and Mrs. Ostroot filed written request for public hearing. Correspondence dated March 23, 1960 from Mr. and Mrs. Ostroot, setting forth their plans 'of development, was submitted and read. Petition of approval containin9 31 signatures was submitted. An artist's rendering of the proposed development was submitted. The Mayor asked if anyone wished to address the Council. Mro Cecil Co DeVote, representing the Applicant, addressed the Council and presented plans and artist's rendering for Council review. Plans indicated 80 carports on an alley on each side of the project, 72~ 870 square foot~ two-bedroom living units~ and being a self-contained area of approximately four acres to be rented to senior citizens. Mro DeVote advised that if they can develop this, they can then economically develop the corner of Ball Road and Nutwood Street. The unde- velopment of this corner, he felt, was the only objection to the project. Mro Piersall, City Engineer, called attention to the drainage situation and reported that at a meeting held, the owners agreed %o dedicate and develop all roads within a year or a year and one half. Others addressing the Council were: CALVIN ANDREWS~ 927 Nutwood Street - re£erred to the 49 homes immediately to the north of this project. MRS. CALVIN ANDREWS, 927 Nutwood Street - felt the corner of Nutwood and Ball Road should be improved and objected to the traffic and drainage situation, and recommended that if this rezoning was approved, that there be a brick wall to the north for the protection of the adjacent home owners o RODNF_Y H£NSLER - objected to the service alley along the homes that are built on the cul-de-sac streets to the north, and felt that Ball Road Was already saturated with apartment houses° He felt the Council should, consider the request very carefully° MRo LLOYD MOUNT, 929 North Citron Street - referred to the rendering a nd remarked that he felt it was patterned after "The Commons" which had 12 units to an acre, and the renting situation encountered by Mr° Hudson, developer of "The Commons". MRSv LINKE, 943 Nutwood Street, circulator of the petition of approval, stated they find the plan acceptable. JOHN NETHERY, 91;1 So. N~o DAVID GORDON, 2132 Minerva Avenue, was concerned with commercial development on Ball Road and the danger to the school children crossing Ball Road to patronize the businesses° Mro DeVore stated his personal feeling was that the Ball Road area would be an ideal location for a medical-dental building, however, be{ore any development, there would be a survey made of the neighborhood, and nothing would be requested without the majority approval of the entire neighborhood° Mro Ostroot, applicant, addressed the Council, advising of the total area of the parcel; that the project was not being built for resale, and ex- plained the differences between "The Commons" and their proposed project~ and advising that Mr. Hudson was helpful and instrumental in these plans, based on his experience with "The Commons"° N~RS. HENSLER, 908 Echo Place, felt that additional apartments were not needed in Anaheim° Mro CALVIN ANDREWS referred to Ordinances Nos 915 and 935 pertaining to areas in certain locations, and referred to a suggested map which he had previously presented° The Mayor asked if anyone had anything new to offer, there being no response, declared the hearing closed. Discussion resumed and consideration was given to possible zoning requested for the property to the east, the possibility of movin9 the carports across the alley° Mro Ostroot stated that Mr. Griffith has constructed a concrete wall up to Trident Street and he would be willin9 to extend this wall to Nutwood Street; that actually, only four houses bordered the property. The density of units per acre was considered, and at the conclusion of the discussion, Councilman Pearson moved that action be postponed to May 10, 1960, to allow further study° Councilman Thompson seconded the motion. MOT ION CARR I ED. PUBLIC HEARING - RECLASSIFICATION NO. F-59-60-80s Submitted by Anthony F. and Roberta J. Parra, requesting C-1 zoning at 735 South Stanton Avenue Avenue (west side of Stanton Avenue, approximately 1090 feet north of Ball Road). The City Planning Commission, pursuant to their Resolution Nco 195, Series 1959-60, recommended said reclassification, subject to the following conditions; 1o 20 foot front yard setback and landscaping. 2o Prepare street improvement plans and install all improvements in accordance with approved standard plans on file in office of City Engineer° 3° Payment o£ $2°00 per front foot for street lighting purposes. 4° That a 90 day time limit for Items 2 and 3o The Mayor asked if anyone wished to address the Council. Proctor, dba Li~l Dude Cafe, was deferred from the meeting of March 29, 1960, for completion of required investigation by Police Department. Report of the Police Department was read wherein the Chief of Police recommended said permit be withheld, pending the business qualifying as a restaurant, rather than a short order cafe. Mr. Proctor was of the opinion that they qualified for the permit, and stated he would be willing to make a change in the menu. Councilman Pearson moved said permit be denied. Councilman Coons seconded the motion° MOTION CARRIED. YELLOW CAB SERVICE.- Application of C. Eo Briley and Eo Ac Slagle for 8 additional taxi cab permit, was withheld from the meeting of March 29, 1960, for completion of required investigation by Police Department. On the recommendations of the Police Department~ permits were authorized as requested, on motion by Councilman Coons, seconded by Councilman Thompson° MOTION CARRIED. REQUEST - ADVERTISING SIGNS, Request of United Outdoor Advertising Company and 3ames Lo Morris for permission to erect a 10v x 25v sign at the north- west corner o£ Crescent Avenue and the Santa Aha Freeway, lettered~ "For Sale or Lease", was submitted. Mr. Henegar of United Outdoor Advertising Company, and Mr. Coalson Morris were present and addressed the Council. Discussion was held and consideration given to the landscaped freeway ordinance and also the zoning ordinance pertaining to regulations of 5ign5o Mro Morris advised that this was a one purpose sign, to advertise the sale of the property; that the sign would be removed when the property is sold, and agreed to a time limitation on the sign. Councilman Pearson moved that action on this request be postponed two weeks in order that the sign regulations can be revised to include pro- visions for the handling of this type of request. Councilman Coons seconded the motion. MOTION CARRIED. SIDEWALK WAIVER~ Request of Don J. Daley, ~anager~ Disneyland Hotel, for waiver of sidewalk requirements on Oerritos Street, was submitted. Based on the report of the City Engineer~ said request for sidewalk waiver was granted, on motion by Councilman Coons, seconded by Councilman Pearson. MOTION CARRIED. MOTION CARRIED- TRACT NO. 3611~ (Reclassification No. F-59-60-56) Correspondence .from Mro Pat Arnold, dated March 31~ 19607 was submitted, requesting amendment to conditions of Council approval to eliminate dedication requirement of a parcel, 75 feet by 105 feet, as ownership of this parcel of land is in the name of Veterans Affairs. Mr. Piersall presented the first tentative map and the revised tentative map~ pointing out the problem~ and advised that the owners are agreeable to post bond for the improvements of this parcel requested to be excluded from the map. Count ilman Thompson moved that the original condition of 'ap. pro~wal~ ... of revised tentative map, Iract No. 3611, requiring the inclusion o£ this pro- perty~ be waived~ with the understanding that they post a bond and install the improvements £ron~ing this parcel° Councilman Pearson seconded the motion. MO/ION CARRIED° TRACTS NOS° 3446 AND 2446 - WATER SERVICE~ Mr. John Griffith, developer, requested clari£ication regarding the water service to Tract Nos° 2446 and 3446, so that construction of water lines can proceed. He explained that dedication has been made to the City o£ Anaheim o£ these lines, and that he now understands the area is to be served by the Dyke Water Company. The agreement with the Dyke Water Company to serve this area, and also the provisions of the subdivision ordinanoe~ which requires throughout the City dedication of lines, was considered. Mro Oelkers explained that in the agreement with the Dyke Water Company~ the City of Anaheim has the right to serve the first tier of lots in this tract which abut; Cerritos Street. Mr. Griffith requested some action be taken by the City Council to abandon these easements so that escrows for the sale of this property can be closed. It was the opinion of the City Council that further investigation would be necessary before action could be taken by the City Council on this request~ and the City Council agreed to adjourn this meeting to tomorrow at 10:00 A.M. to further consider this problem. SPECIAL USE PERMIT NO. 1-58 - RIVIERA ANAHEIM MOBILHOME PARK~ Correspondence of Jolly Hilliard and Bert C. VanHorn, dated March 31, 1960, requesting approval of revised plans, to allow the remodeling of two areas designated as 1 and 2 to allow reduction of trailer space to 2400 square feet, was submitted. The Assistant Manager of the Riviera Anaheim Mobilhome Park', addressed the Council, explaining their reasons for their request and their plans of 4008 City Hall, development. Revised plans were compared by the City Council with the new plans proposed. It was moved by Councilman Pearson, seconded by Councilman Schutte that the revised plans as ipresented, be approved. MOTION CARRIED. RECESS': Councilman Pearson moved to adjourn for a five minute recess. Councilman Coons seconded the motion. MOTION CARRIED, (11110 P.M.) SCHOOL SITE: City Planning Commission's answer to Anaheim Union High School District regarding the school site on the south side of Wagner Street between Placentia and Sunkist Avenues was submitted for Cguncil information.
