A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM CERTIFYING THAT
COST ASSESSMENTS FOR WEED ABATEMENT
IMPOSED PURSUANT TO TITLE 6,
CHAPTER 6.16 OF THE ANAHEIM
MUNICIPAL CODE REGULATING WEED AND
REFUSE ABATEMENT HAVE BEEN DULY
ASSESSED IN ACCORDANCE WITH LAW AND
ARE LEGAL AND VALID
WHEREAS, pursuant to Title 6, Chapter 6.16 of the
Municipal Code (the "Weed and Refuse Control Ordinance the
City is authorized to undertake weed abatement activities when,
after affording the property owner due process, the property
fails to abate the nuisance caused by the weeds when ordered to
do so by the City; and
WHEREAS, pursuant to the Weed and Refuse Control
Ordinance, the City is authorized to declare that the costs of
weed abatement are to be a lien upon the property from which the
weeds were removed to be collected with the taxes of said
property; and
WHEREAS, the City Council annually confirms the report
of the Fire Chief regarding the cost of weed abatement and
directs the filing thereof with the County of Orange so that the
abatement costs may be added to the next regular tax bill levied
by the County against each parcel from which the weeds were
removed; and
WHEREAS, the County of Orange has requested that the
City submit a certification that the weed abatement costs to be
levied against the parcels from which the City removed weeds have
been duly assessed in accordance with law and are legal and
valid; and
WHEREAS, City Attorney's Office has opined that the
weed abatement costs to be levied against the parcels from which
the City removed weeds have been assessed in accordance with the
law and are legal and valid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the weed abatement costs which are to be
placed on the 1997 -98 fiscal year property tax roll have been
assessed in accordance with all applicable law and are legal and
valid.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 5th day of
August ,1997
