INVOCATION: Reverend Nason Dikanifuwa, Pastor of Methodish Church in On Tali, Southern Rhodesia, visiting the 1st Methodist Church in Anaheim gave the invocationG FLAG SALUTE: Mayor Schutte led the Pledge of Allegiance to the Flag. MINUTES: Minutes of the City Council Meeting held June 27, 1961, were approved on motion by Councilman Coons, seconded by Councilman Fry. MOTION CARRIED. PUBLIC HEARING: ABANDONMENT: Public Hearing was held on proposed abandonment of a portion of an easement running through lots 38 to 49, Tract No. 3970 located, briefly, west of Walnut Street, south of Santa Ana Street. Hear- ing was scheduled in accordance with posted notices and Resolution No. 6972 duly published in the Anaheim Bulletin, June 22, 1961. There being no response, declared the Hearing closed. RESOLUTION NO. 7018: Councilman Thompson offered Resolution No. 7018 for passage and adoption. Refer to Resolution Book. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDONMENT OF THAT PORTION OF AN EASEMENT FOR PUBLIC UTILITY PURPOSES UPON, ALONG, OVER AND THROUGH THE HEREINAFTER DES- CRIBED REAL PROPERTY. SIGN PERMIT: Request of Raymond Murphy, Rocket Neon Company, for permission to construct sign at Tiki Motor Hotel, 1018 Orangethorpe Avenue was submitted. Plans were reviewed by the City Council, and request granted on motion by Councilman Thompson, seconded by Councilman Coons. MOTION CARRIED. SIGN PERMIT: Request of M. L. Renfro, Electrical Products Co., for permiss- ion to erect two signs at the northwest corner of Ball Road and Knott Avenue, for Union Oil Company was submitted. Plans were reviewed, and it was noted that the sign projected 4-feet over the right-of-way. Said permit was granted, as requested, on motion by Councilman Fry, seconded by Councilman Thompson. Councilman Coons requested the record to show that he did not vote on this issue because of a conflict of interest. MOTION CARRIED. ENTERTAINMENT PERMIT: Request of Water Wheel, 1154 North Euclid Avenue, for entertainment permit for dinner music only, by one organist, was granted subject to the recommendations of the Chief of Police, on motion by Councilman Chandler, seconded by Councilman Coons. MOTION CARRIED. ~, RECLASSIFICATION NO. 59-60-28: REVISED PLANS: Request of White Front Stores for approval of revised plans to permit enclosing a corner of the canopy fronting the building for a do-nut shop, was submitted. Revised plans were reviewed by the City Council. Mr. Frank Evarone explained that this would be a glass enclosure and would be in one corner of the arch. He further advised that there wasnit sufficient room inside the building for this business. Revised plans, as submitted, were approved on motion by Council- man Chandler, seconded by Councilman Thompsono MOTION CARRIED. RECLASSIFICATION NO. 59-60-107~ DEED RESTRICTIONS: Correspondence from Mae G. Budnick, filed this date, was submitted, requesting that former request to amend deed restrictions filed in accordance with Reclassification 59-60- 107, to permit off-sale liquor, beer and wine sales in neighborhood grocery store be withdrawn, as she has terminated negotiations regarding leasing of the property. Mrs. Budnick's request to withdraw former request was granted on motion by Councilman Chandler, seconded by Councilman Coons, and no further action was taken by the City Council. MOTION CARRIED. --... RECLASSIFICATION NO. 60-61-96: Submitted by Mr. George Reish requesting change of zone from R-I to C-l, property located at 2004 Underhill Avenue. (South- east corner of Placentia and Underhill Avenues) City Planning Commission recommended said reclassification be denied~ Public Hearing was held by the City Council June 13, 1961, at which time said Hearing was closed, and action of the City Council deferred to this date to allow time for the Applicant to obtain approval from the property owners within the Tract for the removal, or waiver of deed re- strictions limiting the use to residential purposes. Communication from Anaheim-Sunkist Civic Association, dated ,JUly 3, 1961, requesting reclassification be denied since there were deed restrictions on the property and since several home owners in the tract object to the change of zone, was submitted and read. Petition of protest containing sixty signatures was filed at open meeting. Councilman Chandler felt this was something that should be studied from a standpoint of public convenience and public good, rather than from an individual standpoint; that precedence will be established as lots in the block on Placentia Avenue are considered piecemeal, un- less action is taken by the Council to determine just what the use of that land facing Placentia Avenue should be, and thereupon moved that action on Reclassification No. 60-61-96 be deferred sixty (60) days and the problem be referred to the Planning Department for a study concern- ing the entire block on Placentia Avenue. Councilman Thompson seconded the motion. REQUEST, VACATION TRAILER: Request of F. E. Woodman, l005 Paradise Place, CL.I for temporary permit to park vacation trailer in his yard was granted V-~ for a period of 60-days on motion by Councilman Coons, seconded by Councilman Fry. MOTION CARRIED~ INTERIM BUSINESS LICENSE: 139 SOUTH LOS ANGELES STREET: Request of Mro Ray Rhoades, on behalf of Mrso .June Hansen and Mr~ Gilbert C. Nee for permission to operate a practical nursing school at 139 South Los Angeles Street was deferred from the Council Meeting of June 27, 1961 so that the Applicant, or his representative could be present at the meetingo Mro Ray Rhoades addressed the Council advising that the interim license was requested due to the fact that the lease for the building has already been entered into, and it would be an economical loss to the operators of the school if permission to operate was denied during the time required to process an application through the City Planning Commission. Di cussion was held pertaining to the operation of the school, parking requirements and the risk taken by the applicants should the business be commenced and the required permit be denied by the CIty Planning Commission, or City Council" Councilman Coons moved that the Applicant's request be granted for an interim business license while processing a Conditional Use Permit, it being specifically understood that this action shall in no way influence the City Planning Commission in their action on his Conditional Use Permit~ and in the event Conditional Use Permit is denied, the Applicant shall have no recourse, on a hardship basis, to the City Council. Futher, application shall be made immediately. Councilman Thompson seconded the motion. MOTION CARRIED. REFUND: FILING FEE: On the recommendatj,ons of the Planning Department, refund of $50,,00 fiLi ng fee to Mro Irving L. November, 742 North Resh Street, Anaheim, California, was authorized on motion by Council- man Coons, seconded by Councilman Chandler. MOTION CARRIED. RECLASSIFICATION NO. 60~6l-25: Request of John Fo Rothman, Providence Farming Co. for waiver of requirement for IS-inch parapet wall be- hind carport , as required in special amendment to Uniform Building Code, Section 1709 was submittedo My, Robert Davis:1 Assistant City Manager, reported that this special provision was adopted at the same time the 1958 Uniform Building Code was adopted. Further discussion was held, at the conclusion thereof, it was moved by Councilman Coons, seconded by Councilman Fry, that it be the findings of the City Council that the actions of the City Counci,l~ City Planning Commission, Planning Department and Building Department in approving said plans for building constitutes affirm- ative action, and shall be deemed to create an estoppel against the city. ARCHITECTURAL CONTRACT, SMITH-POWELL K MORGRIDGE: Mr. John Dawson, Assistant City Attorney, reported that their office has redrawn the original agreement in line with what Smith, Powell and Morgridge bid as their preliminary estimate, and as agreed to by Mr. Powell. The billings submitted were also in line with those previously sent" The corrections and credits 5uggested by Mro Powell are based upon his thinking, and on the possibility that his organization will go ahead with the police facilities contract. If the Council wished to settle, without going ahead with the police facilities contract, the credit which the city would receive for the por- tjon of the drafting time that was put in on the police facility building will be added to the present charges. The method of arriving at a 1/6th credit, as offered by Mr. Powell was explained by Mr~ Dawson. Mr. Dawson also briefed the present contract and explained the provisions therein. He further advised that they had billed on the basis of their time sheets broken down for the Civic Center, Library and Branch Library, and stated in his opinion, in the event the contract was sancelled at this time, by other than a mutually agreeable method, the city would be liable for the reasonable value of the services rendered under the contractu MIo Dawson further stated, that after checking dates on which these services were rendered, and checking the contract, the charges presented to the Council appear to be correct. Councilman Thompson stated he had talked with the former Mayor, and apparently he had no knowledge of extra studies being made for which we apparently have some charge. To him, when Mro Fry stated that this firm was uncooperative, it was a very definite disqualification of the firm, dnd for this reason he would not vote to pay any of these charges until a proper adjustment is made. He further stated that he approved of what the Library Board said they would assume, but disapproved amending the contract. Councilman Fry advised that the statement was made that this firm was uncooperative, but there were other considerations also. The Ubrary Board fel t they should have an archi tect somewhat specialized in libraries9 and if they had a smaller concern, they would get more personal service. Cancellation was requested, but not for non-cooperation alone, several things were considered that made them feel they would rather have another firm. Councilman Coons stated, considering the analysis of costs, and Mr. Dawson's statement, he could see no reason why the Council should not settle this one contract and proceed with another one. It was his opinion that if the city abandoned the project now, that funds would be paid for work done on a police facility building that would have to be totally duplicated by another architect, resulting in not only a 1058 of money but a loss of time. Councilman Chandler prefaced his remarks by stating he had no intentions to impugn the former Council, or the character of Smith, Powell and Morgridge, and intended no personal remarks, but from the evidence presented to him, it appeared the city was paying duplicate charges, as there is a i~pa ckage" charge and a 1 so charges for "component partsIV. As for the firm being uncooperative, the Library Board, an autonomous body, requested the Council to cancel the contract, and it should be noted that the City Council, by Resolution, was the one who cancelled the contracto He further advised that hi~ computation of the billing amounted to 187 3/4 man-days, and that he would only be in favor of payment of actual hours, substantiated from payroll records, plus a reasonable return for the Principals, based on $4,875,00. He felt he could not approve actual cost of 2~% expended, unless more evidence was presented. RESOLUTION NO. 7027: At the conclusion of the discussion, Councilman Coons offered Resolution No. 7027 for passage and adoption, cancelling the existing contract with Smith, Powell and Morgridge, pay the sum of $7,092096, which are the apparent charges for the Civic Center planning, and that we enter into a new contract for the Police Facility Building only, at the established percentage figure based on the estimate furnished by the architectural firm of $680,000.
