DINNER DANCING PERMIT: Application filed by Thomas R. Coughlin for Dinner
Dancing Permit at Kings Row, 409 West Katella Avenue, was held over for one
week to allow for further investigation from the Police Department.
REQUEST - ST. JUSTIN MARTYR CHURCH. Request of Jerome Fo Stehly on behalf of St.
Justin Martyr Church for permission to hold their Fall Festival October 20,
21, and 22, 1961, on the Church grounds on West Ball Road, and further
requesting that the license fees for said Festival be waived, as this is a
charitable activity, was submitted. Councilman Thompson moved that permit
be granted as requested~ and the license fees waived. Councilman Fry
seconded the motion. MOTION CARRIED.
SIDEWALK WAIVER - 412 CRESCENT WAY: Request of U. So Borax Research for
waiver of sidewalks at 412 Crescent Way, in order to complete an addition
to an auxiliary building in this industrial area, was submitted and read.
On the recommendations of the City Manager, Councilman Coons
moved that temporary waiver of sidewalks be granted. Councilman Fry
seconded the motionG MOTION CARRIED.
DRIVEWAY APPROACHfS - 323 EAST BALL RQAD: Request of Manchester Feed and Milling
Company for two, 50' non-standard driveway approaches at 323 East Ball Road,
was submitted.
The City Engineer recommended approval of said request, subject to
the provisions that all three existing approaches be closed.
Councilman Chandler moved that the request for two, 50' driveway
approaches be granted, subject to the recommendations of the City Engineer~
Councilman Thompson seconded the motionG MOTION CARRIED.
REQUEST - FALL-OUI SHELTER: Request of Walt Burton, General Contractor, for
approval of Fall-Out Shelter Plans in the front yard of Mr. & Mrs~ Glen
Dickman, 956 Caplan Street, together with sketCh, was submitted. Councilman
Thompson moved that said request for Fall-Out Shelter be approved by the
Council, subject to the approval of the Engineering Department and the City
ManagerVs Offlce, and approval of the specifications by the Building
Department. Councilman Fry seconded the motion. MOTION CARRIED.
CONDITIONAL USE PERMIT NO. 114: Request of Mr. D. M. Primo for extension of time
for compliance with the street lighting payment required pursuant to Reso-
lution No. 6861 in Conditional Use Permit No. 114, was submitted.
Mr. Primo was present and further explained the reason for his
request, and advised that a six-month extension would be sufficient.
Discussion was held by the City Council and City Manager, and at
the conclusion thereof, Councilman Chandler moved that a six-month extension
time for payment of the street lighting requirement be granted, subject to
the condition that Mr. Primo obtain and file with the City prior to next
Council meeting a letter from the lessor authorizing him to apply for and
receive the requested extension. Councilman Coons seconded the motion.

RECLASSIFICATION NO. 61-62-1: Request of Theodore T. Roelfsema, Pacific South-
west Realty Company, for waiver of street lighting payment required by
Resolution No. 7125 in Reclassification No. 61-62-1, as the street lighting
assessment on this property was paid to Orange County prior to annexation
to the City of Anaheim, was submitted.
RESOLUTION NO. 7261: On the recommendations of the City Manager, Councilman
Thompson offered Resolution No. 7261 for passage and adoption, amending
Resolution No. 7125 in Reclassification Proceedings No. 61-62-1, by deleting
Condition No. 3 therefrom.

RELEASE OF INSURANCE CLAIM - WRECKED POLICE VEHICLE: On report of the City
Manager, Councilman Fry moved that the Mayor be authorized to sign
"Release of all Claims" form in the amount of $2,284. representing
settlement of totally wrecked police vehicle resultirn] from traffic
accident on or about the 12th day of August, 1961 (R. L. and ~argaret
Stalcup). Councilman Coons seconded the motion. MOTION CARRIED.
FINAL MAP~ TRACT NO. 4156: Subdivider. Westmont Estates. Tract located on
the north side of Westmont Drive, opposite Dwyer Drive and contains 30
R-O lots.
The City Engineer reported that said Final Map conformed
substantially with Tentative Map previously approved by the Council,
that all fees have been paid, and necessary bonds posted, and recommended
the approval of Final Map as submitted.
On the recommendations of the City Engineer, Councilman Thompson
moved that Final Map of Tract No. 4156 be approved by the City Council.
Councilman Coons seconded the motion. MOTION CARRIED.
FINAL MAP. TRACT NO. 4323: Subdivider, Cerritos Homes. Tract located on the
northeast corner of Cerritos Avenue and Nutwood Street and contains 20
R-l lots.
The City Engineer reported that said Final Map conformed
substantially to the Tentative Map previously approved, that all fees
have been paid and necessary bonds posted, and recommended approval of
said Final Map.
On the recommendations of the City Engineer, Councilman Fry
moved that Final Map. Tract No. 4323 be approved by the City Council.
Councilman Coons seconded the motion. MOTION CARRIED.
HEADQUARTERS FIRE STATION PRELIMINARY FLOOR PLANS: Mr. Robert Davis, Assistant
City Manager, presented preliminary floor plans for the Headquarters Fire
Station as prepared by Kaltenbach and Associates, Architects, indicating a
basement structure underneath the office portion of the proposed Fire
Headquarters building for use as emergency control and operational center
for the fire stations, and reported on the estimated additional cost
thereof.
Plans were reviewed by the City Council and Fire Chief Stringer,
and discussion was held at the Council Table.

Mro John Mo Martin, 607 South Hobart Street, Los Angeles 5,
California, representing the Trailer Coach Association, addressed the
Council explaining the background and steps taken in selecting this location
for a Mobile Homes Park, referring to the Market Analysis and Appraisal,
finding this area most suitable and beneficial to the Community as a Mobile
Homes Park siteo He reported the advancements made in standards which must
be followed in the construction of Mobile Homes governing electrical, heat-
ing and plumbing requirements 0 Regarding this particular park, he stated
it was planned to contain 167 trailer spaces, or approximately nine spaces
to the acre, costing approximately $350,0000 Further, that the park will
provide wide streets, underground power facilities, trees and landscaping,
and be a self-contained community with their own recreational facilitieso
Reference was made to statistical data taken from a report by Dro
Gillis of UoC.LoAo pertaining to taxeso
Other statistical information pertaining to a six per cent
vacancy factor were taken from a survey made by Ernst and Ernst, Account-
ants - Auditors, proving residents of mobile home parks not the transit
typeo
Plans were reviewed by the City Council, and it was noted that
the size of the lot per trailer space was 62 feet by 40 feeto
Edward Terfansky, 2424 Rainbow Avenue, addressed the Council in
opposition to the developmento He reported that an open civic meeting of
those persons interested in the area had been held, and a petition of
opposition was presented by their committeeo He stated they had read the
minutes of the City Planning Commission meeting, and in the interest of
time and to avoid repition, three spokesmen of their group would present

their oppositiono He further reported that their primary concern is that of
traffic and traffic circulation, as occupancy of 167 spaces would materially
affect auto traffic and pedestrian school children traffic beyond the
capacity of the street so He called attention to the present condition of
Gilbert and Crescent Streets, noting in addition the parking situation, and
presented pictures showing the amount of children walking to school in this
street due to the lack of sidewalksu He stated, should families of children
be allowed to live in the park, the traffic flow and children would increase
even more than they have pointed auto
An area map was presented of the present existing area, and how
this would affect the traffic flowo
To alleviate this situation, Mro Terfansky suggested the land now
proposed for the trailer park be purchased by the City for an additional
park and parking area, and further advised although they had worked and
voted for the bond issue, if additional money was needed, they would be
willing to work for ito He felt this suggested plan would be comensurate
with good planning and the needs of the communityo
MrsoDuane Duncan, 947 North Siesta Street, stated the granting of
this use permit would not be compatible with the present uses in the
vicinity, and would be inconsistent with good planningo She stated that
this was a residential area with no multiple dwellings currently developed
and in use in the areao In her opinion, the development of the trailer
park could devaluate the area in generalo
Mrso Duncan also recommended the City purchase the additional
land to enlarge the suggested park, and if this was not possible, the
property should be zoned R~l to blend with the surrounding areao
Mr, Charles Lusin, 1180 North Los Angeles Street, Anaheim,
Attorney representing many home owners in the area, all in the immediate
vicinity of the subject property, called attention to the use of the
property being subject to the general principles of law, being the right
that the adjoining property owners have in their lando He stated that a
Conditional Use was an exceptional use, and must be compatible within the
meaning of the Ordinance and be desir able or essential to the public con-
venience or welfare, nor impair the integri.ty and character of the zoning
districto In his opinion, thls use would not comply with these definitionso
It was his contention that most of the area of the trailer park would be
covered by cement or some hard surface, such as asphalt, thereby creating
a drainage problem in the stormy, rainy seasono He called attention to the
area of Crescent and Brookhurst, and the present condition of that inter-
section in the rainy seasono He stated that having a trailer park
contiguous to a municipal park would destroy the beauty of the park, and
asked if the City had acquired direct access to Gilbert Avenueo Inasmuch
as development of the community park appears to be two or three years
away, it seemed to him that such access to Gilbert Street would also be
two or three years awayo He submitted that the decision of the Planning
Commission should be reversed and that the applicantqs petition should be
deniedo
Mr, Duane Duncan, 947 North Siesta Street, asked how the six
per cent transit figure had been obtainedo
Mro John Martin read in part the Market Analysis Appraisal,
wherein the six per cent figure had been established, being a vacancy
factor, not a transit factor, and further stated that the average mobile
home resident remains 202 years in one location.
Mr, Burt Olley, 2403 West Crescent Avenue, Anaheim stated in
his opinion if it was possible to purchase this additional R-3 land to
enlarge the community park, Brookhurst Junior High School on the East,
the Mel Gauer School on the West, and the new Savanna High School on the
Northwest of the park would allow multiple use of thlS one park site~

Mro John Martin, in answer to questions presented, stated in
relation to the traffic in the area and off~street parking problems, that
each site within the mobile homes part will have room for two-car parking,
regarding traffic on Gilbert Street, the park will not have access to
Gilbert Street, access being through to Crescent Avenueo Regarding an
increase in school attendance, he stated only one out of thirteen trailer
residents have school-aged childreno Regarding density, he stated that
the density was not greater than that of any other facilityo
The Mayor asked if anyone else wished to address the Council,
there being no response, declared the hearing closede
Discussion was held by the City Council, regarding land use,
taking into consideration this area being basically a single-type
residential neighborhoodo Reference was made to the original plans,
whereby with the installation of streets it would make possible this
area receiving and taking care of its fair share of drainage watero

Mro Asawa addressed the Council stating the activity is presently
being conducted in the existing building and under a County Variance obtained
prior to the time this area was annexed to the City of Anaheimo The County
permit allows retail sales, and this application was made in order to permit
wholesale saleso He explained that this parcel contains five acres, and to
comply with conditions imposed regarding street improvements would preclude
the future development of the balance of the propertyo Although no develop-
ment is presently contemplated, he believed within six months there would be a
plan for this lando
Joseph Geisler, Assistant city Attorney, reported that in his
oplnlon retail candy sales would be a C-I use, where wholesale candy making
would require an M-l Zoningo
Mro Asawa again explained that the candy-making business is pres-
ently being conducted in the existing building, that the same operation will
continue, the only difference being that they would be permitted to sell
wholesaleo
Present zoning in the area was reviewed by the City Councilo
Discussion was held regarding the feasibility of posting a bond
to insure street improvements, as conditions would have to be complied with
before the conduction of the businesso Engineering problems together with

Mro M. Lo McGaughy, Authorlzed Agent and developer of the property,
addressed the Council urging the granting of the reclassification, and
stating that they hoped the divider strip can be relocated, and reported that
the State was agreeable to this change, if the City would approve of ito He
further stated that they were prepared to make the change in the divider
themselves, but were hoping the City would join them in the construction of
the left-hand turn pocket going north. He advised that on parcel number 1,
they planned a two-story building; the first floor to be devoted to commer-
cial businesses and the second floor used for officesu He called attention
to the one foot strip noted on the Tract Map at the east boundary of the

Plans from the file were reviewed by the City Councilo
Mro Michael Roll, owner of property east of subject property,
called attention to the present dedicated one half road (Ridgeway) on the
east side of his property running from Lincoln Avenue south to the Flood
Control Channel, and advised according to this plan and if Ridgeway Street
is not abandoned, it wlll result in his having a roadway on each side of

Mr. Walt Gooden, representing the applicant, addressed the
Council and referred to a map prepared by McDaniel Engineering firm
indicating two alternate plans, Plan A and Plan B, and stated they per-
sonally preferred Plan B because the traffic that is building up in'that area
will . flow more frgely~ He stated that the plan was based on a similar
one developed at Romneya and East Streetsn
Files and plans were reviewed by the City Councilo
Mrso Peters, representing some of the property owners on
Crestbrook and East Streets requested to see a copy of the mapa
Mrs Peters was invited forward to the Council Table to review
the mapa
Mrs. Peters related her findings of the minutes of September 15,
1959, and requested a clarification of those minutes and also the correct
zoning of the property at the present timeo Mra Joseph GeiSler, Assistant
City Attorney, explained that the requirements in the former Resolution of
Intention to Rezone had never been complied with, and the property is the
same as it was, R-l for the first one hundred fifty feet and R-O for the
balance of the propertyo
Mrso Peters felt the former action of the City Council was
relevant to this appllc~tion, as there is proposed commercial on the
front and slxteen houses in the backo She requested clarification of
what ftin the back" was, and in her opinion this answer was in the minutes
of the September 15, 1959 meetingo Also, she felt the type of houses
planned to be built in back could not possibly conform if commercial was
allowed on the fronto With reference to the development at Romneya and

for this developmento She questioned the effect of the commercial develop-
ment on the property to the rear, and called attention to the four planned
drlveways and the alley, which dead-ends into residential property. She
stated it had been established that this would be a buffer zone dividing
residential and M-l, and to allow this request would establish a precedent
for the ten acres to the Southo
Mre Gooden advised that most of those present in opposition were
out of this area, and stated that those in opposition wanted this area
developed into homes because business was obnoxious to themo He wondered
if business across the street from this area would not also be obnoxious
to the residents of this property if developed into homeso He further
advised the plan of development offered by those in opposition was to
build homes with a wall along South and East Streetso He felt because of
the traffic and business, it would not be to anyone's interest to build
houses on East Streeto
Mr~ John Stinson, 1231 Crestbrook Place, Anaheim, stated he
believed every home on Crestbook Place was represented, and asked those
interested to stande He called attention to the fact that homes are
already established on East Streeto
The Mayor asked if anyone else wished to address the Council,
there being no response, declared the hearing closedo
Discussion resumed among the Councilmen, and Councilman Chandler
was of the opinion, taking into consideration the amount of undeveloped
land in this area and the fact that East Street was never constructed as
a commercial street, this fact substantiated by the necessity of posting
"No Parking" signs on a portion of the street at the present time to
alleviate the current situation, felt that a better plan might be developedo

Richard Guthery, representing the applicants, advised that the
application was made for the purpose of constructing a service stationo He
explained the close proximity of the roadway to the house making residential
use of the property undesirable, and referred to a petition of approval
signed by forty people. In his opinion, this would be the most desirable
use this particular parcel of property could be put too

Mro Kenneth Lae, Attorney, also was of the opinion that a small
service station would be the best use that this corner could developo He
reported that the house to the North was approximately thirty feet from
the subject property line, and further explained that this would not be a
super service station, as the size of the lot would only support a small
station; and with the present traffic conditions and further widening of
the street, he felt that the traffic would increase and that this use
would be compatible with other uses coming into this areao
Map of the area and plans from the file indicating the close
proximity of the street to the house were reviewed by the City Councilo
Janet Carroll, resident adjacent to the property on Western
Avenue referred to a petition of protest filed with the Planning Commis-
siono She explain~d that this was her home and that they wanted to live
there, and requested the application be deniedo
Mrs. Carroll was invited to the Council Table to review the
map of the area indicating the street pattern and the location of the
street to the dwelling; and discussion was heldo
Mre Kenneth Lae wondered if Mrs. Carroll understood the
possible location of her home when Western Avenue is widenedo
Dro Carroll explained that he had purchased the property fully
aware of the future development of Western Avenueo He stated that they
did not object to some kind of business, but did object to a service

ANTHONY C. PALOMBI - REGARDING TRAPPING OF CATS: Mro Anthony Co Palombi, 1847
Mountain View, addressed the Council protesting the loaning by the Police
Department of traps used to trap unwanted cats, so that the animals can be
transferred to the County Pound for disposalo He stated that a resident in
the Trailer Park next to his home knowingly trapped and disposed of their
pet cato He felt very bitter towards his neighbor, and felt that if the
Police Department had not loaned the trap this could not have been accom-
plishedo
The City Council was sympathetic with Mra Palombi in the loss of
his pet, but explained the necessity for these traps as many unwanted
animals cannot be captured by any other meanso Also, that it was virtually
impossible to distinguish a household pet from a strayo
ALCOHOLIC BEVERAGE APPLICATION - 1077~ NORTH HARBOR: Mro Joseph Geisler, Assis-
tant City Attorney, reported that the protest filed by the City Council to
application filed by Louis Guiliano Jro and Bernard Kaminsky, for off-sale
beer and wine license on premises to be located at 1077t North Harbor
Boulevard had not been received within the thirty day period, and could not
be considered by the Alcoholic Beverage Board; that further investigation
revealed that the building will not face on Harbor Boulevard, but will face
on the alley behind, and that this is a warehouse and delivery route type
of operation wlth very little off-sale on the premiseso
Discussion was held by the City CounCil, and the City Attorney's
Office was authorized to file an additional letter of protest re-affirming
the Councll's original protest, and because further investigation reveals
a type of operation that the City had no notice of, that the protest be
again considered as this is a type of operation that is very difficult to
police.
CLAIM AGAINST THE CITY: Mro Joseph Geisler, Assistant City Attorney, reported
on a change in the law pertaining to claims filed, and recommended that the
claim filed by Mrso Walter Go Mock, previously denied by the City Council,
be found insufficient because of the following reasons:

Councilman Thompson moved that it be the finding of the City
Council that the claim filed by Mrso Walter Go Mock is insufficient for the
reasons outlined by the Assistant City Attorney. Councilman Coons seconded
the motion. MOTION CARRIED.
