MINUTES: Approval of the minutes of the Anaheim City Council meetings held December 17 and 24, 1963, were deferred one week (January 7, 1964). JOB NO. 1277 - NUrwoOD STREET SEWER IMPROVEMENT: On the recommendations of the City Engineer, resolution calling for bids on Job No. 1277, the Nutwood Street Sewer Improvement, was taken off agenda for redesign of plans. PUBLIC DANCE PERMIT: Application filed by Political Association of Spanish Speaking Organizations of Orange County, John G. Lozano, President, for permission to hold public dance January 9, 1963, at Carpenters Hall, 608 West Vermont Street, was submitted. Councilman Chandler moved said Public Dance Permit be approved, subject to the recommendations of the Chief of Police. Councilman Schutte seconded the motion. MOTION CARRIED. AMUSEMENT MACHINE LICENSE APPLICATION: Application submitted by Leonard Rubin, Sales Manager of Associated Coin Amusement Co., Inc., for permission to place an Automatic Bowler, two Baseball Games and one Juke Box at Linbrook Bowling Center, 201 South Brookhurst Street, was granted subject to the recommendations of the Chief of Police, on motion by Councilman Chandler, seconded by Councilman Dutton. MOTION CARRIED. (Councilman Krein entered the meeting, 1:40 P.M.) BUILDING PERMIT - 535 SOUTH WEST STREET (RECLASSIFICATION NO. 63-64-73): Request of Herman H. Bruns for issuance of building permit to allow construction of a single-family dwelling at 535 South West Street (R-A Zone), pending action on his petition for R-l Zoning, Reclassification No. 63-64-73, was submitted. Mr. Schutz, attorney representing the applicant, addressed the Council requesting favorable consideration of Mr. Bruns' request. On motion by Councilman Schutte, seconded by Councilman Chandler, said request for building permit was granted, all obligation and respon- sibilities to be assumed by the applicant, furthe~ no certificate of oc- cupancy to be issued until R-l zoning of subject property is completed. MOTION CARRIED. CONDITIONAL USE PERMIT NO. 370:\ City Planning Commission Resolution No. 991, Series 1963-64, rescinding Resolution No. 731, Series 1962-63, in order to reinstate Conditional Use Permit No. 370, was submitted for City Council information. No action was taken on the above resolution. CONDITIONAL USE PERMIT NO. 511: Submitted by Arnold Construction Co., request- ing permission to establisha motel with later addition of restaurant-bar facilities on M-l and C-2 property located on the East side of Harbor Boulevard~ approximately 242 feet north of Romneya Drive, (1224 North Harbor Boulevard). The City Planning Commission, pursuant to Resolution No. 986, Series 1963-64, granted said conditional use permit, subject to conditions. 7380 City Hall. Anaheim. California - COUNCIL MINUTES - December 31. 1963. 1:30 P.M. Attention was called to report from the City Engineer, dated December 13, 1963, recommending additional condition be added to the ten con- ditions recommended by the City Planning Commission, as follows: "II. That the owners of subject property shall deed to the City of Anaheim a three foot public utility easement along the easterly boundary; and a three foot public utility easement and a two foot overhang easement along the northerly boundary of the subject property." Mr. Maddox reported that his office has requested the easements and it is possible they will be received today. On motion by Councilman Chandler, seconded by Councilman Dutton, the City Clerk was authorized to set Conditional Use Permit No. 511 for public hearing before the City Council, in the event the easement dedications, as recommended by the City Engineer, arenot obtained by January 7, 1963. MOTION CARRIED. VARIANCE NO. 1611: Submitted by Richard R. and Evelyn Tetrow, requesting per- mission to create two R-A parcels of less than one acre, and waiver of front yard setback requirement, on R-A property located on the north side of Savanna Street, approximately 932 feet west of Krott St. (3621 Savanna St.). The City Planning Commission pursuant to Resolution No. 985, Series 1963-64, granted said Variance, subject to conditions. No action was taken by the City Council. TENTATIVE MAP TRACT NO. 5439: RECLASSIFICATION NO. 62-63-38 AND CONDITIONAL USE PERMIT NO. 317: Clarence Clark, Developer; tract located on the west side of Bella Vista St., 684 feet south of Lincoln Avenue, and contains 8 proposed R-3 lots. The City Planning Commission at their meeting held December 23, 1963, approved said tentative map, subject to the following conditions: 1. That should this subdivision be developed as more than one subdivi- sion, each subdivision thereof shall be submitted in tentative form for approvaL 2. That the subdivider acquire that portion of Lot D, of Tract No. 3886 not previously dedicated to the City of Anaheim. 3. That an alley cutoff be provided at the southwest corner of Lot No. 5, in accordance with Standard Plan No. 130. The City of Anaheim will permit an encroachment of the existing garage until such time as the single family garage is removed, or until additional units are cO'1structed. 4. That the existing 20-foot drainage easement shall be abandoned at such time as Del Monte Drive is extended to Knott Street. 5. That the approval of Tentative Map of Tract No. 5439 is granted subject to the reclassification of subject property to the R-3, Multiple Family Residential, Zone. Mr. Kreidt reported that subject property was included in a petition for R-3 Zoning, Reclassification No. 62-63-38, currently pending completion. Councilman Schutte moved that Tentative Map, Tract No. 5439, be approved, subject to the recommendations of the City Planning Commission. Councilman Krein seconded the motion. MOTION CARRIED. That a drainage easement be provided and improved between Lot Nos. 7 and 8, and 16 and 17. That vertical curbs be constructed along "A" Street, as stipulated to by the engineer. That the curb along Vermont Avenue be located at 24 feet from the centerline of the street, as stipulated to by the engineer. That the vehicular access rights, except at street and/or alley openings, to East Street shall be dedicated to the City of Anaheim, as stipulated to by the engineero That the sidewalks shall be installed along East Street (at ultimate location and grade) and Vermont Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer~ because of the proposed school at the south- east corner of East Street and Vermont Avenue. 8. That a temporary sidewalk waiver be granted for "A" Street due to the in- dustrial nature of the development. Councilman Dutton moved that Tentative Map, Tract No. 5452, be approved subject to the recommendations of the City Planning Commission. Councilman Chandler seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. 63-64-52 AND CONDITIONAL USE PERMIT NO. 494: Submitted by Clarence L. and Mary Sue Mixon, requesting R-3 zoning, property briefly des- cribed as located on Palm Lane approximately 572 feet south of Ball Road (1244 Palm Lane); and further requesting permission to construct a 2-story multiple family planned residential development with carport and waive one- story height limitation. Subject applications were forwarded for Council infomation, along with excerpt from the December 9, 1963~ City Planning Commission minutes, noting that at the request of the petitioner, Reclassification No. 63-64-52 and Conditional Use Permit No. 494 were terminated. No action was taken by the City Council on the above applicationso ORANGE COUNTY TENTATIVE MAP. TRACTS. NOS. 5058 AND 5453: Developer, Marjan De- velopment Inc.; tracts located approximately 2,000 feet easterly of Imperial Highway, containing approximately 15 and 14 acres respectively, and 50 and 53 R-l, lots respectivelyo ''-- I I Mr. Kreidt noted the location of subject property, and read condi- tions recommended by the City Planning Commission to be forwarded to the Orange County Planning Commission, and advised that an addition should be made to Condition No.3 as recommended for Tract No. 5058, said condition to read as follows: "3. That the drainage from the south shall be accepted in an underground storm drain system within the right-of-way of 'B' Street." Mr. Kreidt further reported that the only basic change is that the North-South street has been re-orientated from the easterly section to the westerly section. Maps of the tentative tracts were reviewed by the City Council together with City Planning Commission recommendations. PROPOSAL - ANAHEIM UNION WATER COMPANY. Mr. Murdoch introduced Mr. Peterson from the Anaheim Union Water Company, who was present for the purpose of answering Council questions relative to their offer to the City of Anaheim, to acquire water lines and facilities within the City limits. The question was asked concerning the eventual disposition of water rights along the Santa Ana Rive~ and the nature of said water rights. Mr. Peterson advised that the company was following a procedure recommended by the Economic Research Associates, and that the first step was to dispose of the water delivering system, the disposition of the water rights would be considered by the Board of Directors at a later date; he further advised that their recognized right was one half of the flow of the Santa Ana River, that this is an appropriated right and one that can be transferred to another agency, however, until such time as disposition of the entire facilities can be made, they would be using these rights by spreading the water to the under- ground basin through their own facilities. Mr. Peterson stated that it was his understanding that when the water rights are sold or disposed of~ they would be to some Orange County Agency in order to retain the rights withIn the Count Yo ;; Councilman Krein asked what the City obligation would be to the stock- holders of the company if the transfer materialized. Mr. Peterson replied that the only obligation would be to furnish water. Discussion was held concerning a clause in the proposed Agreement, wherein the City of Anaheim will appear and defend and hold Anaheim Union Water Company harmless from any liability arising from any suit brought against it, by any of the stockholders or present users, by reason of discontinuance of the Anaheim Union Water Company to supply water. Consideration was given to the possible elimination of any litigation by distribution of the companyVs assets such as pipelines, easements,etco, by vote at a stockholders meeting. Mayor Coons referred to report given by Mr. Lenain, Superintendent of the Water Department, concerning the benefits that would be derived by the Water Department, should the transfer take place, and requested that the Director of Public Works, Mro Thornton Piersall, also report on the benefits that might accrue to the Public Works and Engineering Department. At the conclusion of the discussion, the matter was ordered deferred to January 7, 1964, 1:30 P.M., and the City Attorney and Mr. Peterson were re- quested to review the bylaws of the company, to determine if they allow this type of transfer without vote at a stockholders meeting, and also to consider assignment of certain water rights at this time with actual possession delayed to a future dateo RESOLUTION NO. 63R-I041: Coun::il;:lan Chand10T offered Resolution No. 63R-I041, establishing a charge for the purchase and planting of trees. PROPOSED CITY CHARTER: Mr. Murdoch reported that the Citizens Charter Committee has completed the draft of the proposed charter, and asked if the City Council wanted to attempt to have the Charter provision placed on the April Ballot. Discussion was held, and it was the consensus of the City Council, that a hearing by the City Council should be had on the Charter as presented by the Citizens Committee, and the final draft be reproduced in sufficient quantity to be furnished to any interested voter, and that the voters be given ample time to review such charter, with further general hearing to con- sider any possible suggested changes; also noted was the fact that the effective date of the charter would remain the same, whether it was adopted at the April, June or November election" CITY ATTORNEY COMMITTEE - COUNTIES OF LOS ANGELES. ORANGE AND VENTURA: On motion by Councilman Schutte, seconded by Councilman Krein, the City Attorney was authorized to commit the City for a sum not to exceed $100.00 for a joint filing of an amicus brief by cities where the problem involved a matter on ~;\ 7385 City Hall. MOTION CARRIED. PRESS - COMPLIMENT: Councilman Dutton commended the Press for their very fine service rendered to both the City and City Council, referring to the two exclusive articles recently published concerning the proposal of Dart Inc. 'I SIGN REQUEST: Councilman Chandler requested that all reports on sign applica- tions be accompanied by a plot map furnished by the recommending depart- ment, showing the surrounded area and zoning, and including a recommenda- tion concerning the possible impact of any sign on any residential area surrounding the proposed sign location. Councilman Chandler further requested that public hearing be held to consider signs of a particular size, height and light intensity. ADJOURNMENT: Councilman Chandler moved to adjourn.
