2004-225 RESOLUTION NO. 2004- 225 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM EXTENDING THE PAYMENT OF SALARY AND BENEFITS TO CITY EMPLOYEES RECALLED TO ACTIVE DUTY IN CONNECTION WITH ACTIONS TO COMBAT TERRORISM AGAINST AMERICA WHEREAS, the City of Anaheim currently provides fully paid leave of absence and continuation of benefits for a maximum of thirty (30) calendar days per fiscal year to employees who have been in City service for at least one (1) year and who are ordered to report to active duty; and WHEREAS, a number of City of Anaheim employees have been, and other employees may be, called into active military service in connection with actions to combat terrorism against America; and WHEREAS, on January 28,2003, the City Council adopted Resolution No. 03R-14 that provided a supplemental military leave benefit for a period not to exceed two years; and WHEREAS, this supplemental military leave benefit as set forth in Resolution No. 03R- 14, is due to terminate on December 31,2004; and WHEREAS, the City Council of the City of Anaheim desires to alleviate financial hardships which employees and their families will experience as a result of being called to active duty to serve during such crisis. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCil OF THE CITY OF ANAHEIM AS FOllOWS: 1. That the period of supplemental salary continuance and benefits as established in Resolution 03R-14 be extended by twelve (12) months. 2. That each full time officer or employee of the City who is eligible to receive such paid leave and, who has been, or is in the future, called to involuntary active military service with the Armed Forces of the United States to serve in support of the current actions to combat terrorism against America, shall be entitled to I ave with partial pay pursuant to the terms of this Resolution for the period f absence on active duty in excess of the period covered by current pai military leave provisions. 3. That the a ount of pay each employee shall be entitled to receive from the City for sai additional period of military leave shall be the difference between the gross p y and allowances actually received by the officer or employee from the U ited States for such service and the gross wages that said officer or employe would have received from the City of Anaheim if he or she had not been c lied to active military duty, subject to all required and appropriate deductions and with holdings. 4. That the Ci shall provide continued health and welfare benefits to such employees' dependents, provided the dependents were covered for such benefits pri r to the employee being called to active duty. That Wag or benefits pursuant to this Resolution are conditioned upon the officer or mployee requesting such payment providing satisfactory proof and document tion of eligibility to receive payment in accordance with procedures establishe by the Human Resources Director. 6. That the p y and benefits authorized by this Resolution shall terminate on Decembe 31,2005, unless extended by the City Council. 7. That the e ective date of this Resolution shall be January 1,2005.
