RESOLUTION NO. 70R-592 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 7R-71-2fi to consider an amendment to Title 18 of t c Ana eim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 22nd day of December , 1970 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the city Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 70-71-21 That portion of tne northeast quarter of the southwest quarter of Section 14, in Township 4 South, Range II West, in the Rancho Los Coyotes, in the County of Orange, State of California, as shmm on a map thereof recorded in book 51, page 11, ~iscellaneous Maps, records of said Orange County, described as follovls: Commencing at a point in the easterly line of the north- east quarter of the south':7est quarter of said Section 14, distant thereon south 00 16' 02" east 674.59 feet from the northeast corner thereof, and running thence south 890 38' 04" west 45.00 feet.; thence soutn 00 16' 02" east, parallel with said easterly line 90.00 feet to the true point of beginning of the boundary of the land herein described; thence continuing south 00 16' 02" east 81.33 feet to the beginning of a tangent curve, concave northwesterly, having a radius of 15.00 feet; thence south%'esterly along said curve, through a central angle of 890 53' 59'l, an arc dis- tance of 23.53 feet to a line tangent; thence south 890 37' 57" west along said, tangent line 84.58 feet to the begin- ning of a tangent curve, concave northeasterly, having a radius of 368.00 feet; thence northwesterly along said curve, through a central angle of 110 28' 4211, an arc distance of 73.72 feet to the ~eginning of a reverse curve, concave southwesterly, having a radius of 432.00 feet; thence westerly along said reverse curve, through a central angle of go 9l! 55", an arc distance of 68.10 feet, a radial line at the end of said rev~~rse curve bears sou'ch 20 04' 44" \'7;c=St; thence nort11 00 22' 03" \.'lest, 80.70 f:::et; thence north 890 3B' 04;' east 240.48 feet to ,the true ]Joint of beginning. be excluded froTa the ?-A, AGRICULTURAL ZONE, and incorporated in the R-l, ONE-FAJ1ILY RESIDENTIAL ZONE, subject to the following conditions: 1. That the owner of subject property shall pay to the city of Anaheim the sum of 159 per front foot along 1/Jesb:~rn Avenue and Stonybrook Drive for tree planting purposes. 2. That the mIner of subject.oroperty shall pay to the City of Anaheim the ap::?ropria'ce park and recreation in-lieu feE:s as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 3. That th3 ovmer of subject property shall pay to .the Citv of Anaheim the sum of s2.00 per front foot alona Sto;qbroo}. Drive and \'lester~ Avenue for street lighting purposes. 4. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1 and 3, above men- tioned I shall b'2 completed. Th.e provisions or rights granted by Ulis resolution shall become null and void Lv action of the City Council unless said conditions are com.?lied with \'Ji t~lil1 180 days from the date hereof or such further time as the City Council may grant. -2- BE IT FURTHER ro~SOLVED that the city Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
