70R-584 -- -- RESOLUTION NO. 70R-584 A RESOLUT~ON OF THE CITY COUNCIL OF THE CITY OF ~HEIM DENYING CONDITIONAL USE PERMIT NOI. 1208 WHEREAS, ~he City Pl~nning Commission of the City of Anaheim did receiv~ a request for a Conditional Use Permit from Kimbrell and Kimbr~ll, Incorporated, 6291 Burnham Avenue, Buena Park, Califo~nia, 90620, owner; Balboa Pacific Develop- ment Company, P.O.iBox 4585, Irvine, California, 92664, agent to establish a 95-unit condominium apartment development with waiver of (1) regu~red number of parking spaces and (2) minimum front setback on the following described property situated in the City of Anahei~, County of Orange, State of California, to wit: Lot Nos. 11 t~rough 31 and 52 through 55 of Tract No. 4643, rec~rded in Book 195, pages 35, 36 and 37 of Miscellaneous Maps, Orange County, California. AND WHER~S, the City Planning Commission did hold a public hearing at ~he City Hall in the City of Anaheim upon said request ono er 16 1970 ~ notices of which said public hearin were duly given as required by law and the provisions of Titl 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, ~aid Commission, After due inspection, in- vestigation and st~dies made by itself and in its behalf and after due consider~tion of all evidence and reports offered at said hearing, did ~dopt its Resolution No. ~r70-?O~ ~~ny;n~ Conditional Use Permit No. l?OS' and WHEREAS, thereafter, within twenty-two (22) days from the date of the adpption of said resolution, a written appeal was filed with the' City Council protesting the action of the City Planning Comm~ssion in denvinq said Conditional Use Permit and saia appeal was set for public hearing on -1- -. December 15. , 19 70 , at the City Hall, in the City of Anaheim, and no~ices of such public hearing were duly given as required by law! and the provisions of Title 18, Chapter 18.76 of the Anaheim Mun~cipal Code; and WHEREAS" at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all p~rsons interested therein an opportunity to be heard and did rece~ve evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all. evidence and reports offered at said hearing, that Conditional Use Permit No. 1208 should be denied.
