RESOLUTION NO. 70R-581
A RESOLU~ION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE ANNEXATION TO THE
CITY OF ANAHEIM OF THE TERRITORY KNOWN AND
DESIGNATBD AS ESPERANZA - ROTH ANNEXATION.
WHEREAS, said Local Agency Formation Commission
authorized the City of Anaheim to annex the territory known and
designated as ESPEnANZA - ROTH ANNEXATION without notice and
hearing and without an election pursuant to the authority vested
in said Commission by Section 54797.1 of the Government Code;
and
WHEREAS, said territory proposed to be annexed to said
City of Anaheim is situated in the County of Orange, State of
California, and is contiguous to the City of Anaheim, and is un-
inhabited territory. That said consent contained a description
of said territory in words and figures as hereinafter in this
resolution described; and
WHEREAS, the City Council of the City of Anaheim is
authorized to approve said annexation by resolution without
notice and hearing pursuant to the approval of said Local Agency
Formation Commission and Section 54797.1 of the Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim finds:
That the City of Anaheim submitted proof satisfactory
to the Local Agency Formation Commission that all of the owners
of land within the territory proposed to be annexed have given
their signed consent to such annexation. That said territory
proposed to be annexed to said City of Anaheim is situated in
the County of Orange, State of California, and is contiguous to
the City of Anaheim, and is uninhabited territory. That said
consent signed by all of the owners of land within the territory
proposed to be annexed contained a description of said territory
in words and figures as hereinafter in this resolution described.
That the City of Anaheim filed said request to annex
said territory, containing the specific boundaries of the terri-
tory to be annexed, with the Local Agency Formation Commission
and said Local Agency Formation Commission approved said annexa-
tion request of the City of Anaheim pursuant to Section 54797.1
of the Government Code.
That on the 14th day of October, 1970, the Local Agency
Formation Commission duly adopted Resolution No. 70-157 in which
said Commission authorized the City of Anaheim to annex said
territory in accordance with Section 54797.1 of the Government
Code and further approved such annexation of said territory with-
out notice or hearing.
That the Local Agency Formation commission, further,
by resolution, authorized the City Council of the City of Anaheim
to annex said territory without notice or hearing by the City
Council and without the requirement that an election be held by
the City on the question of said annexation.
BE IT FURTHER RESOLVED that the annexation of the terri-
tory included within the boundaries of the ESPERANZA - ROTH
ANNEXATION, more particularly described as follows, to wit:

That portion of allotments in decree of partition of
the Rancho Canon de Santa Ana in the County of Orange,
State of California, rendered in Case No. 1978 of the
17th Judicial Court of California, a certified copy of
which was recorded February 8, 1874, in Book 28, Page
150 of Deeds in the office of the County Recorder of
Los Angeles County, California, described as follows:
Beginning at the southeasterly corner of that certain
annexation to the City of Anaheim entitled "Esperanza-
Fairmont"; and running thence northerly along the east-
erly line, North 340 53' 20" West, 1088.75 feet to a
point on a non-tangent curve, concave northwesterly,
having a radius of 3716.93 feet, a radial line through said
point bears North 500 21' 12" West, said curve being
the southerly line of the Atchison, Topeka and Santa
Fe Railroad Company right of way, 100.00 feet in width,
said 100.00 foot strip is also shown on Orange County
Surveyor's File Map No. 3369, said southerly line being
parallel with and 120.00 feet southerly from the center-
line of Esperanza Road as monumented and noted in Orange
County Surveyor's Tie Book 105, page 17 through 20 in-
clusive; thence northeasterly along said curve having a
radius of 3716.93 feet, through a central angle of 010
42' 07" an arc length of 110.41 feet to a point on a
tangent line; thence North 370 56' 41" East, along said
tangent line and said southerly line of the certain
100.00 foot strip of land a distance of 1949.92 feet as
shown on said Tie Book 105, Pages 18 and 19 to the be-
ginning of a tangent curve, concave southeasterly and
having a radius of 3769.83 feet; thence northeasterly
along said curve, through a central angle of 30 27' 27"
and an arc length of 227.49 feet to a point on the east-
erly line of the land described in the deed from
Angeline Y. Kraemer to Samuel Kraemer, recorded Septem-
ber 18, 1915 in Book 270, Page 7 of Deeds; thence South
10 31' 44" East, along said easterly line, a distance
of 2214.53 feet to a point on the northerly line of the
Orange County Flood Control Channel right of way as
shown on Orange County Surveyor's File Map No. 9870;
thence South 600 38' 00" West, along said northerly line,
a distance of 975.02 feet to the point of beginning.
is hereby approved and said territory is hereby annexed to and
incorporated in the City of Anaheim, County of Orange, State of
California, and is hereby designated as the ESPERANZA - ROTH
ANNEXATION to the City of Anaheim.
BE IT FURTHER RESOLVED that from and after the date of
the adoption of this Resolution and the filing of a certified copy
thereof with the Secretary of State of the State of California,
the annexation of the territory herein described shall be deemed
to be and shall be complete and thenceforth such annexed territory
shall be, to all intents and purposes, a part of the City of
Anaheim, and from and after the effective date of such annexation"
all property therein shall be subject to taxation equally with the
property within the City of Anaheim and shall be taxed to pay its
proportionate share of the existing indebtedness and liability of
said City of Anaheim contracted prior to or existing at the time
of such annexation pursuant to the written consent of the owners
of property in said annexed territory filed with the Clerk of the
City of Anaheim prior to the adoption of this Resolution.
