RESOLUTION NO. 70R-534
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AN~IM APPROVING THE ANNEXATION TO THE
CITY OF ANAHEIM OF THE TERRITORY KNOWN AND
DESIGNATED AS ESPERANZA - FAIRMONT ANNEXATION.
WHEREAS, said Local Agency Formation Commission
authorized the Ciqy of Anaheim to annex the territory known and
designated as ESP~ZA - FAIRMONT ANNEXATION without notice and
hearing and without an election pursuant to the authority vested
in said Commission by Section 54797.1 of the Government Code;
and
WHEREAS, said territory proposed to be annexed to said
City of Anaheim is situated in the County of Orange, State of
California, and is contiguous to the City of Anaheim, and is un-
inhabited territory. That said consent contained a description
of said territory in words and figures as hereinafter in this
resolution described; and
WHEREAS, the City Council of the City of Anaheim is
authorized to approve said annexation by resolution without
notice and hearing pursuant to the approval of said Local Agency
Formation Commission and Section 54797.1 of the Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim finds:
That the City of Anaheim submitted proof satisfactory
to the Local Agency Formation Commission that all of the owners
of land within the territory proposed to be annexed have given
their signed consent to such annexation. That said territory
proposed to be annexed to said City of Anaheim is situated in
the County of Oranqe, State of California, and is contiguous to
the City of Anaheim, and is uninhabited territory. That said
consent signed by all of the owners of land within the territory
proposed to be annexed contained a description of said territory
in words and figures as hereinafter in this resolution described.
That the City of Anaheim filed said request to annex
said territory, containing the specific boundaries of the terri-
tory to be annexed, with the Local Agency Formation Commission
and said Local Agency Formation Commission approxed said annexa-
tion request of the City of Anaheim pursuant to Section 54797.1
of the Government Code.
That on the 14th day of October, 1970, the Loca1 Agency
Formation Commission duly adopted Resolution No. 70-158 in which
said Commission authorized the City of Anaheim to annex said
territory in accordance with Section 54797.1 of the Government
Code and further approved such annexation of said territory with-
out notice or hearing.
That the Local Agency Formation Commission, further,
by resolution, authorized the City Council of the City of Anaheim
to annex said territory without notice or hearing by the City
Council and without the requirement that an election be held by
the City on the question of said annexation.
BE IT FURTHER RESOLVED that the annexation of the terri-
tory included within the boundaries of the ESPERANZA - FAIRMONT
ANNEXATION, more particularly described as follows, to wit:

That portion of allotments in Decree of Partition of the
Rancho Canon de Santa Ana, in the County of Orange, State
of California, rendered in Case No. 1978 of the 17th
Judicial District Court of California, a certified copy
of which was recorded February 8, 1874, in Book 28, page
150 of Deeds, in the office of the County Recorder of
Los Angeles County, California, described as follows:
Beginning at the southeasterly corner of that certain
annexation to the City of Anaheim entitled "Imperial
Highway-Espe~anza (Revised)", and running thence North-
erly along t~e easterly line the following bearings and
distances: North 010 15' 37" West, 119.80 feet; thence
North Olo 30' 56" East, 944.95 feet; thence North 00 28'
56" East, 81.03 feet to a point in a non-tangent curve,
concave northwesterly having a radius of 5,779.65 feet,
a radial line drawn through said point bears South 200
30' 23" East, said curve being the southerly line of the
Atchison, Topeka and Santa Fe Railway Company right-of-
way 100.00 feet in width, said 100.00 foot strip is also
shown on Orange County Surveyor's File Map No. 3369, said
southerly line being parallel with and 120.00 feet south-
easterly from the centerline of Esperanza Road, as monu-
mented and noted in Orange County Surveyor's Tie Book 105,
pages 17 through 20 inclusive; thence Northeasterly along
said curve having a radius of 5,779.65 feet, through a
central angle of 030 19' 56" an arc length of 336.13 feet
to a point of compound curvature, concave northwesterly
and having a radius of 2,914.93 feet; thence Northeasterly
along said curve through a central angle of 120 34' and an
arc length of 639.33 feet to a point of compound curvature
having a radius of 1,939.10 feet; thence Northeasterly
along said curve through a central angle of 130 09' an arc
length of 445.04 feet to a point of compound curvature
having a radius of 3,716.93 feet; thence Northeasterly
along said curve through a central angle of 00 47' 53" and
an arc length of 51.77 feet; thence South 340 53' 20" East,
1,088.75 feet to the northerly line of the Orange County
Flood Control Channel right of way, as shown on Orange
County Surveyor's File Map No. 9870; thence South 600 38'
00" West along said northerly line, a distance of 1,839.58
feet to the beginning of a tangent curve concave northwest-
erly and having a radius of 5,780.00 feet; thence South-
westerly along the arc of said curve through a central
angle of 20 57' 36", a distance of 298.60 feet to the
point of beginning.
is hereby approved and said territory is hereby annexed to and
incorporated in the City of Anaheim, County of Orange, State of
California, and is hereby designated as the ESPERANZA - FAIRMONT
ANNEXATION to the City of Anaheim.
BE IT FURTHER RESOLVED that from and after the date of
the adoption of this Resolution and the filing of a certified copy
thereof with the Secretary of State of the State of California,
the annexation of the territory herein described shall be deemed
to be and shall be complete and thenceforth such annexed territory
shall be, to all intents and purposes, a part of the City of
Anaheim, and from and after the effective date of such annexation,
all property therein shall be subject to taxation equally with the
property within the City of Anaheim and shall be taxed to pay its
proportionate share of the existing indebtedness and liability of

said City of Anaheim contracted prior to or existing at the time
of such annexation pursuant to the written consent of the owners
of property in said annexed territory filed with the Clerk of the
City of Anaheim prior to the adoption of this Resolution.
THE FOR$GOING RESOLUTION is approved and signed by me
this 3rd day of November, 1970.
