70R-527 - - RESOLUTION NO. _70R-527 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIM~CE NO. 2204 WHEREAS, tqe City Planning Commission of the City of Anaheim did receive a petition for zoning variance from s a ent for Frank Muller, Trustee of certain real prop rty situated in the City of Anaheim, County of Orange, State of California, described as follows: The Westerly 468.0~ feet of that portion of the Southeast quarter of Section 8, Township 4 South, Range 10 West in the Rancho Los Coyotest in the City of Anaheim, Count~ of ?range, State of California, shown as Parcel 1 on a map f~led ~n Book 10, page 35, of Parcel Maps in the Office of the County Recorder of said C~unty. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of An~1eim upon said petition on sePtemb~r 21, 1970 , notice of which said public hearing was duly giv.n as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -, WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC70-172 granT-ing Variance No. 2204 ; and -1- .- WHEREAS, ~hereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning C~mmission in qranting said variance and did set a public he4iring thereon to be held on the 3rd day of .Novembe~ ' 19 70 , at 1: 30 0' clock P. M. in the City Hall ~n the C~ty of Anaheim and notice of such public hearing was duly given as r$quired by law and the Provisions of Title 18, Chapter 18.76 of th$ Anaheim Municipal Code; and WHEREAS, ~fter due investigation and studies made by itself and in its b.half, and after due consideration of all the evidence and report$ offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances ot conditions applicable to the property involved ~r to the intended use of the property that do nQt apply generally to the property or class of ~se in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation an~ enjoyment of a substantial property right pos$essed by other property in the same vicinity ~nd zone and denied to the property in question. 3. That the ~ranting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the ~ranting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THER$FORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby ~ranted permitting the establishment of a 104-unit apartment 4omp1ex on the property hereinbefore described with waivers of the following Anaheim Municipal Code requirements or limitations, subject to the conditions hereinafter set forth: SECTION 18.28.0$0(2) Minimum building site area per dwelling unit (1200 sq. ft. required; 1195 sq. ft. proposed). . SECTION 18.28.050(7-a) - Minimum distance between buildings (36-2/3 and 28-2/3 ft. required; 33 and 10 feet proposed) . ~~. 1. That this v4riance is granted subject to the completion of Reclassification No. 69-70-27. 2. That subject property shall be developed substantially in accordan$e with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2 and 3, Revision No.2, provided, however, that a 6-foot masonry wall shall ~e constructed along the south and east property lines. -2- The City Council hereby reserves the right to revoke such variance perm~t for good cause or failure of said owner, his successors or _ssigns, to comply with the Anaheim Municipal Code and the regul,tions and the conditions herein. Said variance is grante4i for the term prescribed by the Anaheim Municipal Code unl~ss otherwise specified herein. THE FORE~ING RESOLUTION is approved and signed by me this 3rd day of'November, 1970.
