RESOLUTION NO. 70R-52l
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AND AU~HORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A WAIVER MODIFYING AGREEMENT OF SALE.
WHEREAS, the City Council adopted Ordinance No. 2864
of the City Council of the City of Anaheim on October 28, 1970,
which Ordinance authorized the execution of an agreement whereby
the City acquired land for construction of a golf course; and
WHEREAS, said Ordinance, when introduced, referred to
an Agreement of Sale between Robert H. Grant Corporation and the
City of Anaheim prQviding for the acquisition of real property
for the construction of a golf course; and
WHEREAS, between the first and second readings of said
Ordinance, certain amendments were made to said Agreement of Sale;
and
WHEREAS, the parties desire to enter into a separate
agreement entitled "Waiver Modifying Agreement of Sale," which
document encompasses the waivers and amendments to the Agreement
of Sale.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of the Waiver
Modifying Agreement of Sale be and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are authorized to e~ecute the Waiver Modifying Agreement of Sale
on behalf of the City of Anaheim.
