A RESOLU~ION OF THE CITY COUNCIL OF THE CITY
OF ANAHE]M AUTHORIZING AND DIRECTING THE MAYOR
I
AND CITY iCLERK TO EXECUTE AN AGREEMENT WITH
SOUTHERN !CALIFORNIA EDISON COMPANY RELATIVE TO
SALES T~ OBLIGATIONS (CONDEMNATION NO.5) .
WHEREAS, the City Council of the City of Anaheim has
heretofore authori~ed the filing of a condemnation action, being
entitled IICity of l\naheim vs. Southern California Edison Company,
et aI, II Orange Comity Superior Court Case No. 174845; and
WHEREAS, ,in connection with the ultimate settlement
thereof, there is ~ remote possibility that the State of California
may levy a sales t~x upon certain of the property to be acquired
by the City of Ana~eim; and
WHEREAS, in the event of such a levy, it would be the
obligation of the qity of Anaheim to include such tax in the cost
of the acquisition of the Edison facilities; and
WHEREAS, the City Council finds that the agreement sub-
mitted by the Sout~ern California Edison Company represents a
fair and equitable imethod of dealing with the contingency of such
a tax, and the exeqution of such an agreement would be in the best
interests of the C~ty of Anaheim in connection with the settle-
ment of the eminent domain litigation.
NOW, THE~FORE, BE IT RESOLVED by the City Council of
the City of Anahei~ that it authorize and direct, and it does
hereby authorize aqd direct the Mayor and the City Clerk to
execute the agreem~nt between the City of Anaheim and the Southern
California Edison Company as the same has been this date submitted
to the City for exacution.
THE FOREGOING RESOLUTION is approved and signed by me
this 13th day of Odtober, 1970.
