RESOLUTION NO. 70R-509
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEtM AUTHORIZING AND DIRECTING THE MAYOR
AND CITY CLERK TO EXECUTE AN AGREEMENT WITH
SOUTHERN. CALIFORNIA EDISON COMPANY RELATIVE TO
CONDm1NATION INVENTORY (CONDEMNATION NO.5) .
WHEREAS, the City Council of the City of Anaheim has
heretofore authoriZed the filing of a condemnation action, being
entitled "City of Anaheim vs. Southern California Edison Company,
et aI," Orange county Superior Court Case No. l74845~ and
WHEREAS, in connection with the ultimate settlement
thereof, certain portions of the "system" being condemned may
change between the time of agreed settlement and the entry of the
Final Order of Con8emnationi and
WHEREAS, it is in the best interests of the City of
Anaheim to agree to an equitable arrangement of credits,and debits
to reflect the true and correct value of the property ultimately
condemned~ and
WHEREAS, the City Council finds that the agreement sub-
mitted by the Southern California Edison Company represents a
fair and equitable method of making such adjustment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anahei~ that it authorize and direct and it does hereby
authorize and direct the Mayor and the City Clerk to execute the
agreement between the City of Anaheim ana the Southern California
Edison Company as the same has been this date submitted to the
City for execution.
THE FOREGOING RESOLUTION is approved and signed by me
this 13th day of October, 1970.
