A RESOLU~ION OF THE CITY COUNCIL OF THE CITY
OF ANAHE~ APPROVING AND AUTHORIZING THE
EXECUTIO OF AN AGREEMENT WITH SOUTHERN PACIFIC
TRANSPO ATION COMPANY, GRANTING TO THE CITY
THE RIGH TO CONSTRUCT AND OPERATE A SEVENTY-
FIVE INC REINFORCED CONCRETE STORM DRAIN BE-
NEATH TH TRACKS AND PROPERTY OF SAID COMPANY
AT OR N R SOUTH ANAHEIM, CROSSING THE CENTER
LINE OF AID TRACKS AT ENGINEER STATION 1259+
90, MILE POST BM-512.20.
WHEREAS, ,the Southern Pacific Transportation Company,
a corporation of ~e State of Delaware, has tendered to the City
of Anaheim an Inde~ture granting to the City of Anaheim, subject
to the reservation;, covenants and conditions the.rein ,contained,
the right to const uct, reconstruct, maintain and operate a
seventy-five inch einforced concrete storm drain, beneath the
tracks and property of said Company at or near South Anaheim,
in the County of O~ange, State of California, crossing the center
line of said track. at Engineer Station 1259+90, Mile Post
BM-512.20, in the ~ocation shown on the print of said Company's
Los Angeles DivisiQn Drawing A-935l, Sheet No.1, dated July 9,
1970, attached to 4nd made a part of the Indenture above men-
tioned; and
WHEREAS, ,the City Council finds that said Indenture,
tendered to the Ci*y to be made and entered into be~een the
parties, would be for the benefit and in the best iriterest of
the City and should be approved.
NOW, THEtFORE' BE IT RESOLVED by the City Council of
the City of Anahei that the Indenture tendered to the City of
Anaheim by the Sou ern Pacific Transportation Company, a corpora-
tion of the State ',f Delaware, granting to the City, but subject
to the reservation$, covenants and conditions therein contained,
the right to consttuct, reconstruct, maintain and operate a
seventy-five inch ~einforced concrete storm drain, beneath the
tracks and propertt of said Company at or near South Anaheim, in
the County of Oran$e, State of California, crossing the center
line of said track$ at Engineer Station 1259+90, Mile Post
BM-512.20, as hereinabove more particularly described, be, and
the same is hereby, approved and accepted.
BE IT FU~THER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said
Indenture for and ~n behalf of the City of Anaheim.
THE FORE~OING RESOLUTION is approved and signed by me
