A RESOLUTlON OF THE CITY COUNCIL OF THE CITY
OF ANAHEI~ APPROVING AND AUTHORIZING THE
EXECUTIONi OF AN AGREEMENT WITH SOUTHERN PACIFIC
TRANSPORT~TION COMPANY, GRANTING TO THE CITY
THE RIGHTiTO CONSTRUCT AND OPERATE A FIFTY-ONE
INCH REliNORCED CONCRETE STORM DRAIN BENEATH
THE TRAC 'AND PROPERTY OF SAID COMPANY AT OR
NEAR SOUT ANAHEIM, CROSSING THE CENTER LINE
OF SAID TRACKS AT MILE POST BM-512.41-X.
WHEREAS, the Southern Pacific Transportation Company,
a corporation of th~ State of Delaware, has tendered to the City
of Anaheim an Inden1ture granting to the City of Anaheim, subject
to the reservations, covenants and conditions therein contained,
the right to constrpct, reconstruct, maintain and operate a
fifty-one inch rein~orced concrete storm drain, beneath the
tracks and property of said Company at or near South Anaheim,
in the County of Orange, State of California, crossing the center-
line of said tracks! at Mile Post BM-5l2.4l-X, in the location
shown on the print of said Company's Los Angeles Division Drawing
A-935l, Sheet No.2, dated July 9, 1970, attached to and made a
part of the Indenture above mentioned; and
WHEREAS, ithe City Council finds that said Indenture
tendered to the Ci~ to be made and entered into between the
parties, would be fbr the benefit and in the best interest of the
City, and should be approved.
NOW, THE~ORE, BE IT RESOLVED by the City Council of
the City of Anahe~ that the Indenture tendered to the City of
Anaheim by the sou!ern Pacific Transportation Company, a cor-
poration of the St · e of Delaware, granting to the City, but
subject to the res, vations, covenants and conditions therein
contained, the rig~ to construct, reconstruct, maintain and
operate a fifty-one inch reinforced concrete storm drain, beneath
the tracks and property of said Company at or near South Anaheim,
in the County of O~ange, State of California, crossing the center-
line of said tracks at Mile Post BM-512.41-X, as hereinabove
more particularly described, be, and the same is hereby, approved
and accepted.
BE IT FU~HER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said Inden-
ture for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
