70R-438 RESOLUTION NO. 70R-438 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PEP~IT NO. 1194. WHEREAS, the City Planning Commission of the City of F~aheim did receive an application for a conditional use permit from Pierce C. Ommanney, 1019 West La Palma Avenue, Anaheim, California, to expand an existing psychological guidance center to encompass certain remedial educational and vocational facilities on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1 and 2: All that certain land situated in the Rancho San Juan Cajon de Santa Ana, described as follows, to wit: That portion of Lot 10 of the "I-hles Rancho" as shown on a map thereof recorded in book 4, page 7 of Miscellaneous Maps, records of Orange County, California described as beginning at a point on the South line of Lot 10, 163.00 feet Easterly from the Southwest corner of said Lot 10; thence North 00 29' 10 a West, parallel with the \~est line of said Lot 10, 160.00 feet; thence North 890 42' 0011 East, parallel with the south line of Lot 10, 174.19 feet; thence South 00 24' 00" East 160.00 feet to the South line of Lot 10; thence South 890 42' 00" West 173.95 feet to the point of beginning. EXCEPTING THEREFROlvl an undivided one-half interest in all oil, gas, and other hydrocarbons and minerals situated therein and thereunder, as excepted in the deed dated July 10, 1942 executed by the Bank of America National Trust and Savings Association in favor of David Corderman and wife, and recorded in book 1156, page 18 of Official Records, in the office of the county recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on August 10, 1970, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter l8.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC 70-149, granting Conditional Use Permit No. 1194; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 8th day of September, 1970, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEP~AS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful considera- tion of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. -3- _""""'"_..,.... "-0..-..., ..~__~, 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designated and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the condit~ons imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said conditional use permit be, and the same is hereby sustained, and that Conditional Use Permit No. 1194 be, and the same is hereby, granted permitting the expansion of an existing psychological guidance center to encompass certain remedial edu- cational and vocational facilities on the property herein before described with waivers of the following Anaheim Municipal Code provisions: SECTION l8.40.070(2A-l) Minimum required building setback adjacent to an arterial highway. SECTION l8.62.090(B-2) Minimum sign elevation. That said conditional use permit be granted subject to the follow- ing conditions: 1. That this conditional use permit is granted subject to the completion of Reclassification No. 70-71-8. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4, and 5. The City Council hereby reserves the right to revoke such conditional use permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
