A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE EXECUTION OF AN
AGREEMENT WITH THE ATCHISON, TOPEKA AND SANTA
FE RAILW1Y COMPANY GRANTING TO THE CITY A
LICENSE to CONSTRUCT AND OPERATE A FIFTY-ONE
INCH STO~ DRAIN ACROSS THE RIGHT OF WAY AND
UNDER THt TRACKS AT MILE POST 169, PLUS 3512.7
FEET NE~ ANAHEIM, AND AUTHOR! ZING THE MAYOR
AND CITY CLERK TO EXECUTE SAID AGREEMENT.
WHEREAS, the Atchison, Topeka and Santa Fe Railway
Company has tender~d to the City of Anaheim a License Agreement
granting to the City the right to construct and operate and main-
tain a fifty-one i~ch reinforced concrete pipe for the conveying
of storm drainage waters beneath the tracks and property of the
Atchison, Topeka ahd Santa Fe Railway Company in the approximate
location shown in red on Drawing No. L-5-30834 dated July 24,
1970, attached to and made a part of the agreement hereinabove
mentioned: and
WHEREAS, the City Council finds that it would be in
the best interest of the City of Anaheim to approve said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anahe~ that the License Agreement tendered to the
City of Anaheim by the Atchison, Topeka and Santa Fe Railway
Company granting to the City the right to construct, operate and
maintain a fifty-one inch reinforced concrete pipe line for the
conveying of storm drainage waters beneath the tracks and property
of the Atchison, Topeka and Santa Fe Railway Company at the
approximate locat~on shown in red on Drawing No. L-5-30834 dated
July 24, 1970, attached to and made a part of the agreement
hereinabove mentioned be, and the same is hereby, approved and
accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized to execute said agreement herein-
above mentioned f~r and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 1st day of September, 1970.
