RESOLUTION NO. 70R- 416
A RESOLU~ION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM UTHORIZING THE SETTLEMENT OF CERTAIN
EMINENT OMAIN LITIGATION AND AUTHORIZING AND
DIRECTIN THE EXECUTION OF AN AGREEMENT IN
CONNECTIqN THEREWITH.
WHEREAS, iheretofore, on the 5th day of November, 1968,
the City of Anahei~ filed a suit in eminent domain to condemn a
certain parcel of ~and for access to a City Park, known as
Chaparral Park, bei~g Superior Court Action No. 163394, entitled
"CITY OF ANAHEIM VSI. SOUTHERN CALIFORNIA BAPTIST CONVENTION, et
al ii; and
WHEREAS, !in lieu of taking all of the property involved
in said litigation '~'t has been determined that a portion of said
property can be ret ined by the Southern California Baptist Con-
vention for the ere tion of a church on said property while the
remainder will adeq ately serve the City of Anaheim for the pur-
poses for which it was condemned; and
WHEREAS, ~he City Council finds that it is in the best
interest of the CitW of Anaheim to enter into an agreement whereby
the City will acqui~e a portion of said property sought to be con-
demned and will imp~ove the same while the Southern California
Baptist Convention ~ill retain the remainder; and
WHEREAS, ~der the terms of such agreement the City
will have the optio~ to purchase the entire property sought to be
condemned for the s~ of $30,000.00, if the Southern California
Baptist Convention decides not to proceed with the establishment
of a church on said! site.
NOW, THE$FORE, BE IT RESOLVED by the City Council of
the City of Anaheimi that it settle and conclude said eminent
domain litigation b~ accepting and it does hereby accept an ease-
ment grant deed for' parking and ingress and egress to Chaparral
Park more particula~ly described as follows:
An easement fo~ parking, ingress and egress to Chaparral
Park over the ~ollowing described real property situated
in the City of Anaheim, County of Orange, State of
California:
The easterly 9a.08 feet of the South one-third of the
East half of t~at portion of the Southeast quarter of
Section 17, To~ship 4 South, Range 10 West, in the
Rancho San Juap Cajon de Santa Ana, that is included
within the fol~owing described lines:
Beginning at tpe Northwest corner of the lands formerly
of Lumis A. Ev~ns, being a point on the South line of
Broadway, also being a point Westerly 660.00 feet, more
or less, from the centerline of Euclid Street; thence
South 1320.00 ~eet to the South line of said Northeast
quarter; thenc~ West 990.00 feet to a stake; thence North
1320.00 feet to said South line; thence East 990.00 feet
to the point of beginning.
BE IT FURtHER RESOLVED that the Mayor and the City
Clerk respectively"be and they are hereby, authorized and directed
to execute that certain agreement between the City of Anaheim and
Southern California Baptist Covention dated the 18th day of
August, 1970.
