70R-403 - ~SOLUTION NO. 70R-403 A RESOLUTIO~ OF THE CITY COUNCIL OF THE CITY OF AN EIM FINDING AND DETERMINING THAT TITLE 8 OF THE ANAHEIM MUNICIPAL CODE RELATI G TO ZONING SHOULD BE AMENDED AND THAT TH BOUNDARIES OF CERTAIN ZONES SHOULD BE C ANGED. WHEREAS, th~ City Planning Commission of the City of Anaheim did hold a puijlic hearing in Reclassification Proceed- ings No. 70-71-1 to consider an amendment to Title 18 0 t e Ana e m Mun1c1pal Code relating to zoning, and to consider a change n the boundaries of the zone or zones hereinafter mentioned. and described, and at said hearing did receive evidence and ~eports from persons interested therein and from its staff; a~d WHEREAS, wi~hin a period of forty days following said hearing the Planning qommission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hea~ing, and a recommendation that the pro- posed amendment be ad~pted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upqn receipt of said resolution, summary of evidence, report of f~ndings and recommendation of the City Planning Commission t~e City Council did fix the 11th day of AUQUst, 19 70 as the time, and the City Council Chambers in the City .all of the City of Anaheim as the place for a public hearing ~pon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situa~ed and the incorporation thereof in the zone or zones hereina~ter set forth, and did give notice there- of in the manner and torm as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Coun~il did hold and conduct such public hearing and did give .11 persons interested therein an oppor- tunity to be heard, a~d did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing b~fore the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded fr~m the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREF~RE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 70-71-1 That portion of the Northeast quarter of the Southeast quarter of Sec~ion 15, Township 4 South, Range 11 West, in the Rancho tos Coyotes, County of Orange, State of California, asishown on a Map by Charles T. Healey upon survey made by him about 1870 for the Stearns Ranchos Company, descr~bed as follows: Beginning at aipoint on the East line of said Section 15, North 2366.76 ~eet from the Southeast corner thereof; thence West 18Q feet; thence North parallel with said East line to the No~th line of said Southeast quarter of Section 15; thence East 180 feet to the East line thereof; thence South 302.07 f~et to the point of beginning. be excluded from R-4, Agricultural Zone, and incorporated in C-l, General Commercial ~one, upon the following conditions: 1. That the qwner of subject property shall deed to the City of ~aheim a strip of land 45 feet in width from the cente~line of the street along Orange Avenue for street wi4ening purposes. 2. That all ~ngineering requirements of the City of Anaheim a~ong Orange Avenue, including preparation of improveme~t plans and installation of all improvements such as c*bs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shal]4 be complied with as required by the City Engineer ~d in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Orange and Knott Avenues shall be installed as required by the Director df Public Utilities and in accordance with standard plans and specifications on file in the office of the Di~ector of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim sQall be posted with the City to guarantee the installation of the above-mentioned requirements. 3. That the qwner of subject property shall pay to the City of Anaheim the sum of l5~ per front foot along Orange and Knott .Avenues, for tree planting purposes. 4. That trash storage areas shall be provided in accordance with apprqved plans on file with the office of the Director af Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 6. That all ~ir-conditioning facilities shall be properly shielded from view. 7. That any ~arking area lighting proposed shall be down- lighting qf a maximum height of 6 feet, which lighting shall be ~irected away from the property lines to protect the residential integrity of the area. 8. Prior to the introduction of an ordinance rezoning subject pJfoperty, Conditions Nos. 1,2, and 3, above mentioned~ shall be completed. The provisions or rights gr4nted by this resolution shall become null and void ~y action of the City Council unless said condition$ are complied with within 180 days from the date ~ereof, whichever occurs first, or such further time as t~e City Council may grant. 10. That Cond~tions Nos. 4, 5, 6, 7, and 8, above mentioned, shall be ~omplied with prior to final building and zoning in$pections. BE IT FURtHER RESOLVED that the City Attorney be, and he is hereby author zed and directed to prepare and submit to the City Council an.ordinance amending Title 18 of the Anaheim Municipal Code to a~complish the objects herein found and determined to be ne~essary and proper.
