70R-395 - RESOLUTION NO. 70R-395 A RESOLUTI~N OF THE CITY COUNCIL OF THE CITY OF AN~EIM FINDING AND DETERMINING THAT TITLE~' 18 OF THE ANAHEIM MUNICIPAL CODE RELAT NG TO ZONING SHOULD BE AMENDED AND THAT T E BOUNDARIES OF CERTAIN ZONES SHOULD BE (HANGED. WHEREAS, t~e City Planning Commission of the City of Anaheim did hold a p~blic hearing in Reclassification Proceed- ings No. 69-70-6i to consider an amendment to Title 18 of the Anah im Municipal Code relating to zoning, and to consider a change 'in the boundaries of the zone or zones hereinafter mentione4 and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, w~thin a period of forty days following said hearing the Planning !Commission did duly adopt a resolution containing a report Qf its findings, a summary of the evidence presented at said he~ring, and a recommendation that the pro- posed amendment be aqopted by the City Council and that a certain zone or zonea be changed as hereinafter set forth; and WHEREAS, uBon receipt of said resolution, summary of evidence, report of ~indings and recommendation of the City Planning Commission the City Council did fix the 4th day of August , 19 70 as the time, and the City Council Chambers in the City 'Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Munici!pal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situ~ed and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and 'form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Coun~il did hold and conduct such public hearing and did give ~ll persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon conside~ the summary of evidence presented at said public hearing b~fore the Planning Commission, its report of findings and reco~endation; and WHEREAS, th~ City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded fr~m the zone or zones in which it is now situated and incorpor~ted in the zone or zones as hereinafter set forth. NOW, THEREF~RE, BE IT RESOLVED by the City Council of the City of Anahei$ that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of C~lifornia, to wit: 69-70-66 -1- Tract No. 325e and Lot No. 13. recorded in Book 99. pages 19-20, Miscel~aneous Maps, in the Office of the Orange County Recorder. be excluded from R~A. Agricultural Zone, and incorporated in C-l. General Comme*cial Zone. upon the following conditions: 1. That str~et lighting facilities along Katella Avenue and Humo* Drive shall be installed as required by the Director of Public Utilities and in accordance with standard ,plans and specifications on file in the office of the D~rector of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installa- tion of the above-mentioned requirement. 2. That the owners of sUbject property shall pay to the City of ~naheim the sum of 15~ per front foot along Katella ~venue and Humor Drive. for tree planting purposes. 3. That the [driveways shall be installed along Katella Avenue ~d Humor Drive as required by the City Engineer and in a~cordance with approved plans on file with the office of the City Engineer. 4. That trasp storage areas shall be provided in accord- ance wit~ approved plans on file with the office of the Diredtor of Public Works. 5. That fire' hydrants shall be installed as required and determineki to be necessary by the Chief of the Fire Departmenrt . 6. That subj~ct property shall be served by underground utilities,. 7. That a 6-foot masonry wall shall be constructed along the north property line. 8. That all ~ir-conditioning facilities shall be properly shielded ~rom view and the sound buffered from adjacent residences. 9. That any parking area lighting proposed shall be down- lighting pf a maximum height of 6-feet. which lighting shall be directed away from the property lines to protect the residential integrity of the area. 10. That subj~ct property shall be developed sUbstantially in accord~ce with plans and specifications on file with the City of Anaheim. marked Exhibits Nos. 1. 2. and 3. 11. Prior to the introduction of an ordinance rezoning sub- ject prop$rty. Conditions Nos. 1 and 2. above-mentioned, shall be ~ompleted. The provisions or rights granted by this r~solution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof or such further time as the City Council may grant. 12. BE IT FUR~ER RESOLVED that the City Attorney be, and he is hereby authori~ed and directed to prepare and submit to the City Council an prdinance amending Title 18 of the Anaheim Municipal Code to ac~omplish the objects herein found and determined to be nec~ssary and proper.
